To file for unemployment in California, you submit a claim to the Employment Development Department through the UI Online portal, by mail, or by fax, then certify every two weeks that you are still eligible. Weekly benefits run from $40 to $450 depending on your past earnings.1Employment Development Department. Do You Qualify
The EDD looks at your earnings during a base period, which is the first four of the last five completed calendar quarters before your claim start date. You need at least $1,300 in wages in your highest quarter. If you fall short, you can still qualify with at least $900 in your highest quarter and total base-period earnings of at least 1.25 times that highest-quarter amount.2Employment Development Department. If most of your work happened in the last few months and the standard base period doesn’t produce enough wages, the EDD can use an alternate base period made up of the last four completed calendar quarters before your claim date.2Employment Development Department. You also need to be unemployed through no fault of your own. Layoffs, closures, and significant hour reductions all count. Quitting or being fired doesn’t automatically disqualify you, but the EDD looks harder. A quit generally requires good cause connected to your work, and a firing only blocks benefits if the employer can show deliberate misconduct rather than mistakes or poor performance.
What to Have Ready Before You Start
The application asks about your total wages from every job you held over the past 18 months, so pulling your records first saves time.1Employment Development Department. Calculator – Unemployment Benefits Gather:
- Your Social Security number.
- The legal name, mailing address, and phone number of each employer for the last 18 months.
- Exact dates you worked at each job and gross wages by calendar quarter. W-2s and final pay stubs are the easiest sources.
- The reason you separated from each employer. The EDD compares your version against what your employer reports, so accuracy beats spin.
- An active email address to create a myEDD account for UI Online.
Lying on the application is a crime. Misrepresenting wages, using someone else’s Social Security number, or hiding facts to collect benefits you aren’t entitled to can lead to criminal charges under the California Unemployment Insurance Code.3California Legislative Information. How to Submit the Application
UI Online through myEDD is the fastest option and runs 24 hours a day. You create the account, enter your work history and reason for separation, review a summary screen, and submit. A confirmation number means the claim is logged.
If you can’t file online, you can submit a paper Unemployment Insurance Application (DE 1101I) by fax or mail. Different versions of the form exist depending on whether you worked only in California, in multiple states, in the military, or for the federal government. The Waiting Period and Your First Payment
Your first week of unemployment is unpaid. California law imposes a one-week waiting period before benefits start.5California Legislative Information. California Code UIC 1253 – Eligibility You still have to certify for that week, but you won’t be paid for it. The week only counts as your waiting period if you were otherwise fully eligible; if you had too much earnings, missed certification, or were disqualified, the waiting period shifts to the next eligible week.6Employment Development Department. Within about two weeks of filing, the EDD mails you a Notice of Unemployment Insurance Award (DE 429Z) showing your weekly benefit amount and maximum total award. Read it carefully. If anything looks wrong, follow the instructions to appeal in writing within 30 days to avoid payment delays.7Employment Development Department. Unemployment – Step 4 Review Benefit Documents
Your weekly benefit amount is roughly your highest base-period quarter divided by 26, capped at $450 and floored at $40. The full claim award is about 26 times that weekly amount, spread across a 12-month benefit year.1Employment Development Department. Calculator – Unemployment Benefits
Expect roughly three weeks from filing to first payment if nothing on your claim is disputed.8Employment Development Department. Unemployment – Receive Your First Payment Payments arrive one of three ways: direct deposit to a checking or savings account, usually within three days of certification; a Money Network prepaid debit card, which arrives by mail within 7 to 10 days after approval and then loads within about two days of each certification; or a mailed paper check, which is the slowest.9Employment Development Department. Certifying for Benefits Every Two Weeks
Filing the initial claim isn’t enough. You have to certify every two weeks to keep the payments coming.10Employment Development Department. Step 7 Continue to Certify Each certification asks whether you were able to work, available for work, and actively looking for a job during those two weeks, and it asks you to report any earnings, even if you haven’t been paid yet.11Employment Development Department. UI Online is the fastest way to certify. Paper filers receive the Continued Claim Form (DE 4581) automatically by mail.10Employment Development Department. Step 7 Continue to Certify Each certification window is 14 days. Miss it and you’ll have to contact the EDD to reopen the certification, which delays payment.
