There is no confirmed Imerys Talc settlement payout date as of mid-2026. What Has to Happen Before Anyone Gets Paid

Confirmation alone does not open the trust. Three steps stand between claimants and a check.

First, the bankruptcy court must confirm the Second Joint Plan. Second, the debtors will seek recognition of that confirmation order in the Ontario Superior Court of Justice under Canada’s Companies’ Creditors Arrangement Act; Canadian recognition is a condition of the plan becoming effective because one debtor entity is Imerys Talc Canada Inc. Insurer Objections

In January 2026, a group of insurers including Continental Casualty (CNA), Century Indemnity, TIG Insurance, and Lexington Insurance objected to updated “insurance neutrality” language in the amended plan, arguing it impairs their rights under insurance contracts.4Bloomberg Law. The Parallel Cyprus Mines Case

Cyprus Mines Corporation, Imerys’s former corporate parent, filed its own Chapter 11 case in February 2021. The two cases share the same judge and the same trust.5Kroll Restructuring Administration. Cyprus Mines Corporation Case Information Cyprus Mines’ plan was also modified on January 20, 2026, and its confirmation hearing resumed in February 2026. Both plans need to be confirmed, and the trust funded by both, before distributions can start.

How Much Will Be in the Trust

  • Johnson & Johnson settlement of approximately $505 million ($225 million initial payment plus up to $280 million in insurance proceeds), which closed on February 21, 2025.1KPMG. Tenth Report of the Information Officer
  • Rio Tinto/Zurich settlement of $340 million.
  • Cyprus Mines settlement of $195 million.
  • Imerys settlement of $75 million plus remaining proceeds from the sale of Imerys assets.
  • XL Insurance settlement of $29.25 million.

How the Money Will Be Divided

The trust splits into two pools by disease. Fund A pays ovarian cancer claimants and receives 60% of the general trust fund and 45% of the Cyprus contributions. What any individual claimant receives depends on the Trust Distribution Procedures, the type and severity of the illness, and the total number of approved claims. Can You Still File a Claim

The plan does account for people not yet diagnosed. It includes a channeling injunction under Section 524(g) of the Bankruptcy Code and appoints a Future Claimants’ Representative, James L. Patton, to represent individuals who may develop talc-related diseases later.10KPMG.
