There is no active class action against Hardie Board siding that homeowners can currently join, and no class action over the product has ever produced a payout. The main U.S. case, a multidistrict litigation consolidated in Minnesota federal court, was dismissed in 2018 when the judge refused to certify a class and threw out the plaintiffs’ key expert. Two separate class actions in New Zealand involving a related James Hardie cladding product also collapsed, one mid-trial and one on appeal in 2024. If you own a home with HardiePlank and believe it has failed, your remaining option is an individual warranty claim with James Hardie, not a class action.
The U.S. Class Action Was Dismissed in 2018

The homeowners alleged the siding shared a common design flaw — low interlaminar bond strength — that let moisture penetrate and caused delamination, warping, cracking, shrinkage, flaking, discoloration, and coating failures well before the advertised 50-year lifespan.3vLex. In Re Hardieplank Fiber Cement Siding Litigation, 284 F.Supp.3d 918 In severe cases, boards reportedly broke and fell off buildings. The complaint also attacked the “50-year transferable warranty” as misleading because the warranty actually excluded labor costs and many common causes of damage, and it accused the company of denying claims by blaming installers.4ClassAction.org. James Hardie Siding Class Action Lawsuit Claims included breach of express and implied warranty, negligence, consumer protection violations, and unjust enrichment.1GovInfo. In Re: HardiePlank Fiber Cement Siding Litigation, Case No. 12-md-2359
On January 2, 2018, Judge Davis denied class certification and excluded the testimony of the plaintiffs’ key expert, Joel Wolf.1GovInfo. In Re: HardiePlank Fiber Cement Siding Litigation, Case No. 12-md-2359 The court found Wolf’s methodology “fundamentally flawed and untrustworthy,” pointing to a small, non-representative sample, modifications to standard testing methods that had no peer review, and a failure to show statistical significance.5CaseMine. In Re Hardieplank Fiber Cement Siding Litigation Without credible expert evidence of a class-wide defect, the plaintiffs could not prove the core of their case on a common basis.
On certification itself, the judge ruled that any common issues were “overwhelmed by a myriad of individualized fact questions.” Deciding whether each homeowner’s problems came from a product defect, installation error, or environmental factors would require separate mini-trials, and the variation in state laws across the plaintiffs’ home states made things worse.1GovInfo. In Re: HardiePlank Fiber Cement Siding Litigation, Case No. 12-md-2359 The court also granted summary judgment on the named plaintiffs’ individual claims. The litigation was officially closed on August 31, 2018, with no class ever certified and no money paid to homeowners.4ClassAction.org. James Hardie Siding Class Action Lawsuit
Why These Cases Keep Failing: The Installation Defense
The reason a class action against Hardie Board siding is so hard to sustain comes down to one argument the company has used successfully for years: failures are caused by how the siding is installed, not by the siding itself. James Hardie publishes detailed installation instructions, and its warranty is voided when those instructions are not followed. Home inspectors who have examined failing installations have reported finding improper nailing, inadequate flashing, poor caulking, and insufficient ground clearance on every damaged section they evaluated.6Structure Tech Home Inspections. Fiber cement absorbs moisture and dries slowly. Overdriven or shallow nails create cracks that let water in. Poorly sealed joints and window areas compound the problem. Once water gets behind the siding, mold, rot, and structural damage follow — outcomes that may look like product failure but, according to James Hardie, trace back to workmanship.6Structure Tech Home Inspections. The New Zealand Cases Also Failed

What a Homeowner Can Do Instead
With no class action available to join, an individual warranty claim is the only direct route for a homeowner who believes their HardiePlank has failed. James Hardie accepts claims through its online portal or by calling 866-375-8603. You will need proof of purchase (a contractor invoice or photographs of the product identification codes on the back of the boards), at least three photographs of the condition at issue, elevation photos of each side of the home, and proof of ownership.12James Hardie. Know the warranty’s limits before you file. Until 2009, James Hardie offered a 50-year prorated limited warranty; since then it has offered a 30-year non-prorated limited warranty.5CaseMine. The company retains sole discretion to replace boards or issue a refund, and it has been accused of attributing failures to installation error to deny claims.13ClassAction.org. In March 2025, the National Advertising Review Board recommended James Hardie modify or discontinue several claims about the fire- and water-resistant properties of its fiber cement siding, after a challenge brought by competitor Louisiana-Pacific Corporation. The panel found a fire-protection demonstration video unsupported, two California wildfire survivor testimonials misleading because no causal link to the product was shown, and a water-resistance comparison misleading because it did not reflect real-world conditions. James Hardie said it disagreed with parts of the decision but agreed to comply.14BBB National Programs.