Your answers on the certification track directly to California’s eligibility statute: able, available, and actively seeking suitable work each week you claim.5California Legislative Information. California Code UIC 1253 – Eligibility Most claimants also have to register for CalJOBS and post an online resume within 21 days of receiving the Notice of Requirement to Register for Work (DE 8405). Reporting Part-Time or Gig Earnings
Part-time or gig work doesn’t automatically end your claim. California uses an earnings disregard: the EDD ignores the greater of $25 or 25 percent of your gross weekly earnings and subtracts the rest from your weekly benefit amount.13Employment Development Department. Completion Instructions for Notice of Reduced Earnings If the adjusted number is still under your weekly benefit amount, you get a reduced payment for that week.
Report every job and every dollar during certification, based on the week you did the work, not the week the paycheck cleared. Unreported earnings are the fastest way to trigger a fraud investigation and an overpayment penalty.
If the EDD Schedules a Phone Interview
When something in the claim raises a question, such as a disputed separation, a work-search gap, or conflicting employer information, the EDD schedules a phone interview. You’ll receive a Notification of Unemployment Insurance Benefits Eligibility Interview (DE 4800) by mail and on your UI Online homepage, showing the date, time, and the questions the interviewer will likely ask.14Employment Development Department. An EDD representative calls you at the scheduled time. Caller ID may show “St of CA EDD” or the UI customer service number. If you need to reschedule, contact the EDD at least one day before the interview. If you miss the call without rescheduling, the EDD decides based on what it already has, which often means a denial.14Employment Development Department. Unemployment Determinations and Eligibility
Review the DE 4800 before the call and pull together supporting documents: termination letters, employer emails, records of your job search, pay stubs. The interviewer may ask you to submit additional documentation afterward.
If Your Claim Is Denied
A denial isn’t the end. You have 30 days from the mailing date on your Notice of Determination (DE 1080CZ) to file a written appeal. Late appeals can still be reviewed if an Administrative Law Judge finds you had good cause for the delay.15Employment Development Department. Unemployment Insurance Appeals
The EDD first looks at whatever new information you include with the appeal. If those details support eligibility, it can reverse the denial without a hearing. Otherwise the case goes to the California Unemployment Insurance Appeals Board’s Office of Appeals, which schedules a hearing before an Administrative Law Judge. Submit every document that supports your case with the initial appeal. Concrete evidence gives you the best shot at a reversal without a hearing. And keep certifying every two weeks while the appeal is pending. If you stop certifying and later win, you can’t collect for the weeks you missed.
Taxes and Overpayments
Unemployment benefits are subject to federal income tax but not to California state income tax.16Ask EDD. Form 1099G You can have 10 percent of each payment withheld for federal taxes by filing IRS Form W-4V with the EDD. That’s the only percentage available; you can’t pick a different one.17Internal Revenue Service. If the EDD later decides it paid you too much, you get a notice of overpayment and have to repay the excess. Honest-mistake overpayments can sometimes be waived or paid off on a plan. Fraud overpayments are punishing: repay the full amount, plus a 30 percent penalty, plus a 5-to-23-week disqualification from future benefits.18Employment Development Department. California Code UIC 2101 – Violations If you spot an error on a past certification, correcting it yourself is far better than waiting for an investigation.
Reopening a Claim After a Gap
If more than 30 days pass since your last certification but your benefit year hasn’t expired, don’t file a new claim. Reopen the existing one through UI Online or by contacting the EDD.19Employment Development Department. Benefit Year End Reopening restarts certifications, and any remaining balance stays intact.
If your entire benefit year has ended and you’re still unemployed or underemployed, you file a brand-new claim, provided you’ve earned enough wages in the most recent 18 months to build a new base period.19Employment Development Department. Benefit Year End Old claims don’t carry over. A new benefit year means a new earnings calculation and potentially a different weekly amount.
