Human trafficking lawsuit settlement amounts have ranged from a few million dollars to a $40 million jury verdict, with hotel and motel operators paying the largest sums. Survivors have collectively recovered more than $255 million in civil damages and public settlements over the past 18 years, according to the Human Trafficking Legal Center.1Human Trafficking Legal Center. Our Work: Strategic Litigation What any one survivor recovers depends on how long the trafficking lasted, how young the victim was, and how clearly the defendant knew or should have known what was happening on its property.
The Largest Reported Settlements and Verdicts
In July 2025, a federal jury in Atlanta returned a $40 million verdict against Northbrook Industries, the operator of the United Inn and Suites in Decatur, Georgia. The award was split between $10 million in compensatory damages and $30 million in punitive damages. The plaintiff was a child trafficked at the hotel between 2018 and 2019; her attorney alleged staff sold condoms to the minor, who was sold for sex more than 200 times in a 40-day period.2Fox 5 Atlanta. What Drives the Dollar Amount
Attorney Nadeem Bezar, who has represented survivors in several of the largest cases, said the valuation of a trafficking case depends on the extent and duration of the trafficking, the age of the survivors, and the degree of liability of the entities involved.4CSE Institute. Kline and Specter Wins $37.5M for Sex Trafficking Victims Within those broad factors, courts and arbitrators tally several categories of damages.
Economic damages typically include lost wages, medical and mental health treatment, rehabilitation, temporary housing, transportation, childcare, and attorneys’ fees.13Southern Poverty Law Center. Civil Litigation on Behalf of Victims of Human Trafficking Calculating lost wages in sex trafficking cases is complicated because prostitution is not legal employment under most state and federal labor laws, so standard wage-and-hour formulas may not apply. Some courts have instead looked at the trafficker’s gross income or profits derived from the victim’s services.
Non-economic damages for pain and suffering are available in civil lawsuits but typically not through criminal restitution orders. Civil cases can also yield punitive damages, statutory damages, and treble damages, which go beyond what a criminal court can order.13Southern Poverty Law Center. Civil Litigation on Behalf of Victims of Human Trafficking The $40 million Georgia verdict illustrates the weight punitives can carry: $30 million was punitive, intended to punish the hotel operator, with $10 million classified as compensatory.2Fox 5 Atlanta. Documentation shapes what a survivor can prove. Legal advocates encourage survivors to gather receipts, medical records, and affidavits, and to define future losses broadly, including projected medical needs and employment limitations caused by physical or psychological harm.
Who Can Be Sued
Most hotel trafficking lawsuits rely on the Trafficking Victims Protection Reauthorization Act, specifically 18 U.S.C. § 1595, which gives survivors a private right to sue anyone who “knowingly benefits, financially or by receiving anything of value, from participation in a venture which that person knew or should have known has engaged in” trafficking. The statute allows recovery of damages and reasonable attorneys’ fees.14GovInfo. 18 U.S.C. § 1595
The “should have known” standard is what opens the door for suits against hotels. Plaintiffs point to observable red flags including frequent short-stay visitors, cash payments, refusals of housekeeping, and repeated police calls, arguing operators were on notice.15O’Hagan Spencer Koch. Ongoing Wave of Civil Lawsuits Targets the Hotel Industry Under the TVPRA Survivors also commonly bring state-law claims for negligence and premises liability, which focus on whether the hotel failed to exercise ordinary care rather than on whether it knowingly participated in trafficking.16American Bar Association. Human Trafficking Hotel Liability Framework Civil Accountability
Whether a parent brand like Wyndham or Choice Hotels can be held liable for trafficking at a franchised property is unsettled. Some courts have dismissed TVPRA claims against franchisors for lack of knowledge or agency control, as in S.J. v. Choice Hotels International, Inc. (E.D.N.Y. 2020) and S.C. v. Wyndham Hotels and Resorts, Inc. (N.D. Ohio 2024).15O’Hagan Spencer Koch. Ongoing Wave of Civil Lawsuits Targets the Hotel Industry Under the TVPRA17FindLaw. S.C. v. Wyndham Hotels and Resorts, Inc. More recent decisions have gone the other way. In February 2025, a federal court in Washington denied Choice Hotels’ motion to dismiss, allowing perpetrator, beneficiary, and vicarious liability claims against the franchisor to proceed.18Singleton Schreiber. Court Denies Choice Hotels Motion to Dismiss Whether a brand is on the hook tends to depend on the specific facts about its control over the property.
How Long You Have to File
Federal TVPRA claims must be filed within 10 years of when the cause of action arose. If the victim was a minor at the time, the 10-year clock starts on their 18th birthday.19Human Trafficking Legal Center. Federal Human Trafficking Civil Litigation The Eliminating Limits to Justice for Child Sex Abuse Victims Act, signed in 2022, removed time limits entirely for claims brought by minors.9Spencer Fane. Civil Liability for Human Trafficking: What the Hospitality Industry Needs to Know
State deadlines vary. California allows a civil action within seven years of being freed from the trafficking situation or within 10 years of reaching the age of majority. Texas gives survivors 15 years, with tolling during minority.20Shared Hope International. NSL Survey: Statute of Limitations
Alternatives to a Private Lawsuit
Not every survivor has a viable lawsuit, and some have access to compensation outside civil court. The federal Backpage remission program is the largest such pool. In December 2024, the Department of Justice forfeited over $200 million in assets traceable to the profits of Backpage.com, the classified-advertising site shut down in 2018.21U.S. Department of Justice. U.S. Department of Justice Announces Compensation Process for Victims Trafficked Through Backpage.com Individuals trafficked through Backpage.com between January 1, 2004, and April 6, 2018, or through CityXGuide between April 8, 2018, and June 19, 2020, could file claims for documented financial losses including medical care, counseling, and lost income. The filing deadline was March 31, 2026, and the Department of Justice received more than 10,000 petitions.22FBI. State victim compensation programs are also available, though the amounts are far smaller than civil lawsuits can produce. California’s program, run by the California Victim Compensation Board, provides up to $10,000 per year for up to two years for income loss, plus coverage of medical bills, dental care, mental health treatment, relocation, and home security expenses, with a $70,000 total cap for violent crime victims.24California Victim Compensation Board. Human Trafficking Program Fact Sheet Applicants do not need a police report; the board accepts alternative evidence including letters from law enforcement, signed statements from caseworkers, government documents for special visas, and medical records. In California, victims must apply within seven years of the crime, and minor victims have until their 28th birthday.25California Victim Compensation Board. For Victims: Victims of Human Trafficking
