To write a settlement demand letter, lay out what happened, explain why the other side is legally responsible, itemize every dollar you lost with documentation attached, state a specific amount you’ll accept, and give the recipient a firm deadline to respond before you file suit. The letter is a negotiation tool and a paper record at the same time, so every sentence should hold up if a judge eventually reads it.1Cornell Law School. Demand Letter
What the Letter Needs To Accomplish
A demand letter is pre-litigation communication. Its job is to change how the recipient sees the risk of ignoring the claim: here are the facts, here is why you are responsible, here is what I lost, and here is what it will cost to make this go away before I sue.1Cornell Law School. Demand Letter
It also builds a record. A clean, documented letter shows that you tried to resolve things in good faith. If the recipient ignores it or stonewalls, that silence can be used later as evidence of negligence or bad faith.2LegalMatch. Writing a Complaint or Demand Letter
One boundary before you start. A demand letter is not a complaint and is not a notice of claim. A complaint is filed with a court and triggers a deadline the other side must meet or lose by default. A notice of claim is a document some states require before you can sue a government entity, with its own short filing window; miss it and the lawsuit is barred regardless of how strong your demand letter was.3Avvo. The Difference Between a Demand Letter and Notice of Claim Sending a demand letter does not pause the statute of limitations either. If the filing deadline is approaching, the clock keeps running while you negotiate.4Avvo. Statute of Limitations and Demand Letters
The Sections Every Demand Letter Contains
The specifics shift with the type of dispute, but the skeleton is the same across personal injury, breach of contract, unpaid wages, landlord-tenant, and employment claims.
Header and Reference Line
Open with your name and address, the date, the recipient’s name and address, and a reference line identifying the claim. For an insurance claim, the reference line includes the insured’s name, your name as the claimant, the claim or policy number, and the date of the incident.5Lawyers.com. Sample Car Accident Demand Letter Small errors in the header signal inexperience to an adjuster, so get them right.6ZD Law Firm. How to Write an Insurance Demand Letter
Statement of Facts
Tell the story chronologically. Who was involved, where, when, what happened. Keep it factual. Leave out vague details and anything that could suggest you were partly at fault, unless you’re deliberately getting ahead of it (see the liability section). Reference the evidence you’re attaching: police reports, photos, witness statements, the contract.7Nolo. How to Write a Demand Letter
Liability
Explain why the recipient is legally on the hook. In a car accident, cite the police report and the traffic law the other driver broke. In a contract dispute, point to the specific obligations in the agreement that were not met. If there’s an obvious weakness in your case, like a pre-existing injury or some shared fault, address it directly here. Pretending it isn’t there doesn’t make it disappear, and raising it on your own terms is stronger than letting the other side introduce it.8EvenUp Law. How to Write Personal Injury Demand Letters
Damages
This is the itemized ledger. For personal injury, it typically includes past and future medical expenses, lost wages, property damage, and pain and suffering.9Miller & Zois. Sample Demand Letter Before Trial For a contract dispute, it covers the direct loss, any contractual interest, late fees, and consequential damages when the contract or statute supports them.10Douglas Firm. How Much Should You Demand in a Demand Letter
In higher-value injury cases, present the economic damages as a two-column table (category and amount) so the adjuster can see at a glance where every dollar comes from.11Miller & Zois. Accident Settlement Demand Letter
The Demand
State the specific dollar figure you’ll accept, the deadline for response, and what happens if the deadline passes. Usually that consequence is filing suit.7Nolo. How to Write a Demand Letter
Picking the Dollar Figure
This is the most consequential sentence in the letter. Too low and you leave money on the table. Too high and you lose credibility before the negotiation starts.
