Hazdovac v. MBUSA Settlement: Covered Parts, Claims, and Payouts

The Hazdovac v. MBUSA settlement is a proposed resolution of a class action against Mercedes-Benz USA alleging the automaker failed to classify fourteen emissions-related parts as “high-priced” under California’s emissions warranty rules, which would have extended their coverage to seven years or 70,000 miles. If the court grants final approval, owners and lessees of qualifying 2015-and-newer Mercedes-Benz vehicles registered in any of seventeen states can get 50% reimbursement for past out-of-pocket repairs on those parts, 100% reimbursement for diagnosis-only visits, and free coverage for future repairs on those parts through the 7-year/70,000-mile mark. Mercedes-Benz denies wrongdoing and settled to end the litigation.1ClassAction.org. Hazdovac v Mercedes-Benz USA Settlement Agreement

Do You Qualify

The class includes anyone who purchased or leased a Mercedes-Benz vehicle of model year 2015 or later (excluding electric vehicles) that carries a high-priced-parts emissions warranty, so long as the vehicle was registered in one of seventeen states that follow California’s emission standards under Section 177 of the Clean Air Act.2ClassAction.org. Hazdovac v Mercedes-Benz USA Preliminary Approval Order Those states are California, Colorado, Connecticut, Delaware, Maine, Maryland, Massachusetts, Minnesota, Nevada, New Jersey, New York, Oregon, Pennsylvania, Rhode Island, Vermont, Virginia, and Washington.3Hazdovac Emissions Warranty Settlement. Coverage does not begin in the same year everywhere. Most states are covered from model year 2015 on. Colorado-registered vehicles are covered starting with model year 2022, and Minnesota, Nevada, and Virginia starting with 2025.4Claim Depot. Hazdovac Emissions Warranty Settlement

What You Can Recover

Two things are on offer: cash reimbursement for past repairs, and extended warranty protection going forward.

Past Repairs

If you already paid out of pocket at an authorized Mercedes-Benz service center for work on any of the fourteen parts, and the service happened after your standard 4-year/50,000-mile warranty ran out but before you hit 7 years or 70,000 miles, you can claim:1ClassAction.org. Hazdovac v Mercedes-Benz USA Settlement Agreement

  • 50% of your out-of-pocket cost for a repair or replacement, including parts, labor, and diagnostic charges.
  • 100% of your out-of-pocket cost when the visit was diagnosis only (labor and diagnostic charges).

Extended Warranty Going Forward

Once the settlement takes effect, Mercedes-Benz will cover 100% of the cost of repairing, replacing, or diagnosing any of the fourteen parts on qualifying vehicles that are past the 4-year/50,000-mile mark but still within 7 years or 70,000 miles. The coverage attaches to the vehicle, so it transfers to a subsequent owner.1ClassAction.org. Hazdovac v Mercedes-Benz USA Settlement Agreement

Deadlines and How to File

The deadline for claims covering repairs performed before March 16, 2026, was May 15, 2026, and that window has closed. For any qualifying repair or diagnosis performed on or after March 16, 2026, a claim must be filed within 60 days of the service date.5Hazdovac Emissions Warranty Settlement. FAQs

If You Did Nothing, or Opted Out

The opt-out deadline was April 30, 2026.5Hazdovac Emissions Warranty Settlement. FAQs Class members who did not opt out are bound by the settlement’s release of claims, meaning they cannot separately sue Mercedes-Benz over the fourteen parts covered here, whether or not they filed a claim. The release does not extend to personal injury claims, unrelated matters, or any contractual coverage that lasts beyond 7 years/70,000 miles.1ClassAction.org. Hazdovac v Mercedes-Benz USA Settlement Agreement Class members who validly opted out kept the right to sue on their own but are ineligible for any settlement benefits, including the extended warranty.
