The 1998 Case and Plea Deal

On April 6, 2012, Hooker was arrested and charged with one felony count of oral copulation with a minor for the 1998 incident at Davis High School. He pleaded not guilty and was released from Stanislaus County Jail on $50,000 bail.5ABC News. The 2024 Arrest and the Autumn Rose Allegations

In September 2024, more than a decade after the plea deal, a minor contacted police alleging that Hooker had possessed and shared explicit images of children.10Modesto Bee. Her family later identified her as Autumn Rose. Hooker and Rose had married after she turned 18.

Hooker was arrested and charged with two felonies: lewd acts with a child aged 14 to 15, and possession of child pornography. He pleaded not guilty and was released on bail.11KCRA. Turlock Man Arrested for Juvenile Molestation Pleads Not Guilty

Autumn Rose’s Death and the Dismissed Charge

In early July 2025, days before she was scheduled to testify against Hooker, Autumn Rose was found dead at age 20. Stanislaus County Deputy District Attorney Wendell Emerson said an autopsy determined the cause was health-related, likely alcohol-related liver failure, and investigators found no evidence of foul play.12Modesto Bee. Autumn Rose Death and Hooker Case Rose’s parents, Marina Gonzales and Matthew Rose, publicly disputed the finding, saying their daughter had no history of alcohol use and generally avoided medications.

Because prosecutors considered Rose a key witness and said they lacked sufficient evidence to proceed without her testimony, the Stanislaus County District Attorney’s Office dismissed the felony charge of lewd acts with a child in July 2025.13KCRA. Revived Charges and Repeated Delays

Prosecutors kept pursuing the case on the remaining child pornography count, with a preliminary hearing set for November 17, 2025. Defense attorney Robert Chase argued the evidence was insufficient and that all charges should be dropped.9KCRA. Former Modesto Teacher Child Pornography Charges Court

By December 2025, Deputy District Attorney Harshan Samra told the court that additional analysis supported proceeding on both the child pornography count and a revived charge involving Autumn Rose, framed as a “victimless prosecution.” The case moved forward with two counts: lewd and lascivious acts with a minor, and possession of child sex abuse material.14Fox 40. Case Against Former Modesto Teacher James Hooker Delayed Again

The December hearing was delayed after Chase requested more time, citing health concerns that affected his ability to cross-examine witnesses. Judge Jeff Mangar rescheduled the preliminary hearing for March 16, 2026. When that date arrived, Chase again told the court he was unprepared because of medical issues. Judge Mangar removed Chase as defense counsel, citing case law holding that a defendant’s right to competent, prepared counsel outweighs the right to a speedy preliminary hearing, but that the court could not allow open-ended delays.15Modesto Bee. Where the Case Stands Now

As of June 2026, Hooker, now 55, remains out of custody. Judge Dawna Reeves set a preliminary hearing for October 9, 2026, at 8:30 a.m. in Department 1 of Stanislaus County Superior Court, with an early case management conference scheduled for August 10, 2026.1Modesto Bee. Judge Sets October Preliminary Hearing for James Hooker Reeves said the case had been pending for over a year without a preliminary hearing and indicated she intended to keep proceedings moving. Scheid requested the additional time to obtain investigative materials and transcripts from his predecessor.

Marina Gonzales has described the repeated delays as an “open wound.” Prosecutors have noted the family may assert concerns under California’s Marsy’s Law, which protects victims’ rights during criminal proceedings. The felony charge of lewd acts with a minor remains the primary count, alongside possession of child sex abuse material. No trial date has been set.