Personal Injury Cases
Build the demand from two layers. Economic damages come straight out of your documentation: medical bills, pay stubs for lost wages, repair estimates. Non-economic damages, meaning pain and suffering, are usually estimated with the multiplier method. Add up your economic damages and multiply them by a factor that reflects how badly you were hurt.12FindLaw. What Is a Pain and Suffering Multiplier
Multipliers generally fall between 1.5 and 5:
- Minor injuries with full recovery: 1.5 to 2
- Moderate injuries with months of treatment and some lasting limits: 2 to 3
- Serious injuries involving surgery, long recovery, or permanent effects: 3 to 4
- Catastrophic, life-altering injuries: 4 to 5 or higher
What pushes the multiplier up: clear liability, objective medical evidence like imaging or surgical records, permanent impairment, and significant disruption to daily life. What drags it down: disputed fault, short treatment, pre-existing conditions, and gaps in your medical care.13Precedent. Pain and Suffering Damages Calculation
An alternative is the per diem method: assign a daily dollar value to your pain and multiply by the number of days from the injury to maximum recovery.12FindLaw. What Is a Pain and Suffering Multiplier
Once you have a defensible total, ask for more. Standard practice is to demand 25% to 50% above the minimum you’d actually accept, which gives you room to negotiate down.7Nolo. How to Write a Demand Letter Some cases ultimately settle for roughly half the opening demand.14David Ricks Law. Demand Letters for Personal Injury Claims The number still has to be defensible on the evidence though. Adjusters read hundreds of these letters and will dismiss unsupported demands as amateur work.15Clio. Personal Injury Demand Letter
Contract and Commercial Cases
Breach-of-contract math is more mechanical. Start with the base damages: the unpaid invoice, the cost to repair, or the benefit-of-the-bargain difference. Add contractual interest, late fees, and attorneys’ fees if the contract has a fee-shifting clause. Add consequential damages only when you can explain and document them. Inflated numbers without a breakdown hurt credibility more than they anchor the negotiation.10Douglas Firm. How Much Should You Demand in a Demand Letter
One framework adjusts the demand to the strength of your case: 80 to 100% of the provable total when liability is clean and the paper trail is solid, 60 to 80% when real disputes exist about scope or performance, and 40 to 60% when the facts are genuinely messy.10Douglas Firm. How Much Should You Demand in a Demand Letter
Supporting Documentation
The letter is only as credible as what’s attached to it. Reference the attachments in the body of the letter and include an evidence index: a short table of contents listing each exhibit by number and description.16Brauns Law. Making the Demand: Evidence
For a personal injury claim, standard attachments include:
- Medical records and bills, organized chronologically from the ambulance report through emergency room records, physician and therapist notes, and pharmacy records. Every billed date of service should have a matching medical record. Any expense without one will get rejected.16Brauns Law. Making the Demand: Evidence
- Police or incident reports.
- Photographs of property damage and injuries.
- Proof of lost wages, such as pay stubs or an employer verification letter.8EvenUp Law. How to Write Personal Injury Demand Letters
- Expert opinions when future medical costs or vocational rehabilitation projections need backing.11Miller & Zois. Accident Settlement Demand Letter
Send clean copies with no handwritten notes or highlighter marks. Keep the originals. Before sending, review your medical records and redact unrelated personal information such as unconnected mental health history.16Brauns Law. Making the Demand: Evidence
Response Deadlines and How To Send It
Set a deadline inside the letter. For commercial disputes, 10 to 14 days is common. For personal injury claims, insurers typically take 20 to 60 days to respond depending on severity and carrier.17Douglas Firm. How Much Should You Demand in a Demand LetterMiller & Zois. Sample Demand Letter Before Trial
No general law forces the recipient to answer by any particular date. A demand letter is a negotiation tool, not a court order.18Justia. How Long Does a Defendant Have to Respond If the deadline passes with no response, your only recourse is the lawsuit you threatened. The practical rule: do not set a deadline you aren’t willing to enforce. An empty threat burns credibility you’ll need in the next round.9Miller & Zois. Sample Demand Letter Before Trial
On delivery, there’s a tradeoff. Certified mail with return receipt gives you signed proof of delivery, which matters if the recipient later claims they never got it.7Nolo. How to Write a Demand Letter But people often refuse certified mail precisely because they assume it’s bad news.19Silberman Law Firm. US Mail and Its Importance in the Law The common compromise is to send certified plus regular first-class mail, and sometimes email on top of that. You get the documentation and reduce the chance the recipient dodges the post office.19Silberman Law Firm. US Mail and Its Importance in the Law
When To Actually Send It
For personal injury claims, the most common and expensive mistake is sending the letter too early. Wait until you have finished medical treatment or reached maximum medical improvement, the point at which further recovery is not expected. Send it before that and you’re guessing at future medical costs. Once you sign a settlement, your right to pursue more money for unforeseen complications is gone.20EvenUp Law. How to Write Personal Injury Demand LettersThe Bradley Law Firm. What Is a Demand Letter in a Personal Injury Case
At the other end, don’t drift too close to the statute of limitations. Insurers sometimes stall deliberately when they can see the deadline approaching and the claimant has no attorney, requesting more documents and then floating a lowball offer when leverage has evaporated. Remember that the demand letter itself does nothing to the limitations clock.4Avvo. Statute of Limitations and Demand Letters
Tone, Length, and Proofreading
Keep it professional, assertive, and fact-driven. Aggressive or inflammatory language alienates the reader and signals that you’re inflating the case rather than presenting a credible one.15Clio. Personal Injury Demand Letter Write like someone who’s prepared to walk into a courtroom and win, not like someone who’s bluffing.
