Jimmie Johnson Charter Lawsuit: Settlement, Puchyr Case, and 2027

The lawsuit between Jimmie Johnson’s Legacy Motor Club and Rick Ware Racing over a $45 million NASCAR charter ended in a confidential settlement announced on September 19, 2025. Legacy got the charter it wanted, but a pre-existing lease means the team cannot actually run it until the 2027 Cup Series season. A related suit Legacy filed against motorsports broker T.J. Puchyr is still active.

What the Two Teams Were Fighting Over

Legacy and Rick Ware Racing signed a Charter Purchase Agreement on March 3, 2025, for roughly $45 million, with Legacy putting down a $750,000 non-refundable deposit.¹² Almost immediately, the two sides discovered they did not agree on what they had signed.

The disagreement had two parts. On timing, Legacy said the charter was to transfer for the 2026 season; Rick Ware said the parties had understood 2027, because one of RWR’s charters was already leased to RFK Racing through 2026.³ On identity, the written contract named Charter No. 27, but RWR maintained the parties had discussed Charter No. 36, calling the signed document riddled with “several errors and misstatements of fact.”² Selling Charter No. 27 for 2026 would have stripped RWR of the charter it needed to race, effectively ending the team.⁴

Rick Ware told Legacy it would not close the deal and tried to return the $750,000 deposit. Legacy refused it.²

How the Lawsuit Unfolded

Legacy filed a verified complaint on April 1, 2025, in Mecklenburg County Superior Court in Charlotte, alleging breach of contract and asking the court to stop RWR from selling the charters elsewhere.⁵ A judge denied Legacy’s first request for a preliminary injunction in late April, and Rick Ware publicly called the ruling vindication.⁴ Legacy reportedly offered another $5 million on top of the original price to secure Charter No. 27, without breaking the deadlock.¹

In June 2025, RWR filed a countersuit asking the court to declare the agreement invalid, confirm Legacy had no claim to Charter No. 36, and dismiss Legacy’s complaint. RWR argued there had been “no meeting of the minds.”²

The picture changed again when T.J. Puchyr, the consultant who had helped broker the original Legacy-RWR deal, announced his own agreement to buy Rick Ware Racing outright for $150 million, with plans to build it into a three-car Cup team by 2027.⁶

On August 22, 2025, Mecklenburg Superior Court Judge Clifton Smith granted a preliminary injunction blocking Rick Ware from selling the team or transferring either charter while the case continued. That order expanded a temporary restraining order that had already paused the Puchyr transaction.⁷ Judge Smith found Legacy had shown a likelihood of success on the merits, a likelihood of irreparable harm without the injunction, and that potential damage to Legacy outweighed harm to Ware.⁸ A $5 million bond Legacy had posted stayed in place, and a trial was scheduled for January 2026.

The Settlement

The trial never happened. On September 19, 2025, Legacy and Rick Ware Racing announced a settlement under which RWR would sell and transfer a charter to Legacy. Rick Ware said the resolution followed recent meetings with Jimmie Johnson and Legacy CEO Cal Wells, and both sides called the outcome “mutually beneficial” and “amicable.”⁹ Financial terms were not disclosed.¹⁰

On November 20, 2025, the parties filed a joint dismissal of all claims, including RWR’s countersuit, and Legacy’s $5 million bond was released.¹¹

One catch remained. The charter Legacy acquired was still under RWR’s earlier lease to RFK Racing for the 2026 season. Legacy chose to honor that lease, so RFK Racing continues to use the charter for its No. 60 driven by Ryan Preece through 2026.¹² Legacy is running two full-time entries for 2026, the No. 42 with John Hunter Nemechek and the No. 43 with Erik Jones.¹³

The Puchyr Lawsuit Is Still Going

Legacy’s separate case against T.J. Puchyr and his firm, Rucus Racing LLC, filed July 16, 2025, in Charlotte, has not settled. The complaint alleged Puchyr used insider knowledge and a position of trust gained through consulting work for Legacy to interfere with the RWR agreement, struck a “backroom deal” to leapfrog Legacy’s purchase, made disparaging public remarks about Jimmie Johnson, and contacted Legacy’s sponsors directly. It brought three claims: tortious interference with contract, tortious interference with prospective economic advantage, and violations of North Carolina’s Unfair and Deceptive Trade Practices Act.¹⁴¹⁵

Puchyr disputed Legacy’s account. He told ESPN the contract Legacy wrote was unworkable and that “none of the parties can perform,” and said Legacy had tried to humiliate Rick Ware publicly. On Johnson personally, Puchyr said, “If anybody deserves a pass it is Jimmie, and if he wants to sit down and talk about it like men, I’d entertain the conversation.”⁶

Legacy filed a sealed amended complaint in February 2026 seeking actual, punitive, and treble damages and alleging Puchyr acted with malice, misused confidential information, and violated the parties’ consulting agreement.¹⁶

Rucus Racing answered in April 2026 with counterclaims. It alleges Legacy owes Puchyr a 7.5% commission for negotiating a sponsorship deal with Dollar Tree and wrongfully terminated the consulting agreement without providing the required 10-day cure period. Rucus also argues Legacy filed suit to coerce Puchyr into dropping his commission claims and to damage his reputation. The counterclaims include breach of contract, breach of implied good faith, and unfair and deceptive trade practices, and Rucus has asked the court to dismiss Legacy’s case and move the litigation to business court.¹⁷ Whether Puchyr’s proposed $150 million purchase of Rick Ware Racing will still proceed is unclear; as of early 2026, no public update on that transaction has surfaced.¹⁶

What Happens in 2027

Jimmie Johnson confirmed in March 2026 that Legacy will expand to three Cup cars in 2027 once the RFK lease expires. “Without question, we will have a third car on the grid next year,” he said.¹⁸¹⁹²⁰ Rick Ware Racing plans to keep operating in 2026, with Rick Ware saying at the time of the settlement that the team will field the No. 51 as a chartered entry.²¹

One outside development affected the value of what Legacy bought. In December 2025, NASCAR settled a separate antitrust lawsuit brought by 23XI Racing and Front Row Motorsports. That agreement made all 36 charters permanent under “evergreen” provisions, gave teams a share of international media revenue and a formal voice in governance, and was widely expected to push charter valuations higher. Every charter-holding organization, including Legacy and RWR, received contract amendments reflecting the new terms.²²¹⁶
