Hello Wisp Lawsuit: Allegations, Claims, and Payment Dates

The Hello Wisp lawsuit is a proposed class action settlement over allegations that the telehealth company Wisp, Inc. shared customers’ personal and health information with Meta, Google, Microsoft, and TikTok through tracking pixels on hellowisp.com. Under the deal, eligible U.S. customers who bought a product on the site between February 1, 2018, and September 9, 2025, can receive $18 by filing a claim through wispclasssettlement.com by July 13, 2026. A Florida judge granted preliminary approval on April 14, 2026, and a final approval hearing is set for August 5, 2026.¹²

What the Lawsuit Alleges

Wisp is a direct-to-consumer telehealth platform that handles sexual and reproductive health care, including treatment for UTIs, yeast infections, bacterial vaginosis, herpes, and birth control.³ The complaint says the company installed the Meta Pixel, the Facebook Conversions API, Google Analytics, Google Tag Manager, TikTok tracking codes, and Bing tracking codes on hellowisp.com, and that those tools transmitted customer activity to the platforms behind them.⁴

According to plaintiffs, the data captured went beyond ordinary browsing. It included specific medical conditions and symptoms, health questionnaire responses, treatment recommendations, medications added to cart, and personal identifiers such as names, email addresses, ages, zip codes, IP addresses, and Facebook user IDs.⁴ When a customer was logged into Facebook, cookies allegedly linked that customer’s health-related activity on the site directly to their Facebook profile. Plaintiffs say none of this was disclosed to or authorized by customers.⁵

Wisp denies wrongdoing. The company says on the settlement website that it “maintains that it did nothing wrong” and agreed to the deal “to avoid the expense, burden, and uncertainties associated with continuing the case.”²

Who Qualifies for a Payment

The settlement class covers all living United States citizens who purchased a product on hellowisp.com between February 1, 2018, and September 9, 2025.⁵ Each class member who submits a valid claim receives a flat $18 cash payment.²

If you only browsed the site without buying anything, you are outside the class as defined. Most class members should have received an emailed settlement notice with a unique class member ID.

How to File a Claim

Claims are due by July 13, 2026. You have two options:

File online at wispclasssettlement.com using the class member ID from your emailed notice.⁶
Mail a completed paper claim form to Kroll Settlement Administration LLC, PO Box 225391, New York, NY 10150-5391, postmarked by July 13, 2026.²

If you believe you qualify but never got a notice, call the claims administrator at (833) 447-6794 to verify your identity and get filing instructions.⁶ Kroll Settlement Administration LLC is running the claims process.⁷

Opting Out or Objecting

If you don’t want to be bound by the settlement, you can exclude yourself. If you want to stay in the class but tell the court why you think the deal is unfair, you can file an objection. Both are due by July 13, 2026, the same date as claim submissions. Objections must be filed with the court and mailed to both class counsel and the defendant’s counsel, and must include your reasons and any supporting evidence.⁸ Doing nothing means you give up the right to sue Wisp over these claims but receive no payment.

Case Status and When Payments Go Out

The case is Sophin v. WISP, Inc., case number CACE26001543, in the Circuit Court of the 17th Judicial Circuit in Broward County, Florida, before Hon. Fabienne E. Fahnestock.¹ It alleges violations of the Florida Security of Communications Act, the California Invasion of Privacy Act, the federal Electronic Communications Privacy Act, and negligence.²

Preliminary approval was granted on April 14, 2026, and proceedings are stayed until the final approval hearing on August 5, 2026, at 8:30 a.m. ET, held by Zoom.¹² Payments will not be distributed until the court grants final approval and any appeals are resolved.⁵ Class counsel is Jeff Ostrow of Kopelowitz Ostrow P.A. Named plaintiff Annette Sophin may seek up to $5,000 as a service award, subject to court approval.⁸

How This Case Got Here

An earlier federal class action against Wisp was filed on November 28, 2023, in the Northern District of California (case 4:23-cv-06155), raising broader claims under federal and multiple state privacy and consumer protection laws.⁴ Plaintiffs voluntarily dismissed that case on July 31, 2024.⁹ A separate California state action was also filed in San Mateo County on behalf of California purchasers.¹⁰ The Florida Sophin case is the one that produced the current settlement, and it is the case under which you file a claim.