Match the length to the case. A two-page letter for a minor fender-bender with soft-tissue injuries fits. Twenty pages for the same case signals inexperience. Complex, high-value claims warrant longer submissions, and in a serious injury case, roughly 90% of the letter should be about the injuries, treatment, and how the injury affected your life.11Miller & Zois. Accident Settlement Demand Letter
Proofread it. Typos and grammar errors give the adjuster an easy reason to take you less seriously.15Clio. Personal Injury Demand Letter
If you’re writing without a lawyer, two guardrails especially: stick to facts and dates with no emotional language, and never threaten illegal activity, physical harm, or any action you aren’t prepared to carry out, since the threat itself can create legal liability.21Texas Law Help. Mistakes That Hand the Adjuster an Easy Win
Adjusters review hundreds of demand letters and know the signs of a weak one. The common failures:
- Figures without documentation. Asserting losses without attaching bills, records, or employer statements invites a lowball counter. Adjusters press on poorly documented claims because the writer has nothing to push back with.22The Bradley Law Firm. What Is a Demand Letter in a Personal Injury Case
- Exaggeration. Overstating injuries or inflating damages beyond what the evidence supports kills credibility. Adjusters are trained to do an objective assessment, and inaccuracies tell them you’re not a serious opponent.15Clio. Personal Injury Demand Letter
- Pretending weaknesses don’t exist. Every case has them: a pre-existing condition, a gap in treatment, some shared fault. Ignoring them doesn’t make them go away; it just lets the other side raise them on their terms.8EvenUp Law. How to Write Personal Injury Demand Letters
- Accepting a fast first offer. Insurers sometimes offer quick, insufficient payments to claimants who haven’t yet grasped the full extent of their damages. Signing the release ends the claim, even if your medical costs balloon later.23Claypool Law Firm. Common Mistakes to Avoid in Personal Injury Claims
- Social media. Adjusters and defense attorneys monitor public posts for anything that contradicts the claimed injuries. An ordinary vacation photo can be turned into an argument that you’re not as hurt as you say.23Claypool Law Firm. Common Mistakes to Avoid in Personal Injury Claims
When State Law Requires a Demand Letter Before You Can Sue
In most disputes, sending a demand letter is strategic rather than mandatory. In a few situations, state law requires it, and skipping the step can get the lawsuit dismissed.
Consumer Protection Statutes
Massachusetts General Laws Chapter 93A, Section 9 requires a consumer to serve a demand letter at least 30 days before filing suit over unfair or deceptive conduct. The letter has to reasonably describe the conduct and give the defendant enough information to evaluate a settlement offer. The defendant then has 30 days to respond. No response, or an unreasonable offer, can expose the defendant to double or treble damages.24Massachusetts Bar Association. Responding to Chapter 93A Demand Letters in Product Liability Cases
California’s Consumer Legal Remedies Act works similarly. Under Civil Code Section 1782, you must send written notice to the business at least 30 days before filing a damages claim. The notice has to identify the specific violations and demand that the business correct, repair, replace, or otherwise fix the problem. If the business provides an appropriate fix within 30 days, the damages claim cannot go forward.25FindLaw. California Civil Code Section 1782
California Small Claims
In California, a demand letter is a required step before filing a small claims case.26California Courts Self-Help Guide. Demand Letter
Medical Malpractice
Medical malpractice cases have their own pre-suit requirements. Florida, for instance, requires the claimant to notify each prospective defendant by certified mail at least 90 days before filing suit. During that 90-day window, both sides must investigate the claim in good faith and share information informally. At the end, the defendant has to either reject the claim, offer a settlement, or propose arbitration.27Florida Legislature. Florida Statutes Section 766.106 More than half the states impose some form of certificate of merit, expert affidavit, or review panel requirement for malpractice claims, each with its own timing rules.28National Conference of State Legislatures. A Working Structure To Follow
Put together, a demand letter you write today will move through these blocks in order:
- Your name, your address, the date.
- Recipient’s name and address.
- Reference line identifying the claim (parties, policy or claim number, date of incident).
- One or two paragraphs stating the facts chronologically, with references to the exhibits attached.
- A liability paragraph explaining why the recipient is responsible, including any weakness in your case addressed on your own terms.
- A damages section, itemized, with a table for economic losses in higher-value cases. Add the pain and suffering calculation using the multiplier or per diem method if the case involves injury.
- The demand itself: a specific dollar figure (typically 25% to 50% above your true minimum), the response deadline, and what happens next if the deadline passes.
- An evidence index listing every attachment by number and description.
Send it certified mail with return receipt, add a regular first-class copy, and keep every original document in your file. If a required pre-suit period applies in your state or your claim type, count the days from delivery before you file anything in court.
