John Connolly, FBI Agent: Convictions, Release, Motion to Vacate

John Connolly is the former FBI agent whose corrupt handling of Boston mobster James “Whitey” Bulger became one of the worst law enforcement scandals in American history. He was convicted of federal racketeering in 2002, convicted of second-degree murder in a Florida state court in 2008, and sentenced to 40 years in prison. Now 85 and on compassionate medical release in Massachusetts, Connolly is asking a Miami-Dade court to vacate the murder conviction based on a handwritten Bulger manuscript that his lawyers say prosecutors hid for years.¹

From South Boston to the FBI’s Boston Office

Connolly was born on August 1, 1940, and grew up in the Old Harbor housing project in South Boston, a mostly Irish neighborhood where the local underworld was a fact of daily life. He earned an undergraduate degree from Boston College and attended Suffolk Law School without finishing a law degree.²

He joined the FBI in 1968 and worked early assignments in Baltimore, San Francisco, and New York City. In 1972, after arresting Mafia figure Frank Salemme, he transferred back to the Bureau’s Boston office and stayed there for the rest of his career.² For a stretch, he was celebrated inside the Bureau as a mob-buster whose informants helped dismantle the Angiulo family, the Mafia’s Boston operation.³ He retired in 1990.

The Bulger Informant Relationship

In 1975, Connolly began handling Whitey Bulger as a confidential informant, and Bulger’s partner Stephen Flemmi was signed up as well.² The theory of the FBI’s Top Echelon Informant program was to trade limited protection for intelligence on rival criminals; Bulger, running South Boston’s Winter Hill Gang, was expected to give up Italian Mafia figures.

The relationship became something else. Rather than only receiving intelligence, Connolly fed Bulger and Flemmi law enforcement secrets, including the identities of other informants, details of wiretaps and surveillance, and advance notice of pending indictments.⁴ Kevin Weeks, Bulger’s right-hand man, later testified about a special fund built from criminal proceeds and used to pay Connolly. John Martorano, a hitman for the gang, described payments as well, and Salemme said he and Flemmi handed Connolly $5,000 on two occasions.⁵

Connolly’s supervisor John Morris was compromised too. Morris admitted taking $7,000 in payoffs from Bulger and acknowledged protecting him from prosecution.⁶ Morris was granted immunity and testified against Connolly, whom he had once called his “best friend.”⁷ Who really leaked what would later become the pivot of Connolly’s defense.

The Killings That Put Him in a Florida Courtroom

The murders at the center of Connolly’s prosecution trace back to World Jai Alai, a Florida gambling company. Roger Wheeler, its Tulsa-based owner, discovered that people connected to the Winter Hill Gang were skimming from operations; former FBI agent H. Paul Rico, working as the company’s security chief, had been funneling funds to Bulger and Flemmi.⁸ On May 27, 1981, Martorano shot Wheeler between the eyes in a country club parking lot in Tulsa.⁹

Wheeler’s murder created loose ends. In early 1982, FBI informant Brian Halloran told agents that Bulger and Flemmi had ordered the Tulsa hit. Connolly learned Halloran was cooperating and passed that to Bulger; Halloran was murdered in May 1982.¹⁰ Prosecutors say Connolly then warned Bulger and Flemmi that former World Jai Alai executive John Callahan, who knew enough to implicate them in the Wheeler killing, was about to talk. Martorano was sent to kill Callahan. On or about July 31, 1982, Callahan was shot dead and his body was left in the trunk of a Cadillac at Miami International Airport.³

The 2002 Federal Racketeering Conviction

Connolly was indicted on October 11, 2000, on federal racketeering charges in the District of Massachusetts.¹⁰ At trial, cooperating witnesses from Bulger’s circle described the payments and the leaks. Prosecutors also proved that Connolly had tipped Bulger, Flemmi, and Salemme about pending 1995 federal indictments, helped draft an anonymous letter to a federal judge on forged Boston Police Department letterhead, and coached Flemmi to give false testimony blaming another agent.⁵

On September 16, 2002, a jury convicted him of racketeering, two counts of obstruction of justice, and making false statements, and acquitted him on one obstruction count. He was sentenced to 121 months in prison and two years of supervised release, and the First Circuit affirmed on appeal.⁵

