There is no active class action lawsuit against Etsy at the moment. The most recent one, a California privacy case filed in July 2025 over the company’s use of tracking pixels, was voluntarily dismissed by the plaintiff three months later. Earlier class actions against Etsy, covering securities fraud, pandemic-era sales tax on face masks, and website accessibility for blind users, were either dismissed by the courts or resolved out of public view.
The 2025 Pixel Tracker Privacy Case
In July 2025, California resident Austin White filed a proposed class action in the U.S. District Court for the Northern District of California. The case, White v. Etsy Inc. (No. 4:25-cv-05644), alleged that Etsy embedded third-party tracking pixels from Google, Meta, TikTok, and Microsoft on its website. According to the complaint, those pixels captured visitors’ IP addresses, browsing activity, session duration, device details, and geolocation, then sent the data to the third parties for advertising and behavioral profiling.1Bloomberg Law. White argued the practice violated the California Invasion of Privacy Act and California’s Unfair Competition Law. The complaint described the pixels as unauthorized “trap-and-trace” devices, which under CIPA require a court order or explicit user consent, and said Etsy’s privacy policy did not adequately disclose the collection. The suit sought statutory damages, attorney fees, and an injunction.2Top Class Actions. Etsy Class Action Alleges Website Uses Trackers to Collect Users Data
On October 24, 2025, White’s attorneys filed a motion to voluntarily dismiss the claims. One industry observer noted that a dismissal of this kind typically signals the two sides reached some form of agreement.3Value Added Resource. Shareholder Lawsuit Over Counterfeit Goods
After Etsy’s April 2015 IPO, investors sued the company in the U.S. District Court for the Eastern District of New York. The case, Altayyar v. Etsy, Inc. et al. (No. 1:15-cv-02785), also named CEO Chad Dickerson and CFO Kristina Salen. Shareholders alleged the IPO prospectus failed to disclose that more than 5% of merchandise on the site may have been counterfeit or trademark-infringing, and that brand owners’ enforcement efforts against sellers threatened Etsy’s listing fees and commissions. The complaint cited Section 10(b) and Rule 10b-5 of the Securities Exchange Act, with control-person claims under Section 20(a).4Grossman LLP. U.S. District Judge Ann Donnelly dismissed the case on March 17, 2017, ruling that “no reasonable investor” could view Etsy’s disclosures as misleading. The prospectus, she found, included sufficient warnings about the company’s limited ability to prevent counterfeiting, and Etsy had no duty to adjust its financial metrics for infringement.5WWD. Pennsylvania Face Mask Sales Tax Case
In January 2021, Pennsylvania consumer Vince Ranalli filed a proposed class action in the U.S. District Court for the Western District of Pennsylvania. Ranalli v. Amazon.com LLC et al. (No. 2:21-cv-00088) accused Etsy, Amazon, Outdoor Research, Brave New Look, and Zazzle of unlawfully charging sales tax on protective face masks, which a Pennsylvania executive order had classified as nontaxable medical supplies during the pandemic.6ClassAction.org. Amazon was dismissed into arbitration. Zazzle settled privately in June 2021. In November 2021, U.S. District Judge Robert J. Colville dismissed the remaining claims against Etsy, Outdoor Research, and Brave New Look, ruling that collecting sales tax is a “public duty imposed by statute” and not “trade or commerce” under Pennsylvania’s Unfair Trade Practices and Consumer Protection Law. The court found no evidence of intent to deceive and noted the tax proceeds went to the state.7Top Class Actions. Etsy Dodges Class Action for Adding Sales Tax to Face Masks During Pandemic
Website Accessibility Case
In May 2022, a visually impaired plaintiff named Lamar Brown filed Brown v. Etsy Inc. (No. 1:22-cv-4174) in the U.S. District Court for the Southern District of New York, alleging Etsy.com violated the Americans with Disabilities Act by being inaccessible to screen-reader users. The complaint pointed to missing or poor alt-text on images, drop-down menus that did not announce their state, no keyboard navigation, and a checkout flow that required a mouse. Brown sought to represent a nationwide class and a New York state subclass of legally blind individuals.8Top Class Actions. Etsy Class Action Alleges Website Inaccessible to Blind Visually Impaired
Seller Fund Reserves Were Not a Class Action
Etsy’s 2023 practice of holding seller earnings in reserve generated boycotts, press coverage, and policy changes, but no class action was filed. The company began withholding up to 75% of some sellers’ earnings for as long as 45 days, saying it needed the funds to cover potential refunds and keep the marketplace safe. Etsy said fewer than 2% of active sellers were affected; seller estimates put the figure near 140,000 worldwide, with roughly $7 million held at any given time. After seller strikes and shop closures, Etsy announced in August 2023 that it would reduce reserve levels globally, with the most common hold expected to drop to 30%.9The Guardian.
