James Franco Lawsuit: Studio 4 Claims, Settlement, and Career Fallout

The James Franco lawsuit was a 2019 class action filed in Los Angeles Superior Court by former students of his acting school, Studio 4, alleging that Franco and his business partners used the school to sexually exploit and defraud aspiring young actresses. The case settled in June 2021 for $2,235,000, with Franco and his co-defendants denying the allegations but agreeing to resolve the claims.¹

What the Studio 4 Students Alleged

Franco co-founded Studio 4 in 2014 with Vince Jolivette, running acting classes in New York and Los Angeles. The school marketed itself in part on access: tuition, students were led to believe, would open the door to auditions for projects made by Franco’s company, Rabbit Bandini Productions.² Studio 4 closed abruptly in October 2017.³

Two former students, Sarah Tither-Kaplan and Toni Gaal, filed the complaint. They alleged that Franco, Jolivette, and fellow instructor Jay Davis ran the school to “create a steady stream of young women to objectify and exploit,” and that promised audition opportunities were rare and, when they came, often required nudity.⁴¹

Much of the complaint centered on a “Sex Scenes” master class that carried an additional $750 fee. Tither-Kaplan alleged the class pressured students to “get naked and do sex scenes and not complain and push the envelope.” She also alleged that footage from a short film produced in the class, Hungry Girl, was uploaded to a Studio 4 Vimeo page and later appeared on pornography websites without the students’ consent.¹²

The suit also framed the school as a fraud. California law prohibits charging actors for auditions. By framing paid classes as educational rather than audition-based, the plaintiffs argued, the defendants sidestepped the rule while still collecting tuition from students chasing access to Franco’s productions.⁴

The Specific Incidents Described

Tither-Kaplan’s most detailed accusation involved a 2015 shoot for a Franco-directed film called The Long Home. She said that during an orgy scene, Franco removed clear plastic guards that had been placed over the actresses’ genitals while he simulated oral sex on them. She also described being made to perform an unscripted topless scene while wearing an animal skull, and said an actress who refused was sent home.²

Two other former students, Hilary Dusome and Natalie Chmiel, described a 2012 shoot at a strip club where they said Franco became visibly angry when no women volunteered to go topless after he asked.²

Actress Violet Paley, who was not a Studio 4 student, described a mentor-mentee relationship with Franco that turned romantic in early 2016 and alleged that Franco pressured her into performing oral sex on him in her car. She said the “power dynamic was really off” and that she complied because she didn’t want him to dislike her.⁵ Paley did not join the class-action suit.

How the Case Was Filed and Settled

Tither-Kaplan and Gaal filed their complaint in October 2019 in Los Angeles Superior Court, case number 19STCV35156, assigned to Judge David S. Cunningham. The suit named Franco, Jolivette, Davis, and several Rabbit Bandini-affiliated entities, and sought to represent more than 100 former female students.⁶⁷⁸

In February 2021, Tither-Kaplan and Gaal agreed to drop their individual claims as part of a preliminary settlement.⁷ By June 2021, the terms of the full settlement were public. The total was $2,235,000. Tither-Kaplan received $670,500 and Gaal $223,500, both subject to attorney fees. Roughly $1.341 million was set aside for the remaining class members, with any unclaimed funds going to the National Women’s Law Center.⁹ The settlement was structured as opt-in: class members had to affirmatively accept payment to release their claims.⁶

No one admitted wrongdoing. The parties issued a joint statement noting that while the defendants “continue to deny the allegations in the Complaint, they acknowledge that Plaintiffs have raised important issues; and all parties strongly believe that now is a critical time to focus on addressing the mistreatment of women in Hollywood.”¹⁰

What Franco Has Said

For years, Franco said little. When the allegations first drew national attention in January 2018, he appeared on The Late Show with Stephen Colbert and said the claims circulating on Twitter were “not accurate,” while adding, “I completely support people coming out and being able to have a voice.” He told Colbert, “If I have done something wrong, I will fix it.”¹¹

He was more candid in December 2021, months after the settlement, in an interview with SiriusXM host Jess Cagle. Franco admitted he had slept with students at Studio 4. “I did sleep with students. That was wrong,” he said, while denying the school had been a “master plan” to enable those encounters and saying he had been “completely blind to power dynamics” at the time.¹² He described himself as having a sex addiction, said his behavior “spun out to a point where it was like I was hurting everybody,” and acknowledged cheating on every partner before his current one. On the “Sex Scenes” class, he said the title was deliberately provocative and the class was meant to be about “contemporary romance,” while conceding there were “certain instances” where he was in a “consensual thing with a student and I shouldn’t have been.”¹³

The plaintiffs were not persuaded. Through their attorneys, Tither-Kaplan and others called Franco’s conduct “despicable,” not a “misunderstanding over a course name,” and described his interview as “a transparent ducking of the real issues.”¹⁴

What Happened to Franco’s Career

The case effectively pulled Franco out of Hollywood for years. His last notable English-language credits before the hiatus were the animated film Arctic Dogs and the final season of HBO’s The Deuce, both in 2019.¹⁵ Longtime collaborator Seth Rogen said in 2021 that he had “no plans” to work with Franco again. By 2024, Franco confirmed the friendship was over, telling Variety, “I haven’t talked to Seth. I love Seth, we had 20 great years together, but I guess it’s over.”¹⁶

Franco returned to acting in 2024 through European productions, starring in the French thriller The Price of Money: A Largo Winch Adventure and the Italian drama Hey Joe, which premiered at the Rome Film Festival.¹⁶ In May 2026, he joined the cast of a Rambo prequel titled John Rambo, starring Noah Centineo and directed by Jalmari Helander. Franco described his role as small, and the film, which wrapped in Thailand, is expected for release in late 2026 or early 2027.¹⁷ He attended the 2026 Cannes Film Festival with his partner, Izabel Pakzad, and pushed back on the framing of a comeback, telling Deadline, “I’ve been here the last three or four years running, selling things.”¹⁸