The 2008 Florida Murder Conviction

While Connolly was serving his federal sentence, Florida moved. A Miami-Dade County grand jury indicted him in 2005 for first-degree murder and conspiracy to commit first-degree murder in Callahan’s killing, alleging that he had met with Bulger, Flemmi, and Martorano in New York or Boston in the weeks before the hit to help plan it.¹¹

The prosecution leaned on Flemmi and Martorano, who between them had admitted to a combined 43 murders.¹² Martorano testified that he shot Callahan after Connolly warned the mobsters that Callahan might cooperate.¹³ Martorano’s own plea deal had let him serve 12 years for 20 admitted murders; he was released in 2007.¹⁴

On November 6, 2008, the jury acquitted Connolly of conspiracy but convicted him of the lesser included offense of second-degree murder with a firearm. Connolly was in Boston, not Florida, when Callahan was shot, but as a principal in the murder scheme his physical absence did not bar conviction. The trial court sentenced him to 40 years in prison, consecutive to his federal sentence.³

Because the killing was in 1982 and the indictment came in 2005, the case survived a statute-of-limitations fight only because Florida’s firearm enhancement reclassified the offense as a life felony with no time limit. A three-judge panel of the Florida Third District Court of Appeal briefly vacated the conviction in May 2014, but the full court sitting en banc reinstated it on July 29, 2015, finding “abundant evidence” that Connolly personally carried a firearm during the offense.¹⁵

Compassionate Release

By 2021, Connolly was 80 and had terminal cancer, including multiple melanomas, along with diabetes. On February 17, 2021, the Florida Commission on Offender Review voted 2-1 to grant him conditional medical release.¹⁶ A commission member said at the time that he had about a year to live. He was released to a South Florida condominium, with a friend, Francis “Franny” Joyce, taking on his medical costs.¹⁷ As of 2026, he is on home confinement in Lynnfield, Massachusetts.¹⁸

The 2026 Motion to Vacate and the Bulger Manuscript

On March 16, 2026, Connolly’s attorney Peter Mullane filed a motion for post-conviction relief in Miami-Dade Circuit Court seeking to vacate the murder conviction.¹ The filing rests on a handwritten, unfinished manuscript by Bulger and FBI reports of statements Bulger made after his 2011 capture in Santa Monica, California. The material had been seized by the FBI but was never turned over to Connolly’s defense.¹⁹

In the manuscript, Bulger described Connolly as “framed” and as a “sacrificial lamb” and pointed to John Morris as his real source inside the FBI’s Boston office. “I am sure everyone close to me thought all the information I had came from (Connolly),” Bulger wrote. “I didn’t discourage that thought — sadly for Connolly, he took the heat for warning me to take off and other things that had come from (Morris).”²⁰ Bulger also called Flemmi and Martorano liars who fabricated testimony for lenient deals.²¹

Connolly’s lawyers learned of the material in 2024, through a letter from Miami-Dade Chief Assistant State Attorney Jose Arrojo describing a sealed envelope labeled “confidential” that held the writings and FBI interview reports.²⁰ That disclosure followed the March 2024 resignation of Michael Von Zamft, the veteran Miami-Dade prosecutor who had led the 2008 trial, after a judge disqualified him from a separate death penalty case, citing a “prosecutorial philosophy of winning at all costs” and evidence of witness testimony manipulation.²²

The motion argues, first, that prosecutors committed a Brady violation by suppressing exculpatory evidence for years.²³ It names Morris as having the “motive, means, and opportunity” to leak information to Bulger and to frame Connolly to protect himself after receiving immunity. It cites Robert Fitzpatrick, the former assistant special agent in charge of the FBI’s Boston office, in arguing that Connolly was “walled-off” from the Callahan matter because he was pursuing a master’s degree at Harvard at the time.¹² And it accuses Von Zamft of “persistent misconduct” in the original prosecution, including coordinating witness testimony and granting favors to jailed witnesses.¹⁸

As of mid-2026, no ruling has been issued. Connolly’s lawyers have asked the court to vacate the conviction and sentence or, in the alternative, to grant a new evidentiary hearing on the suppressed material.¹ The 2002 federal racketeering conviction is not part of the motion and remains in place.
