GHB is illegal under federal law unless you have a prescription for the one FDA-approved form of it. So the short answer to whether GHB is legal: no, with a narrow medical exception. Possessing GHB without a valid prescription is a federal crime punishable by up to one year in prison for a first offense, and distributing it carries up to 20 years. The only lawful version is sodium oxybate, prescribed for narcolepsy and dispensed through a tightly restricted pharmacy program.
Two Legal Statuses for the Same Molecule
Federal drug law treats GHB in two very different ways depending on its source. Illicit GHB sits on Schedule I of the Controlled Substances Act, the category reserved for drugs the government considers to have a high potential for abuse and no accepted medical use.1eCFR. 21 CFR Part 1308 – Schedules of Controlled Substances Any FDA-approved drug product containing GHB, however, is classified as Schedule III, which recognizes a legitimate medical application and a comparatively lower abuse risk.2U.S. Food and Drug Administration. The identical molecule carries radically different consequences depending on whether it came from a pharmacy or the street.
The Only Legal Form: Prescribed Sodium Oxybate
Legal GHB exists in exactly one form: the prescription medication sodium oxybate. It is sold under the brand names Xyrem, an immediate-release liquid, and Lumryz, an extended-release formulation.3Drug Enforcement Administration. GHB – Gamma-Hydroxybutyric Acid The FDA approved sodium oxybate to treat cataplexy and excessive daytime sleepiness in patients with narcolepsy.2U.S. Food and Drug Administration. Xyrem (Sodium Oxybate) Information Generic versions of Xyrem received FDA approval in late 2025 and have begun reaching the market.4U.S. Food and Drug Administration. FDA Approves a Generic of Xyrem With a REMS Program
Because of the drug’s abuse potential, every sodium oxybate product is subject to a Risk Evaluation and Mitigation Strategy, or REMS. Under that program, sodium oxybate can only be prescribed by a certified prescriber and dispensed by a certified pharmacy that ships directly to enrolled patients.4U.S. Food and Drug Administration. FDA Approves a Generic of Xyrem With a REMS Program You cannot fill this prescription at a retail pharmacy, and both prescriber and patient must complete enrollment forms. If your GHB did not come through that chain, it is not legal GHB.
Penalties for Possessing GHB Without a Prescription
Simple possession of GHB without a valid prescription is a federal misdemeanor on the first offense. The maximum sentence is one year in prison, with a minimum fine of $1,000.5Office of the Law Revision Counsel. 21 USC 844 – Penalties for Simple Possession
Repeat offenses escalate sharply. A second offense, after a prior drug conviction becomes final, carries 15 days to two years in prison and a minimum $2,500 fine. A third or subsequent offense carries 90 days to three years and a minimum $5,000 fine.5Office of the Law Revision Counsel. 21 USC 844 – Penalties for Simple Possession
These are federal baseline figures. State charges can run alongside or exceed them, and some states classify even a first possession offense as a felony rather than a misdemeanor.
Penalties for Distribution
Distribution is where the exposure becomes severe. GHB is not named in the federal mandatory minimum quantity tables that apply to drugs like heroin, cocaine, and methamphetamine. Instead, GHB distribution is prosecuted under the general provision for Schedule I substances, which carries up to 20 years in prison for a first offense. With a prior conviction for a serious drug felony or serious violent felony, the maximum rises to 30 years.6Office of the Law Revision Counsel. 21 USC 841 – Prohibited Acts A
If someone dies or suffers serious bodily injury from GHB a defendant distributed, a mandatory minimum of 20 years applies, with a maximum of life imprisonment. That mandatory minimum applies regardless of quantity, and a defendant with a prior serious drug felony conviction who causes death faces mandatory life.6Office of the Law Revision Counsel. 21 USC 841 – Prohibited Acts A
A trafficking conviction also triggers mandatory criminal forfeiture of proceeds and any property used to carry out the offense, including cash, vehicles, and real estate.7Office of the Law Revision Counsel. 21 USC 853 – Criminal Forfeitures
Extra Penalties When GHB Is Used in a Sexual Assault
GHB’s reputation as a drug used in sexual assaults is reflected directly in federal law. Under 21 USC 841(b)(7), distributing a controlled substance to someone without their knowledge with the intent to commit a violent crime, including sexual assault, carries up to 20 years in prison as a standalone offense.6Office of the Law Revision Counsel. 21 USC 841 – Prohibited Acts A That charge stacks on top of any penalty for the sexual offense itself.
Federal sentencing guidelines also apply an upward adjustment when a defendant distributed a controlled substance to commit or attempt a sexual act against another person.8United States Sentencing Commission. Amendment 667 Under 18 USC 2241, administering a drug to someone without consent and then engaging in a sexual act is separately punishable by any term of years up to life. Combined exposure in these cases is among the most severe in the federal criminal code.
The Analog Trap: GBL and 1,4-Butanediol
Two chemicals closely related to GHB produce identical effects when ingested, and this is where people often misread the law.
GBL (gamma-butyrolactone) is classified as a List I chemical under the Controlled Substances Act. The body readily converts GBL into GHB after ingestion.9Drug Enforcement Administration. Gamma-Butyrolactone 1,4-Butanediol (BD) is not a controlled substance or listed chemical at all, and is sold openly as an industrial solvent, but the body also metabolizes it into GHB.10Drug Enforcement Administration. 1,4-Butanediol
Both can be prosecuted as Schedule I controlled substance analogs under the Federal Analogue Act when they are intended for human consumption. The statute looks at factors like how the substance was marketed, its price relative to legitimate versions, and whether the seller knew or should have known it would be ingested.11govinfo. 21 USC 813 – Treatment of Controlled Substance Analogues Buying GBL as a cleaning product is legal. Buying it to drink, or to spike someone’s drink, carries the same penalties as possessing GHB itself.
State Laws Vary
Most states mirror the federal dual classification, listing illicit GHB as Schedule I while permitting prescribed sodium oxybate under Schedule III or its state equivalent. Specific penalties vary. What triggers a trafficking charge in one state may be a lower-level felony in another, and some states impose stricter penalties on first-time possession than federal law does, including treating it as a felony.
Because GHB is almost always encountered as a liquid, how a given state measures quantity for sentencing matters a great deal. Some jurisdictions weigh the entire liquid mixture, while others focus on the weight of the pure GHB content. A small bottle of diluted GHB could support a high-level trafficking charge under one approach and a simple possession charge under another. For anyone facing state charges, the measurement method is one of the first things to clarify with a defense attorney.
