Iran’s marriage age laws set the floor at 13 full solar years for girls and 15 full solar years for boys under Article 1041 of the Civil Code. Younger children can still be married if the father or paternal grandfather consents, a court finds the marriage is in the child’s best interest, and a judge formally approves it. In practice, that exception means girls as young as nine have been married legally in Iran.1Office of the United Nations High Commissioner for Human Rights. What Article 1041 Actually Says
Article 1041 was amended in 2002. In substance, it provides that marriage of a girl before 13 full solar years and a boy before 15 full solar years requires three things at once: the guardian’s permission, a determination that the marriage serves the child’s best interest, and a court’s approval.1Office of the United Nations High Commissioner for Human Rights. Islamic Republic of Iran Submission on the Issue of Child, Early and Forced Marriage All three conditions have to be met before the marriage can be registered.
Above those ages, the extra conditions fall away. A girl of 13 or a boy of 15 can marry with ordinary guardian consent and no judicial involvement. The 13 and 15 figures are not absolute minimums. They are the ages above which the court steps out of the picture.
How the Court Exception Works Below 13 and 15
When a guardian wants to marry off a child under the statutory age, a petition goes to a competent court. The judge weighs the case under the standard of maslahat, usually translated as expediency or best interest, and considers whether the child has sufficient physical and mental maturity for married life.2United Nations Office of the High Commissioner for Human Rights. Early and Forced Marriages in the Islamic Republic of Iran
On paper, the judge is a gatekeeper. In practice, the standard is open-ended, and approvals are routine. A UK government assessment noted that with both paternal permission and judicial approval, the legal guardian effectively has the right to marry a minor daughter on her behalf, a situation that can amount to sanctioned forced marriage.3GOV.UK. Why Girls Under Nine Can Legally Marry
Several provisions of Iranian law tie legal capacity to the Islamic age of puberty, which is counted in lunar years rather than solar. For girls, that age is nine lunar years, roughly eight years and nine months on a standard calendar. For boys, it is 15 lunar years.3GOV.UK. Country Policy and Information Note: Women – Early and Forced Marriage, Iran
The 2002 amendment specified “full solar years” for the 13 and 15 thresholds, which narrowed the gap. But because Article 1041 still allows marriage below those ages with court and guardian approval, and because the religious concept of majority kicks in at nine lunar years for girls, marriages of girls as young as eight or nine remain legally possible. Australia’s parliament, in a human-rights submission, confirmed the amended Article 1041 language uses “full solar years” while still permitting exceptions below those ages.4Parliament of Australia. Guardian Consent for Adult Women
Age is not the only restriction. Article 1043 of the Civil Code requires the permission of the father or paternal grandfather for any first marriage of a woman, even if she has reached full legal adulthood.5Food and Agriculture Organization of the United Nations. The Civil Code of the Islamic Republic of Iran
If the guardian refuses without a justifiable reason, the woman can petition a Special Civil Court. She provides details about the proposed husband and the agreed dower, the court notifies the guardian, and if no satisfactory response comes within 15 days, the court can authorize the marriage itself.5Food and Agriculture Organization of the United Nations. The Civil Code of the Islamic Republic of Iran Only the father or paternal grandfather holds this role; mothers, siblings, and other relatives have no standing under Article 1043.
Criminal Penalties for Skipping the Process
Article 50 of the Family Protection Act makes it a crime, punishable by imprisonment, to marry a girl under 13 without meeting all three Article 1041 conditions. Article 56 of the same law targets the notary: a marriage registrar who records a union in violation of Article 1041 can be criminally prosecuted.1Office of the United Nations High Commissioner for Human Rights. Islamic Republic of Iran Submission on the Issue of Child, Early and Forced Marriage
These penalties reach only marriages that bypass the required legal process. A marriage of a 10-year-old girl that goes through the courts and receives judicial approval does not trigger them. The criminal framework punishes procedural violations, not child marriage itself.
Temporary Marriage
Iranian law recognizes temporary marriage, known as sigheh or mutah, a fixed-term union subject to the same minimum age rules as permanent marriage. Girls under 13 and boys under 15 need guardian consent and court approval for a temporary marriage as well.
Enforcement is a different matter. Temporary marriages involving minors are often arranged informally within families and never registered with civil authorities, which means the court authorization step is skipped entirely. Without a record, the Family Protection Act penalties are difficult to apply, and the minor has none of the legal protections that come with a documented marriage, including rights to dower and inheritance.
Rules for Recognized Religious Minorities
Article 13 of Iran’s Constitution recognizes Zoroastrians, Jews, and Christians as the only official religious minorities and allows them to follow their own religious rules in personal matters, including marriage.6Constitute Project. Iran 1979 (rev. 1989) Constitution Marriage age for members of these three communities is set by their own religious authorities rather than by Article 1041. The state still requires civil registration, but the age and consent criteria can differ from those applied to the Muslim majority. No other religious groups receive this accommodation.
How Common Child Marriage Is in Iran
Iran’s own Civil Registration Organization data recorded roughly 118,000 marriages involving girls under 18 in 2021, up 9,000 from the previous year. Over an eight-year period, about 21 percent of all women who married in Iran were 17 or younger. Children under 15 accounted for about five percent of marriages in that same window, and approximately 13,500 marriages involving girls under 13 were registered across those eight years.
International figures track the same pattern. Among Iranian women aged 20 to 24, an estimated 17 percent were married before 18 and three percent before 15. The highest recorded year was 2014, with nearly 170,000 child marriages, more than a third of all marriages logged that year. A 2018 parliamentary effort to raise the minimum age for girls to 16 was defeated.
Whether an Iranian Marriage Is Recognized in the United States
U.S. immigration law does not set its own minimum age for spouses in family-based visa petitions. USCIS generally looks to the law of the place where the marriage was performed to determine validity.7U.S. Citizenship and Immigration Services. Marriage Involving Minor(s)
A marriage valid under Iranian law can still be rejected if it violates the strong public policy of the United States or of the state where the couple lives or plans to live. Officers are instructed to evaluate state-of-residence laws. Marriages entered without the full, free, and informed consent of both parties are not treated as valid for immigration purposes regardless of their legality in the country of origin.7U.S. Citizenship and Immigration Services. Marriage Involving Minor(s)
Most U.S. states set their marriage age floors between 16 and 18, so an Iranian marriage involving a 13-year-old bride would face serious scrutiny and would likely trigger the public policy exception. A petitioning sponsor on a Form I-864 Affidavit of Support must also be at least 18, which adds another obstacle when both spouses were minors at the time of the marriage.7U.S. Citizenship and Immigration Services.
