HelloFresh $7.5 Million Settlement: Refunds, Claims, and Changes

HelloFresh has agreed to pay $7.5 million to settle a California consumer protection lawsuit accusing the meal kit company of enrolling customers in automatic renewal subscriptions without proper disclosure, making cancellation difficult, and running misleading “free meals” and “free shipping” promotions. A Santa Clara County Superior Court judge approved the deal on August 14, 2025. About $1 million is set aside for consumer restitution, and eligible California customers have until December 17, 2025 to file a claim. Who Qualifies for a Refund

The restitution fund is limited to California consumers, and the criteria are strict. To be eligible, you must meet all four of the following:

  • You were enrolled in a HelloFresh automatic renewal subscription between January 1, 2019 and August 18, 2025.
  • You were charged for your first shipment without your knowledge or consent.
  • You canceled the subscription after that first shipment.
  • You never received a refund from HelloFresh.

How to File a Claim

Claims can be submitted online at grocery-settlement.com or mailed to the claims administrator, Kroll Settlement Administration LLC, at PO Box 225391, New York, NY 10150-5391. The filing deadline is December 17, 2025.3Grocery Settlement (Claims Administrator). HelloFresh Restitution Program

What HelloFresh Was Accused of Doing

The civil complaint, filed as People of the State of California v.   • Failed to clearly disclose, before collecting payment, that customers were signing up for an automatic renewal.
  • Charged credit and debit cards without obtaining affirmative consent to the recurring charges.
  • Did not send the post-enrollment confirmation of material terms required by state law.
  • Did not offer an easy-to-use cancellation mechanism.
  • Advertised “free meals,” “surprise gifts,” and “free shipping” without disclosing the conditions and purchase obligations attached to those offers.

The complaint alleged violations of California’s Automatic Renewal Law (Business and Professions Code § 17600 et seq.) and the state’s False Advertising Law. Where the $7.5 Million Goes

  • $6.38 million in civil penalties paid to the prosecuting agencies, with roughly $1.06 million earmarked for the Santa Clara County DA’s office to fund future consumer protection enforcement.
  • $1 million in consumer restitution for eligible California customers.
  • $120,000 to reimburse investigative costs.

What HelloFresh Has to Change

  • Presenting automatic renewal terms prominently before payment is collected, including that the subscription continues until canceled, how to cancel, the recurring charge amount, the term length, and any minimum purchase obligations.
  • Obtaining express consent to those renewal terms through a checkbox or dedicated consent button placed adjacent to the disclosures.
  • Sending a post-purchase email confirmation promptly after each order, with a subject line that clearly identifies it as a transaction confirmation.
  • Letting online sign-ups cancel entirely online, without obstruction, through a prominently placed cancellation link in account settings.
  • Dropping misleading button labels and payment page designs, and showing a summary of any pending order with a chance to cancel or modify it before the charge posts.

HelloFresh’s Response

HelloFresh spokesperson Abby Dreher said the company “takes our commitment to customer transparency very seriously” and that “our subscription model and cancellation policies have been consistently clear to customers throughout the whole customer journey.” Dreher added: “While we deny any wrongdoing, we have cooperated fully with the coalition of California District Attorneys and have entered into a settlement agreement with them to resolve the matter amicably.”2Jeff Rosen, Santa Clara County District Attorney.
