Is Marijuana Legal in Britain? Class B, CBD, and Prescriptions

No, marijuana is not legal for recreational use in the UK. Cannabis is a Class B controlled drug under the Misuse of Drugs Act 1971, and simple possession can carry up to five years in prison.1legislation.gov.uk. Misuse of Drugs Act 1971 Two narrow exceptions sit alongside that rule: specialist doctors have been able to prescribe cannabis-based medicinal products since November 2018, and CBD products are sold openly provided they meet strict limits on THC content.

What Class B Means in Practice

The Misuse of Drugs Act 1971 sorts controlled drugs into three classes, and cannabis sits in Class B alongside amphetamines and barbiturates. For simple possession, the maximum penalty is five years in prison, an unlimited fine, or both.2GOV.UK. The Classification of Cannabis Under the Misuse of Drugs Act 1971 Most first-time offenders caught with a small personal-use amount will not go to prison. The ceiling exists for repeat offenders and aggravating circumstances, and courts use it that way.

How Police Actually Respond

In England and Wales, officers work through an escalating response for small quantities held for personal use. A first offence with no aggravating factors can be dealt with by a cannabis warning: a formal record on local police intelligence systems, but not a criminal conviction, and it does not show on a standard DBS check.3Association of Chief Police Officers of England, Wales and Northern Ireland. Guidance on Policing Cannabis – Use of Cannabis Warnings The person must be an adult, admit the offence, and have no previous cannabis warnings or convictions.

A second offence typically brings a Penalty Notice for Disorder, a £90 on-the-spot fine. A third offence, or a larger quantity, usually means arrest and prosecution. Smoking in public, or in view of the public, is treated as an aggravating factor that moves you up this ladder faster.4The Crown Prosecution Service. Drug Offences

Scotland works differently. There is no equivalent cannabis warning scheme; officers report cases to the procurator fiscal, who decides what happens next. Police Scotland has been able to issue recorded warnings for low-level possession since 2016, but most cases are still formally reported. Northern Ireland sits under the same Act, with the Police Service of Northern Ireland applying its own discretionary guidelines. The maximum penalties are identical across the UK. What varies is how discretion is used at the lower end.

Medicinal Cannabis by Prescription

Since November 2018, specialist doctors have been able to prescribe cannabis-based medicinal products.5GOV.UK. Government Announces That Medicinal Cannabis Is Legal Only doctors on the General Medical Council’s Specialist Register can write these prescriptions, and only within their area of expertise. GPs cannot prescribe directly but can refer patients on.6Care Quality Commission. Cannabis-Based Medicinal Products – What We Look at When We Register and Inspect

NICE has recommended cannabis-based products for four conditions: severe treatment-resistant epilepsy, chemotherapy-induced nausea and vomiting that does not respond to standard anti-sickness drugs, spasticity from multiple sclerosis, and chronic pain.7National Institute for Health and Care Excellence (NICE). Cannabis-Based Medicinal Products – Guidance Prescriptions are generally reserved for patients who have not responded to conventional treatments. Products include oils, capsules, dried flower, and pastilles.

In practice, medicinal cannabis is technically available on the NHS but very rarely issued through it. The great majority of legal cannabis patients in the UK access their prescriptions through private clinics. An initial consultation typically costs around £100, with repeat prescription fees on top, and the medicine itself is not subsidised.

Where CBD Fits In

CBD products are legal and widely sold, but they have to stay within tight limits. During production, the hemp must contain no more than 0.2% THC, and the finished product must contain no more than 1mg of THC per container.8GOV.UK. Drug Licensing Factsheet – Cannabis, CBD and Other Cannabinoids A product that breaches either threshold is legally a controlled substance, whatever the label claims.

CBD foods and supplements also fall under Novel Food Regulations. The Food Standards Agency confirmed in January 2019 that CBD food products need authorisation before legal sale in Great Britain. No CBD extracts or isolates have yet received full authorisation. The FSA maintains a public list of products linked to applications made for items that were on the market before February 2020 and submitted by March 2021; anything not on that list must come off sale.9Food Standards Agency. Cannabidiol (CBD) Guidance In Northern Ireland, no CBD food products are currently authorised, because the European Commission has not approved any under EU novel food rules.

Sellers cannot make medical claims about CBD products without a specific medicinal licence. Labelling a CBD oil as a treatment for anxiety or insomnia without that licence is illegal, however common the practice.

Growing and Supplying

Penalties jump sharply once production or supply enters the picture. Growing even a single cannabis plant without a Home Office licence is a criminal offence, and the maximum sentence for production or supply of a Class B drug is 14 years in prison, an unlimited fine, or both.10legislation.gov.uk. Misuse of Drugs Act 1971 – Section 4 Courts distinguish between a plant or two in a spare room and a commercial operation; the latter attracts sentences near the top of the range.

On top of a prison sentence, the Proceeds of Crime Act 2002 gives courts the power to make confiscation orders against assets and profits connected to drug offences.11legislation.gov.uk. Proceeds of Crime Act 2002 – Confiscation Orders Cash, vehicles, property, and bank balances linked to cannabis dealing can be seized after the criminal case ends.

There is one legal route to growing cannabis plants in the UK: a controlled drugs domestic licence from the Home Office for industrial hemp. The licence permits cultivation of approved hemp strains for seed and fibre only. Harvesting or using the flowers and leaves is not allowed under a hemp licence.12GOV.UK. Industrial Hemp Licensing Every person named on the application must hold a valid enhanced DBS check from a specified provider.

Driving With Cannabis in Your System

The UK has a specific offence for driving with certain drugs in your blood above a set limit, separate from the older offence of driving while impaired. For cannabis, the limit is 2 micrograms of THC per litre of blood, set deliberately close to zero.13GOV.UK. Changes to Drug Driving Law The offence was introduced in England and Wales in March 2015 under Section 5A of the Road Traffic Act 1988. Scotland adopted the same 2μg/L threshold in October 2019.14Scottish Government. Drug Driving and Medicine – Advice for Healthcare Professionals

A conviction carries a minimum one-year driving ban, an unlimited fine, up to six months in prison, and a criminal record. The conviction stays on your driving licence for 11 years. If drug driving causes a fatal accident, the maximum penalty is life imprisonment.15GOV.UK. Drugs and Driving – The Law

THC can stay detectable in blood long after any effects have worn off, which catches out regular users who feel sober. A valid prescription offers a potential defence, but only if the drug was taken in line with medical advice and did not actually impair driving. Prescribed users should discuss driving with their specialist first, because exceeding the blood limit can still lead to prosecution where there is evidence of impairment.

The Premises Offence Hosts and Landlords Should Know

Section 8 of the Misuse of Drugs Act 1971 creates a separate offence for anyone who occupies or manages premises and knowingly allows cannabis to be smoked there.4The Crown Prosecution Service. Drug Offences This covers homeowners, tenants, and venue operators. If you host a gathering where guests smoke cannabis and you know about it, you are committing an offence whether or not you use any yourself. Landlords commonly include no-drugs clauses in tenancy agreements for this reason, and persistent use can form the basis for eviction.

Traveling Abroad With a Prescription

Taking prescribed cannabis out of the UK is legally possible, but preparation matters. Carry the medicine in your hand luggage with proof it was prescribed to you, either the original prescription or a letter from your doctor.16GOV.UK. Take Medicine In or Out of the UK The bigger problem is the destination. Cannabis is illegal in many countries regardless of whether you have a UK prescription, and a UK prescription carries no weight abroad. Check the rules with the embassy of the country you are visiting before you travel.
