Yes, James Vincent Sullivan is still alive. As of 2026, he is in his early eighties and incarcerated at the Augusta State Medical Prison in Georgia, serving life without the possibility of parole for arranging the 1987 contract killing of his estranged wife, Lita McClinton Sullivan.1ABC News. What He Was Convicted Of
On the morning of January 16, 1987, a man carrying a white box with a pink bow rang the doorbell at Lita McClinton Sullivan’s Buckhead townhouse in Atlanta. When she answered, he shot her in the head. She was 35. She died about thirty minutes later at Piedmont Hospital.1ABC News. Deadly Delivery Shook Atlanta: The Long Road to Justice for Lita
Lita was due in divorce court that day. A hearing scheduled for the same morning would decide the validity of a postnuptial agreement that capped what she could claim from her husband’s estate. If a judge threw it out, she stood to collect half of Sullivan’s assets. Sullivan had sold his inherited liquor distribution company, Crown Beverages, in 1983 for roughly $5 million and bought a $2 million Palm Beach mansion.2Atlanta Magazine. The gunman was Phillip Anthony “Tony” Harwood, a North Carolina truck driver who had done moving work for Sullivan. Court records showed Sullivan propositioned Harwood in November 1986, offered him $25,000 to kill Lita, and mailed him a $14,000 certified check as a partial payment. Harwood called Sullivan from a rest stop after the shooting and said, “Merry Christmas.” Sullivan answered that he understood.3FindLaw. Sullivan v. State
Why It Took Nineteen Years
Suspicion landed on Sullivan almost immediately. Lita’s father, told that his daughter had been shot, said, “That son of a bitch did it.” But a 1992 federal prosecution for conspiracy to commit murder was dismissed for lack of evidence.2Atlanta Magazine. The case broke in 1998, when Harwood’s former girlfriend, Belinda Trahan, came forward. She told investigators that Harwood had described Sullivan’s offer and that she had personally seen Sullivan pay Harwood at a Florida restaurant after the killing. She identified Sullivan from a photo lineup. Authorities tracked Harwood to North Carolina, where he confessed. Prosecutor Clint Rucker later called Trahan “the lynchpin” of the entire case.3FindLaw. The 2006 Trial and Sentence
Sullivan went to trial in Fulton County Superior Court in 2006, nineteen years after the murder. The state, led by assistant district attorney Clint Rucker, sought the death penalty.8Macon Telegraph. James Sullivan Murder Trial
Prosecutors built their case on Harwood, who had pleaded guilty to voluntary manslaughter in 2003 for a 20-year sentence; on Trahan, who had witnessed the payoff; and on phone records tying Sullivan’s Palm Beach home to a motel near the Buckhead crime scene. They also presented a financial motive beyond the divorce itself: Sullivan needed Lita’s signature to refinance a balloon mortgage on the Palm Beach home, and he completed that refinancing within a week of her death. Rucker summed up the motive as “greed, pure and simple greed.”3FindLaw. Sullivan v. State4NBC News. Sullivan Convicted in Murder-for-Hire Case
On March 14, 2006, the jury convicted Sullivan of malice murder, aggravated assault, and burglary. It declined to recommend execution and instead returned life without parole. The judge imposed that life sentence for the murder, plus two consecutive 20-year terms for the aggravated assault and burglary counts. His own defense team acknowledged the sentence meant Sullivan would “die as an old man in state prison.”3FindLaw. Sullivan v. State9Dalton Citizen. James Sullivan Sentenced to Life Without Parole
The Appeal
Sullivan appealed on several grounds, including the sufficiency of the evidence, the search warrant executed on his Florida home, jury selection, and the trial court’s refusal to instruct the jury on voluntary manslaughter. The Georgia Supreme Court rejected every argument and affirmed the conviction on September 22, 2008, in Sullivan v. State, 284 Ga. 395. The court held that a voluntary manslaughter instruction had no place in the case because the killing was a “carefully planned hit,” not a product of sudden passion.3FindLaw. Sullivan v. State
The Civil Judgment Still Hanging Over Him
Separate from the criminal case, a Palm Beach County civil jury found Sullivan responsible for Lita’s death in February 1994 and awarded her family a $4 million wrongful death judgment. Sullivan has paid none of it. With 12 percent interest, the balance has grown to more than $13.5 million.6Palm Beach Post. Hunt for James Sullivan Money After He Had Wife Lita McClinton Killed
Collection has been difficult because, as the FBI noted, Sullivan “buried his fortune in complex offshore accounts.” Investigators have traced evidence of accounts and fees linked to Liechtenstein and Switzerland. In 2014, as the original judgment approached its 20-year expiration, the McClintons’ attorney filed suit in Palm Beach County Circuit Court to preserve the right to collect. Circuit Judge Richard Oftedal lifted the 20-year limitation, keeping the judgment enforceable. Sullivan participated by telephone from prison and did not contest the motion. If he dies before the money is located, the judgment remains enforceable against his estate.10Palm Beach Daily News. Sullivan Sued by Victim’s Family6Palm Beach Post. Where the Triggerman Stands
Sullivan’s status is not his co-conspirator’s. Harwood, the man who pulled the trigger, is not in prison. He served the full 20 years of his plea deal, with credit for the four years he spent in county jail after his April 1998 arrest, and was released from Coastal State Prison on May 25, 2018. His release drew public anger that the hitman walked out while the man who hired him remained in a cell.11Atlanta Journal-Constitution. Triggerman in Socialite Sullivan Murder Released From Prison
Sullivan himself has no such release ahead of him. Life without parole in Georgia means what it says, and the Supreme Court’s 2008 affirmance exhausted his direct appeal. He remains at Augusta State Medical Prison, and barring a death in custody, that is where he will stay.1ABC News. Deadly Delivery Shook Atlanta: The Long Road to Justice for Lita
