John Joseph Daly III is a retired U.S. Border Patrol supervisory agent arrested in May 2021 and charged as the suspected East Valley serial rapist, a figure tied to at least eight sexual assaults across Mesa, Gilbert, Chandler, and Bisbee, Arizona, between 1999 and 2001. Federally funded DNA testing broke the case open after more than two decades. He is being prosecuted in both Cochise and Maricopa counties, and his Cochise County trial is set for June 18, 2026.
Who John Daly III Is
Daly joined the U.S. Border Patrol in November 1999, the same window in which the assaults began, and was stationed at the Douglas, Arizona, station near the Mexican border. The Assaults
Between July 1999 and October 2001, investigators identified eight sexual assaults across the East Valley and in Bisbee that they believe were committed by the same person. The attacker entered homes in the early morning hours through unlocked doors or windows, blindfolded the victims, and sexually assaulted them. DNA collected at three of the scenes linked those cases to one another, but no match to a known individual turned up in national databases, and the investigation went cold.3Mesa Police Department. How DNA Identified Him
The cold case was reopened with support from the Sexual Assault Kit Initiative, a U.S. Department of Justice program that funds testing of backlogged rape kits and cold-case investigative work. Using those resources, investigators zeroed in on Daly as a possible suspect in February 2021. A background check showed he had lived near each assault location at the time it happened. The Arrest
Mesa Police, the U.S. Marshals Arizona WANTED Violent Offender Task Force, and other agencies arrested Daly at his Hereford home on May 4, 2021. Authorities seized 279 guns from the residence. Charges in Two Counties
Daly’s initial booking covered three of the eight suspected assaults, with counts of sexual assault, kidnapping, burglary, and sexual abuse. Police said Bisbee would add charges for a 2001 assault in that city, and four other cases needed more investigation before charging decisions.7Boston 25 News. The case then split. A Cochise County grand jury indicted him for the 2001 Bisbee assault. In Maricopa County, he was booked on kidnapping and sex crime counts covering the Mesa and Gilbert cases and set for arraignment.8ABC15. No Bail

Why the Age of the Cases Doesn’t Block Prosecution
Arizona has no statute of limitations for sexual assault charged as a Class 2 felony under Arizona Revised Statute § 13-107. The limitations clock for serious offenses is also tolled during any period when the identity of the person who committed the offense is unknown.9Arizona Legislature. ARS § 13-107 – Time Limitations Because Daly was not identified until 2021, the state kept full authority to prosecute regardless of how much time had passed since the assaults.
Where the Case Stands
The Cochise County case has moved slowly. After a status conference in March, Judge Karwaczka set trial for June 18, 2026. In late April 2026, Daly’s attorneys, Ralph Ellinwood and Michael Terrible, filed a motion to dismiss the sexual assault count in the Cochise indictment, arguing insufficient evidence. At a hearing, Terrible said there was “no proof, no evidence to support the count.” The judge had not ruled on the motion as of the most recent reporting.10The Bisbee Observer.
