Is Delta 8 Legal in Greece? Penalties, Driving, and Imports

Delta-8 THC is not legal in Greece. Greek law does not list delta-8 by name, but the country has spent the past two years classifying psychoactive cannabinoid analogs as controlled substances, and delta-8 fits the pattern squarely. Possessing it can bring criminal charges and up to five months in prison, even for personal-use quantities.

Why Delta-8 Falls Under Greece’s Drug Laws

Greece’s main drug statute is Law 4139/2013. It organizes controlled substances into tables that the government updates through ministerial decisions whenever new psychoactive compounds appear on the market. That update mechanism is how Greek regulators have handled the wave of hemp-derived cannabinoids sold as legal alternatives to delta-9 THC.

Two decisions matter for delta-8.

In January 2024, a Joint Ministerial Decision published in Government Gazette B’ 287/2024 classified hexahydrocannabinol (HHC) and its derivatives as controlled substances under Law 4139/2013. Shops were ordered to pull HHC flowers, vapes, edibles, and oils from shelves immediately. Products that had been sold openly the day before became criminal to possess.

On March 26, 2025, Ministerial Decision No. Δ3γ/οικ. 11626 placed a further group of cannabinoid analogs under Table B of the narcotics code:

  • THCP (tetrahydrocannabiphorol)
  • THC-JD (tetrahydrocannabioctyl)
  • THC-O (tetrahydrocannabinol acetate)
  • THCP-O (tetrahydrocannabiphorol acetate)
  • THCH (tetrahydrocannabihexol)
  • THCB (tetrahydrocannabutol)

Delta-8 is not named in either decision. The regulatory logic, though, is clear: Greece is systematically prohibiting intoxicating chemical analogs of delta-9 THC and CBD regardless of whether they come from hemp or how they are synthesized. Delta-8 is an isomer of delta-9 THC, it produces a euphoric effect, and it is typically made by chemically converting CBD. Every feature that drove the HHC ban and the March 2025 analog ban applies to delta-8.

Greek prosecutors do not need a compound to be listed by name if they can show it is a psychoactive cannabinoid analog within the scope of existing drug laws. Standing in a Greek airport is not the place to test that argument.

Penalties for Possession

If Greek authorities find delta-8 or any other controlled cannabinoid on you, you face prosecution under Law 4139/2013. Article 29 provides for imprisonment of up to five months for personal-use quantities.1European Union Drugs Agency. Penalties for Drug Law Offences at a Glance Quantities that suggest sale or distribution, or any evidence of trafficking, escalate the penalties sharply and can reach years in prison.

Being a tourist buys no leniency. Cases go through Greek criminal courts, a conviction leaves a record that can affect future travel across the EU and Schengen area, and the process itself can drag on long enough to restrict your movement while it is pending.

Do Not Bring Delta-8 Into the Country

Carrying delta-8 vapes, edibles, tinctures, or flower into Greece is a bad idea whether you are arriving by air, sea, or land, and whether Greece is your destination or a transit stop.

Even conventional medical cannabis is blocked at the border. In 2021, Article 71 of Law 4864/2021 added an import ban to Greece’s medical cannabis framework.2Prohibition Partners. Greece Medical Cannabis Legislation A valid prescription from your home country gives you no legal standing in Greece; prescriptions must come from a licensed Greek physician and products must be sourced domestically.

A Schengen certificate will not save you either. The Schengen Convention lets travelers carry certain prescription controlled substances across member borders with a doctor-signed, nationally validated certificate covering a 30-day supply. The mechanism was built for medications like opioid painkillers and ADHD stimulants. Given Greece’s explicit ban on cannabis imports, customs will apply domestic law and the certificate will not authorize entry of a cannabis-based product.

Driving and Roadside Testing

As of late 2025, Greek traffic police have been moving toward roadside drug testing using saliva-based screening devices that detect cannabis, cocaine, and heroin. A positive saliva result triggers a mandatory blood draw to produce evidence for court. If you have used any THC product, delta-8 included, within the detection window, you could face both possession and impaired-driving charges. Renting a car or scooter while using any cannabinoid product is particularly risky.

What You Can Legally Buy

Greece permits the sale of hemp-derived CBD products that contain no more than 0.2% delta-9 THC. You can find CBD oils and topicals in shops and pharmacies. The decisive point is that legal CBD products cannot be psychoactive. A product that produces any intoxicating effect falls outside the safe harbor regardless of what the label says about THC content, which is why delta-8 does not qualify as a legal CBD product in Greece even when the starting hemp meets the threshold.

Greece does run a medical cannabis program. It was created in 2017, when cannabis was rescheduled from Schedule A to Schedule D.2Prohibition Partners. Greece Medical Cannabis Legislation Access is narrow, prescriptions must be initiated by specialist physicians, and the approved conditions are limited to serious diagnoses such as chemotherapy-related nausea, cancer and nerve-related chronic pain, multiple sclerosis spasticity, and palliative care. The program is not an avenue for recreational delta-8 use, and a foreign prescription will not open the door to it.

If you depend on cannabinoids for a medical reason, the only workable route in Greece is to consult a Greek specialist after you arrive and see whether your condition qualifies. For delta-8 specifically, treat it as off-limits.
