Iryna Zarutska: The Attack, Charges, and Iryna’s Law

Iryna Zarutska was a 23-year-old Ukrainian refugee stabbed to death on a Charlotte, North Carolina, light rail train on August 22, 2025. Surveillance video showed an unprovoked attack by a stranger seated behind her. The man charged with killing her, Decarlos Dejuan Brown Jr., was found mentally incompetent to stand trial in federal court in June 2026 and faces potential death sentences in both state and federal cases if his competency is restored. In the months after her death, North Carolina enacted sweeping pretrial-release legislation named in her memory, the Charlotte Area Transit System overhauled its security model, and the case became a flashpoint in national politics.

Who Iryna Zarutska Was

Zarutska fled Ukraine in August 2022, six months after the Russian invasion, traveling with her mother, sister, and brother after sheltering in a bomb shelter. She held a degree in art and restoration from a college in Kyiv. In the Charlotte area she obtained a work permit and found jobs at a senior citizen center and at Zepeddie’s Pizzeria. She was attending Rowan-Cabarrus Community College and hoped to become a veterinary assistant.1CNN. The Attack on the Blue Line

On the evening of August 22, 2025, Zarutska was riding the Lynx Blue Line light rail near the East/West Boulevard station in Charlotte. According to a federal affidavit, she was seated in an aisle seat when the man behind her stood up roughly four and a half minutes into the ride and attacked her with a pocketknife, striking her three times.3U.S. Department of Justice. Brown’s family has said he suffers from schizophrenia. His mother, Michelle Dewitt, obtained an involuntary commitment order that resulted in a 14-day hold, after which he was released back into family care. On another occasion, a mental health hospital declined to admit him because he was not threatening self-harm and lacked a bed. His parents eventually brought him to the Roof Above Lucille Giles Men’s Shelter in Charlotte. In 2024, police interacted with him three times and referred him to resources. In January 2025, he was arrested for misusing the 911 system after repeatedly calling emergency services and was released without bond on that misdemeanor.8KATU. State and Federal Charges

Competency Ruling and Current Status

Both prosecutions are paused on competency. Central Regional Hospital in Butner, North Carolina, conducted a forensic evaluation and concluded that Brown suffers from a mental illness involving persistent delusions, specifically a belief that a “man-made” material controls his body movements. Evaluators found he lacked a factual understanding of the legal system, could not make rational case-related decisions, and could not work with defense counsel.13WRAL. In April 2026, Brown was found incapable of proceeding in state court, and the state murder case was delayed for at least six months, with a hearing pushed to October 2026.15The Guardian. Iryna Zarutska Suspect Incompetent Charlotte Trial On June 9, 2026, U.S. District Judge Kenneth Bell of the Western District of North Carolina ruled Brown incompetent to stand trial in federal court as well, stating that “the uncontradicted evidence is the defendant is incompetent to proceed to trial.”16Courthouse News Service. Judge Bell ordered Brown committed to a secure federal medical facility for up to four months of inpatient psychiatric treatment aimed at restoring his competency. If Brown refuses medication, a separate hearing would be required to authorize forced treatment. At the end of that period, the court will reassess. If he is not restored within four months but clinicians believe restoration remains possible, treatment may be extended.13WRAL. Iryna’s Law

North Carolina enacted sweeping legislation named for the victim. House Bill 307, known as Iryna’s Law, was signed on October 3, 2025, becoming Session Law 2025-93. Most of its provisions took effect on December 1, 2025.17North Carolina General Assembly. House Bill 307 Lookup18UNC School of Government. H 307 Bill Summary

The core provisions reshape pretrial release and sentencing in violent cases:

  • A rebuttable presumption against pretrial release applies to defendants charged with specified violent offenses, meaning Class A through G felonies involving assault or the use or threat of physical force. Courts must presume that no conditions of release will reasonably assure community safety, and defendants bear the burden of overcoming that presumption.
  • Defendants charged with a first violent offense must receive a secured appearance bond or house arrest with electronic monitoring. For a second or subsequent violent offense, house arrest with GPS monitoring is required.
  • Defendants with three or more convictions at the Class 1 misdemeanor level or higher within the previous ten years are ineligible for unsecured bonds or written promises to appear.
  • If a defendant charged with a violent offense has been subject to involuntary commitment within the previous three years, or a judicial official finds the person dangerous, the court must order an examination to determine whether involuntary commitment is warranted.
  • Committing an offense while a victim is using public transportation is now an aggravating sentencing factor.
  • Post-conviction motions for relief and automatic Supreme Court reviews in death penalty cases must be heard within 24 months absent extraordinary circumstances.
  • The law appropriated funds for ten additional assistant district attorneys and five legal assistants in Prosecutorial District 26, Mecklenburg County.

The law also directed the North Carolina Collaboratory to study the intersection of mental health and the justice system and prohibited the re-creation of the state’s Task Force for Racial Equity in Criminal Justice without an act of the General Assembly.18UNC School of Government. Transit Security Changes

In the weeks after the stabbing, Charlotte officials and CATS announced a series of safety measures. Security personnel were redeployed to Blue Line platforms, and the Charlotte-Mecklenburg Police Department increased patrols at key transit areas. CATS planned to hire nearly 30 additional security staff and introduce bike units and urban terrain vehicles.19WFAE. Charlotte Mayor Announces New Safety Steps Following Light Rail Stabbing

The agency announced a strategic shift from a private “corporate security model” to what officials called a “stronger transit policing model.” Fare evasion enforcement became a priority, with Interim CEO Brent Cagle stating that “everyone needs to have a ticket.” Officials also weighed installing physical barriers and turnstiles at stations.20WBTV. Political Fallout

Zarutska’s killing became a national political issue almost immediately. President Donald Trump called Brown a “career criminal” on Truth Social and wrote that “North Carolina, and every State, needs LAW AND ORDER, and only Republicans will deliver it!” The White House said Brown’s prior release had left him “free to slaughter an innocent woman.” The administration cited the incident in justifying deployments of federal law enforcement to Los Angeles and Washington, D.C., and in threatening to send the National Guard to Chicago. Charlotte Mayor Vi Lyles and Brown’s family pointed to systemic failures in criminal justice and mental health care, including the family’s unsuccessful efforts to secure long-term treatment for him.1CNN.
