HS 11377(a) California: Penalties, Diversion & Defenses

Under California Health and Safety Code section 11377(a), possessing certain non-narcotic controlled substances without a valid prescription is a misdemeanor punishable by up to one year in county jail and a fine of up to $70.1California Legislative Information. California Health and Safety Code 11377 That misdemeanor treatment came from Proposition 47 in 2014. Since then, Proposition 36 (passed in November 2024) has added a separate “treatment-mandated felony” track for repeat offenders caught with drugs like methamphetamine, fentanyl, or cocaine. So what you actually face depends on the substance and on your record.

Which Drugs the Statute Covers

HS 11377(a) does not apply to every illegal drug. It reaches non-narcotic controlled substances in Schedules III, IV, and V, along with certain named substances from Schedules I and II. The drugs most commonly charged under this section include methamphetamine, MDMA (ecstasy), GHB, ketamine, prescription stimulants and sedatives held without a prescription, and hallucinogens such as LSD, psilocybin, and DMT.1California Legislative Information. Cannabis, peyote, mescaline, and THC are excluded from this statute. Narcotics like heroin and fentanyl are prosecuted under HS 11350 instead, though the penalty structure is similar. The specific substance matters because it decides not just the base charge but whether the Proposition 36 felony provisions can attach.

What Prosecutors Must Prove

To convict you under HS 11377(a), the prosecution has to establish three things: you possessed a covered controlled substance, you knew the substance was there, and you knew it was a controlled substance.1California Legislative Information. California Health and Safety Code 11377 Being near drugs, or being in a room where they turn up, is not enough on its own. There must be evidence you controlled the substance in some way.

Actual and Constructive Possession

Actual possession means the drugs were on your person, in your hand, or in something you were carrying. Constructive possession means the drugs were in a place you controlled: your car, your apartment, a locker you rented. Constructive possession cases lean on circumstantial proof: whether you had a key, whether your belongings were nearby, whether you said anything suggesting you knew the drugs were there.

This distinction matters in shared spaces. When drugs turn up in a car with several passengers or a house with roommates, prosecutors cannot charge everyone present. They need something tying you to the substance in particular.

Usable Quantity

The amount must be enough to actually be used as a drug. Trace residue does not qualify. That said, the bar is low. It doesn’t mean enough for a full dose; it means enough to consume.

Misdemeanor Penalties

For most people, HS 11377(a) is a straight misdemeanor. The maximum is up to one year in county jail. The statutory fine is capped at $70, and the judge has to consider your ability to pay before imposing it.1California Legislative Information. California Health and Safety Code 11377

First-time defendants rarely see anything close to the maximum jail time. Probation is common, sometimes with drug testing, community service, or treatment as conditions. The $70 fine cap surprises many people, since misdemeanor fines in California often run much higher. Court fees and assessments layered on top can still push the total bill up substantially.

When Possession Becomes a Felony

Two different paths can turn a simple possession charge into a felony, and they run on different statutes.

Felony Elevation Inside HS 11377(a)

The statute itself allows felony treatment in a narrow set of situations. If you have a prior conviction for a “super strike” offense listed in Penal Code 667(e)(2)(C)(iv), or you must register as a sex offender under Penal Code 290(c), the court can sentence you under Penal Code 1170(h) instead of as a misdemeanor.1California Legislative Information. California Health and Safety Code 11377 The super strike list is short and severe, covering offenses like homicide, sexually violent crimes, certain sex offenses involving minors, and possession of a weapon of mass destruction.2California Legislative Information. When this path applies, the sentence is 16 months, two years, or three years, generally served in county jail under PC 1170(h) unless you also have prior serious or violent felony convictions, in which case the term shifts to state prison.3California Legislative Information. Treatment-Mandated Felony Under HS 11395

The 2024 Proposition 36 created a new category called a “treatment-mandated felony” under Health and Safety Code 11395. It applies if you possess a “hard drug” and have two or more prior convictions for specified drug offenses, including prior violations of HS 11377.4California Secretary of State. “Hard drug” under this law means methamphetamine, fentanyl, heroin, cocaine, cocaine base, and PCP. It specifically excludes cannabis, LSD, psilocybin, mescaline, peyote, and other psychedelics. A third possession offense involving LSD does not trigger the treatment-mandated felony; a third possession offense involving methamphetamine does.4California Secretary of State. The design of this new felony is treatment-first. Rather than going straight to jail, you can plead guilty, waive sentencing, and enter a court-approved treatment program built by a drug addiction expert. Complete treatment, and the charges are dismissed. Refuse or fail treatment, and you face up to a year in county jail or sentencing under PC 1170(h). Diversion Under Penal Code 1000

