Is Belize a Non-Extradition Country? Treaties and Process

Belize is not a non-extradition country. It has a bilateral extradition treaty with the United States that has been in force since March 27, 2001, a modern domestic statute in the Extradition Act, 2023, and it participates in the Commonwealth extradition framework that covers the United Kingdom, Canada, Australia, and dozens of other nations.1U.S. Department of State. Treaty Between the United States of America and Belize on Extradition Someone wanted for a serious offense who travels to Belize can be arrested, brought before a court, and surrendered. Belize can even act on an Interpol alert before a formal extradition request arrives.

Who Belize Will Extradite To

The U.S.-Belize Extradition Treaty was signed on March 30, 2000, and entered into force on March 27, 2001.1U.S. Department of State. Treaty Between the United States of America and Belize on Extradition It is the most detailed extradition relationship Belize maintains and the one most relevant to anyone wanted by U.S. authorities.

Belize is also a member of the Commonwealth of Nations and participates in the London Scheme for Extradition within the Commonwealth, an agreed set of procedures among the 50-plus Commonwealth member states. Requests from the United Kingdom, Canada, Australia, and other Commonwealth countries move through that framework, with Belize’s Extradition Act providing the domestic legal authority.

The Extradition Act names Mexico alongside the United States as a country whose extradition relationship is separately regulated under the statute. Beyond its standing treaty partners, the Act allows “special extradition arrangements” with countries that have no treaty with Belize, so cooperation on a case-by-case basis is possible even where no formal agreement exists.2Attorney General’s Ministry of Belize. What Offenses Qualify

Under the U.S.-Belize treaty, an offense is extraditable if it is punishable in both countries by more than one year of imprisonment.3Congress.gov. Treaty Document 106-38 – Extradition Treaty with Belize This is dual criminality: the conduct has to be a crime in both places. The two countries do not need to call the offense by the same name or categorize it the same way; what matters is whether the underlying conduct is criminal and crosses the imprisonment threshold.

The Commonwealth scheme sets a slightly higher bar, requiring offenses punishable by two or more years of imprisonment.

Attempt, conspiracy, and aiding the commission of a qualifying offense are each independently extraditable.3Congress.gov. Treaty Document 106-38 – Extradition Treaty with Belize Once a request is granted for a qualifying offense, the requesting country can also obtain surrender for additional lesser offenses in the same request, even if those carry less than a year of imprisonment on their own.4U.S. Department of State. Belizean Citizenship Is Not a Shield

Many countries refuse to hand over their own nationals. Belize is not one of them. The U.S.-Belize treaty states plainly that extradition “shall not be refused on the ground that the person sought is a national of the Requested State.”1U.S. Department of State. Treaty Between the United States of America and Belize on Extradition A Belizean citizen wanted by the United States has no special protection based on nationality, and acquiring Belizean citizenship after the fact does not create one.

How the Process Works

Under the U.S. treaty, requests move through diplomatic channels.1U.S. Department of State. Treaty Between the United States of America and Belize on Extradition Belize’s Minister responsible for extradition reviews the paperwork. If it is legally sufficient, the Minister issues an “authority to proceed,” which moves the case into the courts.2Attorney General’s Ministry of Belize. Belize Code – Extradition Act, 2023 A Magistrate issues an arrest warrant, and the person is brought before the Magistrate Court for committal proceedings. The court must find that the evidence would justify sending the case to trial if the conduct had occurred in Belize. If it is satisfied, it commits the person for surrender.

Interpol Alerts and Provisional Arrest

A formal extradition request does not need to arrive before an arrest. Section 12 of the Extradition Act allows a Magistrate to issue a provisional arrest warrant based on information from Interpol that a wanted person is in Belize or on the way.2Attorney General’s Ministry of Belize. Belize Code – Extradition Act, 2023 The Magistrate issues the warrant if the evidence would justify an arrest for the same conduct domestically and the alleged offense would be extraditable.

An Interpol Red Notice is not itself an arrest warrant and does not compel any country to act on it.5INTERPOL. Red Notices Each country decides what weight to give it, and Belize’s statute answers that question: an Interpol alert is enough to justify a provisional arrest.

After the arrest, the Magistrate notifies the Minister, who decides whether to issue an authority to proceed. If the Minister declines, the warrant is cancelled. If a formal request never comes, the court can set a deadline and discharge the person from custody once it passes.2Attorney General’s Ministry of Belize. Belize Code – Extradition Act, 2023

Grounds That Can Block Extradition

The Extradition Act lists specific circumstances where Belize will not surrender someone.

Political Offenses

Extradition is barred where the offense is political in nature.1U.S. Department of State. Treaty Between the United States of America and Belize on Extradition The statute carves out categories that can never be treated as political: genocide, violence against a head of state or their family, and offenses covered by multilateral conventions that require countries to extradite or prosecute.2Attorney General’s Ministry of Belize. Belize Code – Extradition Act, 2023 The executive can also refuse surrender if it finds the request itself is politically motivated, even when the offense is not political.

Double Jeopardy

A person cannot be extradited if they have already been convicted, acquitted, or pardoned for the same offense in Belize or a third country, or already punished under Belizean law for conduct that makes up the extradition offense.2Attorney General’s Ministry of Belize. Belize Code – Extradition Act, 2023

Discrimination, Torture, and Fair Trial

Extradition must be refused if the request is actually made to prosecute or punish someone because of race, nationality, political opinions, sex, or religion, or if the person would be prejudiced at trial or face restrictions on liberty for those reasons. The 2023 Act also bars extradition where the person would be subjected to torture or cruel, inhuman, or degrading treatment in the requesting country.2Attorney General’s Ministry of Belize. Belize Code – Extradition Act, 2023

Death Penalty

The U.S.-Belize treaty itself does not contain a death penalty restriction.6U.S. Government Publishing Office. Senate Executive Report 106-26 – Extradition Treaties Section 17(4) of the Extradition Act fills the gap: the Minister may refuse to surrender a person if the offense carries the death penalty in the requesting country but not in Belize.2Attorney General’s Ministry of Belize. Belize Code – Extradition Act, 2023 This is discretionary. The Minister can still allow the extradition.

Conviction in Absence

If someone was convicted in their absence, Belize can refuse extradition on that conviction if surrender would not be in the interests of justice.2Attorney General’s Ministry of Belize. Belize Code – Extradition Act, 2023

What Happens After Surrender: The Specialty Rule

Once extradited, the person can only be prosecuted for the offense that was the basis of extradition, or a lesser offense based on the same facts. The requesting country cannot pile on unrelated charges and cannot hand the person off to a third country for pre-surrender offenses without Belize’s consent.3Congress.gov. Treaty Document 106-38 – Extradition Treaty with Belize This protection expires if the person leaves the requesting country and voluntarily returns, or stays in that country more than ten days after having the chance to leave.

Appeals Through the Belize Courts

A committal is not the final word. After the Magistrate Court commits a person for surrender, that person can apply to the High Court for habeas corpus or judicial review of the committal proceedings. If the High Court rules against them, the Court of Appeal is the next stop.2Attorney General’s Ministry of Belize. Belize Code – Extradition Act, 2023

A habeas application is not a rehearing of the extradition case. It challenges whether the committal was lawful, not whether the underlying evidence was strong. The specific legal objections have to be raised in the application itself; new arguments cannot be added later.
