How long it takes to freeze assets ranges from a few hours to several months, and the single biggest variable is who is doing the freezing. A federal agency acting under its own statutory authority can lock a bank account the same day. A private party suing someone has to persuade a judge first, which usually takes weeks. Emergency orders can collapse that timeline to a single day when the evidence justifies it, and assets sitting in other states or countries can stretch it out indefinitely.
Government Agencies: Hours to About 30 Days
Federal agencies move fastest because many of them don’t need a court order at all.
IRS Bank Levies
For back taxes, the IRS runs a structured clock. It must send a Final Notice of Intent to Levy at least 30 days before taking action.1Internal Revenue Service. What Is a Levy If that window closes without resolution, the IRS sends a levy notice to the bank, and the bank freezes the funds up to the amount owed as soon as it receives the notice. A 21-day holding period then runs before the bank actually hands the money over.2Internal Revenue Service. Information About Bank Levies
So the full timeline from first warning to money leaving your account is at least about 51 days. The freeze itself, from the bank’s point of view, is immediate.
The exception is a jeopardy levy. When the IRS believes collection is at risk, usually because someone is leaving the country or actively moving funds, it can skip the standard notice and seize property right away.3Office of the Law Revision Counsel. 26 USC 6331 – Levy and Distraint
OFAC Sanctions
The Treasury Department’s Office of Foreign Assets Control works on a different model entirely. Under the International Emergency Economic Powers Act, the President can authorize blocking the assets of designated foreign nationals, and OFAC adds those names to its Specially Designated Nationals list.4Office of the Law Revision Counsel. 50 USC 1702 – Presidential Authorities The moment a name is added, every U.S. person and financial institution holding that party’s property must block it.5U.S. Department of the Treasury. Specially Designated Nationals (SDNs) and the SDN List No advance notice, no hearing, no waiting period. The list updates without a fixed schedule.
Criminal Seizure Warrants
Federal law enforcement investigating money laundering, fraud, drug trafficking, or other offenses covered by the civil forfeiture statute can obtain seizure warrants from a court on a showing of probable cause.6Office of the Law Revision Counsel. 18 USC 981 – Civil Forfeiture When investigators have their evidence lined up, these warrants can be obtained quickly, and the target typically learns about the freeze only after it has already happened.
SEC and FTC Enforcement: Often Within 24 Hours
Federal regulators sit between unilateral agency power and ordinary civil litigation. The SEC and FTC can’t freeze accounts on their own, but they can walk into federal court and ask for emergency orders, and courts give those requests significant weight.
The SEC can seek a temporary restraining order with an asset freeze whenever it believes someone is violating securities laws, and federal courts can grant that relief without requiring the SEC to post a bond.7Office of the Law Revision Counsel. 15 USC 78u – Investigations and Actions The FTC uses the same tool in consumer protection cases, routinely obtaining ex parte TROs that freeze assets before the defendant even knows a case has been filed.8Federal Trade Commission. Private Lawsuits Before Judgment: Several Weeks
If you’re suing someone and want to freeze their assets before you’ve won, this is the slowest path. You can’t freeze someone’s property just because you’ve filed a lawsuit. You need a court order.
Federal courts allow prejudgment seizure remedies, including attachment, garnishment, and sequestration, generally following the procedures of the state where the court sits.10Legal Information Institute. Federal Rules of Civil Procedure Rule 64 – Seizing a Person or Property To get one, you have to show a strong likelihood of winning the case and real evidence that the other side will hide or spend assets before trial. Courts treat this as extraordinary relief because you’re restricting someone’s property before any wrongdoing has been proven.
The plaintiff is typically required to post a bond to cover damages if the freeze turns out to be unjustified. From filing the motion to getting a hearing and the order, the process commonly takes several weeks. In complex commercial disputes it can run a month or more.
Collecting on a Judgment You Already Won: Days to a Few Weeks
Once a court has entered a final judgment in your favor, freezing the debtor’s assets to collect is far more straightforward. Liability is already decided, so the legal standard drops.
The typical tool is a writ of execution or garnishment, which directs the bank or another third party holding the debtor’s property to freeze and turn over the funds.11U.S. Marshals Service. Writ of Garnishment The main delays here are logistical: getting the writ issued, serving it on the right financial institution, and waiting for processing.
Emergency Ex Parte TROs: Possibly the Same Day
When there’s evidence that someone is actively draining accounts or moving property out of reach, a private party can request an emergency ex parte hearing, where the judge hears only from the party seeking the freeze.
Under Federal Rule of Civil Procedure 65(b), a court can issue a TRO without notice if the requesting party shows through an affidavit or verified complaint that waiting would cause immediate and irreparable harm. The attorney must also certify what efforts were made to notify the other side and explain why notice wasn’t practical. A TRO granted this way expires within 14 days unless the court extends it for good cause, so a full hearing with both sides present has to follow quickly.12Legal Information Institute. Federal Rules of Civil Procedure Rule 65 – Injunctions and Restraining Orders
This is the fastest route available to a private party. In urgent cases, a skilled attorney can get a TRO signed the same day the motion is filed.
What Speeds Up or Slows Down the Clock
Type of Asset
Bank accounts are the fastest. A court order or levy notice can be transmitted electronically, and most banks execute the hold within one to three business days, sometimes within hours. Real estate is slower. Freezing real property typically requires filing a lis pendens with the county recorder’s office, which becomes effective as constructive notice only once it appears in the land records. Investment and brokerage accounts fall in between, depending on the custodian’s internal legal processing.
Where the Assets Sit
Assets inside the state where the order was issued are simplest to reach. Assets in another state require domesticating the judgment there first, meaning the new state’s court has to formally recognize the original order. Most states have adopted the Uniform Enforcement of Foreign Judgments Act, which streamlines this, but it still adds time for filing, serving notice, and allowing objections. Assets held in foreign countries are the hardest case, depending on treaties, cooperation of foreign courts, and local laws that may not recognize U.S. orders at all. International freezes can take months or years.
Court Schedule and the Other Side’s Behavior
A backlogged court docket can delay even a routine hearing by weeks. On the other hand, if you can show the opposing party is actively dissipating assets, most judges will prioritize the request. The difference between a standard motion and emergency relief can shrink the timeline from weeks to hours.
What Can’t Be Frozen
Not every dollar in an account is reachable, which matters because an order can be served quickly but still fail to capture protected funds. Social Security benefits cannot be subject to execution, levy, attachment, or garnishment, and banks must review two months of deposit history to identify and protect them when they receive a garnishment order.13Office of the Law Revision Counsel. 42 USC 407 – Assignment of Benefits The IRS has its own exempt list, including unemployment benefits, workers’ compensation, certain pension and disability payments, court-ordered child support, and a minimum wage exemption.14Office of the Law Revision Counsel. 26 USC 6334 – Property Exempt from Levy Many states add a minimum protected bank balance on top of the federal floor, with dollar amounts that vary by state.
