The HFH class action settlement is a $141 million agreement resolving claims that Henry Ford Health failed to protect patients from Dr. Oumair Aejaz, a hospitalist who secretly recorded and, in some cases, sexually assaulted patients at Henry Ford Macomb Hospital and other system facilities. Macomb County Circuit Court Judge James Maceroni approved the settlement on October 31, 2025. Who Qualifies as a Class Member
You are in the class if you were treated, evaluated, or provided professional services by Dr. Aejaz between January 1, 2018, and August 8, 2024, at any hospital owned or operated by Henry Ford Health. Eligibility is based on medical records confirming that Aejaz treated you. You do not have to prove that he actually recorded or assaulted you to receive the baseline payment, which reflects the fact that many patients have no way of knowing whether they appear in the thousands of videos investigators recovered.2Expert Institute. How Much You Can Receive
The settlement is paid out in two phases. Everyone in the class gets something from the first phase; the second phase is reserved for patients who can show they were recorded or assaulted.
Phase One: $25 Million Baseline Fund
Henry Ford Health pays $25 million upfront. Each of the roughly 8,200 class members receives $5,000 from this fund, minus attorneys’ fees and costs. No proof of recording or assault is required. Phase Two: Up to $100 Million for Verified Victims
Henry Ford Health funds a second pool of up to $100 million for class members who can demonstrate specific harm. A court-appointed special master reviews claims and assigns payments on two tiers:
- Patients who were video-recorded in a state of undress or in a sexualized manner, without physical contact, are eligible for $75,000 to $275,000.
- Patients who provide proof of sexual assault involving contact or penetration are eligible for $1 million to $2 million. The special master may award up to an additional $1.5 million to a patient in this tier who submits a written statement describing the harm suffered.

The settlement is administered by Garretson, a third-party claims administrator. Class members who received a notice can log in at hfhclassactionsettlement.com using the personalized Notice ID and Confirmation Code printed on that notice. If You Want to Sue Separately
Three women filed individual lawsuits in October 2025 alleging that Aejaz sexually assaulted and recorded them at Henry Ford Macomb Hospital. Represented by Fieger Law, they chose to proceed individually because they believed their claims were not adequately represented by the class action. Those cases are separate from the $141 million settlement and are not resolved by it.7CBS News Detroit. Other Henry Ford Health Settlements With Similar Names
The phrase “HFH class action settlement” has been used for at least two other unrelated cases against Henry Ford Health, and the notices look similar enough to cause confusion.
A $12.29 million settlement resolved allegations that Henry Ford Health embedded tracking tools such as Meta Pixel and Google Analytics on its website and MyChart patient portal, sharing patient data with third parties without consent. That case is also captioned McClain v. Henry Ford Health but carries a different docket number (Case No. 2:24-cv-11739). A third case, Hundley et al. v. Henry Ford Health System (Case No. 2:21-cv-11023-SFC), was brought by employees who claimed the health system breached its fiduciary duties in managing their retirement plans. The $141 million case involving Dr. Aejaz’s recordings and assaults is by far the largest of the three and is the settlement most people mean by “HFH class action settlement.” If the notice you received references MyChart, tracking pixels, or a retirement plan, you are looking at a different case with its own claim portal.
