Is the Charlie Kirk Shooter in Custody? Charges and Motive

Yes. Tyler Robinson, the 22-year-old accused of shooting Charlie Kirk at Utah Valley University on September 10, 2025, is in custody and has been since the night of September 11, 2025. The Charlie Kirk shooter is being held without bail at the Utah County Jail on seven charges, including capital aggravated murder, and Utah prosecutors are seeking the death penalty. As of mid-2026, Robinson has not entered a plea, and his preliminary hearing is scheduled for July 6 through 10, 2026.¹²

How Robinson Was Caught

Kirk was shot in the neck at roughly 12:23 p.m. on September 10, 2025, while speaking to about 3,000 people in an outdoor courtyard on the UVU campus in Orem, Utah. The shot came from the rooftop of the university’s Losee Center, roughly 200 yards from the stage.³⁴ The gunman fled into a wooded area, and Kirk was pronounced dead at Timpanogos Regional Hospital.

The first hours were confused. Two people were briefly detained and released. FBI Director Kash Patel posted on social media at 4:21 p.m. that a suspect was in custody, then corrected himself about 90 minutes later.⁵ The actual shooter was still at large.

By the morning of September 11, investigators had recovered a Mauser Model 98 bolt-action rifle chambered in .30-06, along with footwear impressions and palm prints, from the wooded area near campus. The FBI released photos of a person of interest and announced a $100,000 reward. Tips flooded in, but the break came from Robinson’s own family. According to CBS News, Robinson’s father recognized him in the images and confronted him. Robinson admitted the shooting but said he would rather die by suicide than surrender. His father reached a family friend who was both a youth pastor and a court security officer, and that intermediary helped calm Robinson and contacted the U.S. Marshals Service.⁶ The Washington County Sheriff later said Robinson eventually surrendered accompanied by his parents, having said he feared being shot by police.⁷ From the shooting to the arrest, the manhunt lasted about 33 hours.⁵ DNA taken from the rifle’s trigger later confirmed Robinson’s identity.

Who Tyler Robinson Is

Tyler James Robinson grew up in the St. George, Utah, area, graduated from Pine View High School in 2021, and briefly attended Utah State University on a $32,000 scholarship before leaving after one semester.⁸ At the time of the shooting he was a third-year electrical apprentice at Dixie Technical College and held an apprentice electrician license. He lived in a St. George apartment with a romantic partner and was registered to vote as unaffiliated, though he had never cast a ballot.⁹ State and federal records showed no prior criminal history.

The rifle used in the shooting was a Mauser Model 98 that prosecutors say belonged to Robinson’s grandfather. In a message to his partner after the shooting, Robinson wrote, “I’m worried what my old man would do if I don’t bring back grandpa’s rifle.”¹⁰ The weapon had been modified with a replacement barrel for .30-06 rounds and likely predates the 1968 federal law requiring firearms to carry serial numbers.¹¹

The Charges Against Him

Robinson was formally charged in Utah’s Fourth Judicial District Court, Utah County, with seven counts:¹²

Aggravated murder, a capital felony carrying the possibility of the death penalty
Felony discharge of a firearm causing serious bodily injury, a first-degree felony
Two counts of obstruction of justice, second-degree felonies, tied to alleged efforts to conceal evidence after the shooting
Two counts of witness tampering, third-degree felonies, based on text messages directing his romantic partner to delete their messages and refuse to speak with investigators¹³
Violent offense committed in the presence of a child, a class A misdemeanor

Prosecutors have said they will seek the death penalty. Robinson is being held without bail. He has not entered a plea and, according to authorities, has not cooperated with investigators.¹¹⁴

What Prosecutors Say About Motive

According to charging documents and reported statements, Robinson told his parents he acted because “there is too much evil and the guy spreads too much hate.”¹⁵ In text messages to his partner, he wrote that he “had enough of his hatred” and that “some hate can’t be negotiated out.” A note found under his keyboard read: “I had the opportunity to take out Charlie Kirk and I’m going to take it.”¹⁶ Robinson told his partner he had planned the attack for “a little over a week.”¹⁷

Robinson’s mother told investigators her son had grown more politically engaged over the previous year, with his views shifting to the left, and that he had become “more pro-gay and trans-rights oriented” following the start of a relationship with a roommate who was transitioning.¹⁷

Shell casings recovered near the campus carried unusual engravings. One read “Hey fascist! Catch!” with arrow symbols referencing the video game Helldivers 2. Others contained lyrics from the Italian anti-fascist song “Bella Ciao” and internet meme references from the furry subculture. Governor Spencer Cox said the “Hey fascist! Catch!” inscription “speaks for itself.”¹⁸ Robinson described the engravings to his partner as “mostly a big meme.” Prosecutors have said it remains unclear whether Robinson held a coherent political ideology, and authorities were considering whether the attack fits the category of “nihilistic violent extremism.”¹⁷

Pretrial Fights and What Comes Next

Two disputes have shaped the pretrial phase. First, Robinson’s defense team, led by attorney Kathryn Nester, moved in late 2025 to disqualify the entire Utah County Attorney’s Office. The defense argued that Deputy County Attorney Chad Grunander’s 18-year-old daughter had been at the event when Kirk was killed, creating a disqualifying conflict, and that prosecutors had not put a screening process in place.¹⁹ On February 24, 2026, Judge Tony Graf rejected the motion, finding there was “not a significant risk” of compromised prosecution and noting the daughter had been facing away from the shooting, did not witness the killing, and was not a material witness.²⁰

The second fight followed comments by Deputy County Attorney Christopher Ballard to TMZ and Fox News that prosecutors had “ample evidence” to prove Robinson’s guilt. The defense argued the statements violated a pretrial publicity order and asked the court to bar prosecutors from seeking the death penalty as a sanction.²¹ On June 26, 2026, Judge Graf found Ballard in civil contempt but called the requested sanction “grossly disproportionate.” Instead, the judge ordered an expanded jury selection process with additional screening for potential prejudice and required prosecutors to pay Robinson’s legal fees on the contempt motion.²² Graf found the comments were not made with a “malicious desire” to taint the jury pool.²³ The death penalty remains available to prosecutors.

Robinson’s preliminary hearing is scheduled for July 6 through 10, 2026. At that hearing, a judge will decide whether there is enough evidence to send the case to trial. Ahead of it, Judge Graf ruled that prosecutors may present hearsay evidence and denied a defense request to close portions of the proceeding to the public and press.¹⁴²
