To get rid of a body attachment warrant, hire an attorney in the county where the warrant was issued, have them file a motion asking the judge to recall or quash it, and arrange a voluntary court appearance before law enforcement picks you up. People who walk into court on their own almost always fare better than those arrested on the warrant, and judges have the discretion to lift the attachment the same day you appear if you give them a reason to.
A body attachment is a court order directing officers to physically bring you before a judge.1U.S. Marshals Service. Writ of Body Attachment It is not a criminal charge. It almost always comes out of a civil matter where you missed a hearing or ignored a court order, most commonly a child support hearing, a debtor’s examination, or a specific directive from the court that went unanswered. Nothing happens on its own. These warrants have no expiration date, and they do not fall off the docket with time.
Confirm the Warrant Before You Do Anything Else
Call the clerk’s office of the court where your case was filed. The clerk can tell you whether a warrant is active, which judge issued it, and whether a bond or purge amount has been set. Some courts post this through online case search, but many restrict public access to active warrants, so a phone call, an in-person visit, or an attorney inquiry may be the only route.
Body attachment warrants generally do not appear in the FBI’s National Crime Information Center database, so a routine traffic stop in another state may not flag one. That is not protection. The warrant stays live in the issuing court’s system and comes back into play any time you deal with that jurisdiction.
Walk In Voluntarily Instead of Waiting to Be Arrested
This is where most people lose the most ground: they do nothing and hope the warrant disappears. It won’t, and the difference between the two paths is large.
When your attorney arranges a voluntary surrender during business hours, you appear before a judge or magistrate quickly, often the same day. You get to argue for recalling the warrant while standing in front of the court as someone who showed up willingly. That matters to judges deciding whether to release you or set conditions.
If you are arrested instead, you sit in custody until you can be brought before a judge. That wait varies by jurisdiction but often runs 24 to 48 hours, longer over a weekend. You can spend days in jail over what started as a missed hearing, lose time at work, and still face the same underlying legal issue when you finally see the judge.
File a Motion to Recall or Quash the Warrant
The formal mechanism for clearing a body attachment is a motion asking the court to quash or recall it. A motion to quash asks the court to declare the proceeding invalid or void.2Legal Information Institute. Motion to Quash A motion to recall asks the court to withdraw the warrant while keeping the underlying case alive. Either way, the motion has to give the judge a concrete reason to lift the attachment.
Grounds that tend to work:
- Lack of proper notice, meaning you never received the hearing notice or court order, or it went to an old address.
- A genuine emergency, such as a medical crisis or family emergency, that prevented your appearance.
- Compliance since the warrant issued, such as catching up on missed support payments or producing documents the court ordered.
- A clear willingness to appear at a rescheduled hearing and meet the court’s requirements going forward.
The court reviews your arguments and any supporting evidence, hears from the opposing party, and decides whether to lift the attachment.2Legal Information Institute. Motion to Quash Showing up without paperwork and asking the judge for forgiveness on the spot is a weaker position than filing a drafted motion in advance, which is why doing this through an attorney matters.
Purge Amounts and the Ability-to-Pay Defense
In cases involving unpaid child support or other financial obligations, the court often sets a purge amount tied to the debt. Paying it secures your release and triggers the warrant being recalled. It is the price of clearing the contempt finding.
What many people in this situation do not know: a court cannot jail you for civil contempt if you genuinely lack the ability to pay. The whole theory of civil contempt is that you carry the keys to your own cell by complying with the court’s order. If compliance is impossible because the money is not there, incarceration serves no legitimate purpose, and courts are required to find that you have the present ability to pay before ordering you held.
The U.S. Supreme Court reinforced this in Turner v. Rogers, holding that due process requires specific procedural safeguards before someone can be jailed for failing to pay a civil obligation.3Justia. Turner v Rogers, 564 US 431 (2011) Those safeguards include notice that your ability to pay is the critical issue, a form or equivalent method for presenting your financial information, a chance to respond to questions about your finances at the hearing, and an express finding by the court that you actually can pay.4Legal Information Institute. Turner v Rogers
If you truly cannot pay, say so clearly and come prepared to document it. Bring bank statements, pay stubs, proof of expenses, and anything else that shows your real financial situation. Judges in that situation often reduce the purge amount, set up a payment plan, or release the person with conditions rather than hold someone who demonstrably cannot pay.
A note on counsel: Turner held that the Due Process Clause does not automatically require the state to provide a lawyer in civil contempt proceedings, even when jail is on the table, but that is only true when the opposing party is also unrepresented and the court provides the alternative safeguards above.3Justia. Turner v Rogers, 564 US 431 (2011) When the other side has a lawyer or the state itself is pursuing contempt, raise the appointment-of-counsel question with the court at the earliest opportunity. Some states guarantee appointed counsel in civil contempt cases regardless.
What Happens If You Ignore It
An outstanding body attachment creates problems that compound. Law enforcement can pick you up at home, at work, or during a traffic stop, and once arrested you stay in custody until you see the issuing judge. The underlying obligation keeps running the whole time. Unpaid child support keeps accruing. Deadlines keep passing. The hole gets deeper.
Moving does not help. State-issued body attachments generally do not trigger interstate extradition the way serious criminal warrants do, but the warrant stays active in the issuing court’s system, and any return to that state puts you at risk of arrest. For federal writs enforcing federal law, the U.S. Marshals Service can serve the attachment anywhere in the United States.1U.S. Marshals Service. Writ of Body Attachment
Your Next Step
Call an attorney who handles civil contempt or family law in the county where the warrant was issued. Have them pull the case, file a motion to recall the warrant, and set up a voluntary court appearance. Attorney fees for this kind of work vary with complexity and location, but they are almost always less than the cost of being arrested, missing work, and trying to argue your position from a jail cell. Every day the warrant stays active is another day you can be picked up.