California law offers a real alternative to conviction for simple possession. Penal Code 1000 creates a pretrial diversion program that covers HS 11377 charges. Finish the program and the case is dismissed outright, leaving no conviction on your record.5California Legislative Information. California Penal Code 1000

To qualify for PC 1000 diversion, all of the following must be true:

  • No controlled substance conviction (other than those PC 1000 lists) within the past five years.
  • The current offense did not involve violence or threatened violence.
  • There’s no evidence of a related narcotics violation beyond the possession charge.
  • No felony conviction of any kind within the past five years.

Diversion typically runs 12 to 18 months and involves drug education, treatment sessions, or counseling, paid out of pocket. Complete it and the charges disappear; fail it and the criminal case picks up where it left off.5California Legislative Information. California Penal Code 1000

If your record disqualifies you from PC 1000, the HS 11395 treatment path may still be an option for avoiding incarceration.

Legal Defenses

The strongest defenses attack the elements prosecutors have to prove. Knock out any one of them and the case falls apart.

Lack of Knowledge or Control

If you genuinely didn’t know the substance was there, you didn’t possess it in any legal sense. This defense fits shared living situations, borrowed vehicles, and cases where someone else left drugs in your space. The prosecution has to show you knew about the drugs and controlled them, and in constructive possession cases the evidence is often thin.

Unlawful Search and Seizure

If the police found the drugs through an illegal search, whether searching your car without probable cause, entering your home without a warrant or valid exception, or going beyond the scope of a consent search, your attorney can move to suppress the evidence. If the court agrees, the prosecution usually loses its case. Many drug possession cases turn on this issue, so how the drugs were discovered deserves careful scrutiny.

Valid Prescription

HS 11377(a) exempts substances held under a valid prescription from a licensed physician, dentist, podiatrist, or veterinarian.1California Legislative Information. California Health and Safety Code 11377 A legitimate prescription is a complete defense.

Challenging the Substance Identification

Prosecutors must prove the substance is actually a controlled substance covered by the statute. Field tests are presumptive and can produce false positives. The defense can question whether a certified lab tested the substance, whether the chain of custody held, and whether the results match a scheduled drug. If the identification fails, the charge fails.

Immigration Consequences for Non-Citizens

If you are not a U.S. citizen, an HS 11377(a) conviction can hurt you far more than the jail term suggests. Federal immigration law makes any conviction “relating to” a controlled substance a basis for deportation. The only statutory exception is a single offense involving 30 grams or less of marijuana, which does not help with methamphetamine, MDMA, or the other substances covered here.6Office of the Law Revision Counsel. 8 USC 1227 – Deportable Aliens

The same conviction also makes you inadmissible, which can bar re-entry or block adjustment of status. Even diversion can create problems if it requires you to formally admit the elements of the offense. Before accepting any plea, a non-citizen should talk to an immigration attorney, because a resolution that looks favorable in criminal court can be devastating in immigration court.

Clearing Your Record After Conviction

If you’re convicted under HS 11377(a) and finish your sentence or probation, Penal Code 1203.4 lets you petition to withdraw your plea, enter a not-guilty plea, and have the case dismissed. That relief lifts most penalties tied to the conviction.7California Legislative Information. California Penal Code 1203.4

You have to have completed probation (or been discharged from it early), you cannot currently be serving a sentence or on probation for another offense, and you cannot have pending charges. An unpaid restitution order does not disqualify you. The prosecution gets 15 days’ notice to respond.7California Legislative Information. California Penal Code 1203.4

Two limits to keep in mind. A 1203.4 dismissal does not erase the conviction for federal immigration purposes; immigration authorities treat the underlying conviction as still valid. It also will not restore firearm rights lost because of the conviction. For employment, housing, and most other everyday purposes, though, this relief is worth pursuing as soon as you qualify.
