John Gotti Jr: Four Mistrials, Dropped Charges, and Life After

John Gotti Jr. is the son of Gambino crime family boss John Gotti and served as acting boss of the family himself during his father’s imprisonment. He pleaded guilty to racketeering in 1999 and served roughly six years in federal prison. He was then tried four more times on racketeering charges between 2005 and 2009; every jury deadlocked, and prosecutors formally dropped the case in January 2010. He has since said he left organized crime behind.

From Capo to Acting Boss

John Angelo Gotti was born to John Gotti and Victoria DiGiorgio. His father took over the Gambino family in 1985 after orchestrating the murder of Paul Castellano outside a Manhattan steakhouse.¹ Junior allegedly rose quickly through the ranks, serving as a capo before taking on a larger role.²

In 1990, FBI agents raided the Ravenite Social Club and arrested John Gotti Sr. along with his underboss, Sammy “The Bull” Gravano. Gravano flipped and became the government’s star witness, and in 1992 the elder Gotti was convicted of racketeering, five murders including the Castellano hit, conspiracy, illegal gambling, loansharking, bribery, obstruction of justice, and tax evasion. He was sentenced to life.¹

With his father locked away, Junior stepped in as acting boss around 1991 and effectively ran the Gambino family’s day-to-day operations through the 1990s.³ He was permitted to visit his father in prison and carried messages to associates outside.⁴ Prosecutors would later describe the enterprise as spanning Florida, New York, New Jersey, and Pennsylvania, involving murder, kidnapping, witness tampering, and money laundering.²

The 1999 Guilty Plea

Federal authorities charged Gotti Jr. with racketeering, extortion, bribery, gambling, and fraud in 1998.³ Facing what prosecutors described as a mountain of evidence, he took a plea. Before Judge Barrington D. Parker Jr. in Federal District Court, he pleaded guilty to racketeering and extortion and was sentenced to six years and five months in prison.⁵ The deal required a $1 million fine, and his sentencing was delayed to give him time to sell real estate and other assets to raise it.⁶

He was released from a federal lockup in Manhattan on September 28, 2005, after serving six years. He posted a $7 million bond and was placed under house arrest at his Long Island home. Two months earlier, a 2004 federal indictment had already landed.⁷

Four Trials, Four Hung Juries

What followed was one of the most unusual runs in modern federal prosecution: four racketeering trials over five years, and four juries that could not agree.

The Charges

The 2004 indictment alleged that Gotti had ordered the 1992 kidnapping and beating of Guardian Angels founder Curtis Sliwa and also charged him with racketeering, extortion of construction companies, and loansharking.⁸ Sliwa had been attacked twice in 1992, beaten with baseball bats in one incident and shot inside a taxi in another, escaping by jumping through the window.⁹

In 2008, federal prosecutors in Tampa expanded the case with conspiracy to commit murder charges tied to three killings: George Grosso in 1988, allegedly murdered in retribution for trying to kill one of Gotti’s drug dealers; Louis DiBono in 1990, found shot seven times in a World Trade Center parking garage, allegedly for failing to answer a summons from Gotti Sr.; and Bruce John Gotterup in 1991, allegedly killed for challenging Gotti’s control of a drug operation.¹⁰¹¹ The indictment also tied Gotti to a Gambino drug ring operating across New York, New Jersey, and Florida.¹² The case was transferred to New York for trial.

The Withdrawal Defense

The defense across all four trials rested on a single claim: Gotti had withdrawn from the Gambino family before July 1999. Under the federal racketeering statute, a five-year statute of limitations applies. If he had severed ties before that date, many of the 2004 charges would be time-barred.¹³

Attorneys Charles Carnesi, Seth Ginsberg, and John Meringolo played recordings of a 1999 prison meeting in which Junior told his father why he wanted out. Radio host and attorney Ron Kuby testified under subpoena that Gotti had approached him in 1998, asking Kuby to tell the government he was “ready to quit the Mafia and wanted to cut a deal.”¹⁴ Gotti’s brother Peter also testified about Junior’s stated desire for an ordinary life.¹³

Prosecutors called the withdrawal claim an “elaborate ruse.” They argued Gotti knew he was being recorded and staged the prison conversations to fabricate a paper trail while remaining active. They also argued he continued to receive money from businesses seeded with crime-tainted funds after 1999.¹⁵ The defense countered that this income came from assets Gotti was legally entitled to keep under his 1999 plea deal.

John Alite on the Stand

The government’s later cases leaned heavily on John Alite, a former Gambino enforcer and Gotti’s onetime best friend who had become a cooperating witness. Alite told jurors that Gotti had been his boss, that they collaborated on killings, and that Gotti once shot a man in the hip with a rifle for mocking the size of his handgun.¹⁶ He described getting manicures with Gotti after the 1988 murder of George Grosso and returning to the scene to verify the death, quoting Gotti as saying of the corpse, “He doesn’t look that good.”¹⁷

The testimony produced courtroom fireworks. During a lunch break, Gotti called Alite a “punk” and a “dog,” and a deputy marshal reported that Gotti mouthed the words “I’ll kill you.” Lead counsel Charles Carnesi hammered Alite’s credibility, arguing that he and other turncoats were fabricating testimony to shave their own sentences. After the final trial, jurors told reporters they had unanimously agreed Alite was the least credible witness they heard. “The whole jury agreed he was the least credible,” one juror said.¹⁶

Trial-by-Trial Outcomes

September 2005 (Trial 1): A six-week trial in Manhattan ended with a hung jury. The vote was 11 to 1 in favor of conviction on the main counts, and jurors voted not guilty on a securities fraud charge.⁸¹²
March 2006 (Trial 2): The retrial also hung. This time the panel largely favored acquittal, with the withdrawal defense gaining traction.¹⁵
September 2006 (Trial 3): U.S. District Judge Shira Scheindlin declared a third mistrial. Jurors indicated they believed Gotti had organized the Sliwa kidnapping but could not agree on all counts.¹²¹⁵
Fall 2009 (Trial 4): With the expanded murder conspiracy charges included, a New York jury deliberated for eleven days before declaring itself hopelessly deadlocked on all counts of racketeering conspiracy and murder. Gotti was released on $2 million bail.¹⁸

Charges Dropped in 2010

On January 8, 2010, the U.S. Attorney’s office in New York filed a notice of nolle prosequi, declining to pursue the case any further. U.S. District Judge Kevin Castel signed the order dismissing it on January 13, 2010.¹⁹ Assistant U.S. Attorney Elie Honig said the decision was based on “all the circumstances.” The case is officially closed and cannot be reopened.

Life After the Trials

Gotti has said he left organized crime behind for good. In his 2015 memoir, Shadow of My Father, he publicly acknowledged for the first time that he had held a leadership role in the Gambino family. “My father was a criminal, as was I,” he wrote, adding that they both “deserved to go to prison.”²⁰ He self-published the book without a ghostwriter, chronicling his withdrawal from the family, describing going “on the shelf for life,” and offering a counter-narrative to Alite’s testimony.²¹ Despite the admissions, no new charges followed.

The Family Since

The Gotti name has kept generating headlines even as Junior has stayed largely out of them. His son, John Gotti III, has pursued professional boxing, with a 2-0 record including one knockout, and drew public attention through exhibition fights with Floyd Mayweather Jr. Their first bout ended in a ring brawl that stopped the match, and a rematch was held in Mexico City in August 2024.²²

Gotti’s wife Kimberly and daughter Gianna were charged with assault in February 2024 following an altercation at a youth basketball game. The charges were dropped on a technicality in October 2024, and a Long Island family filed a $50 million civil lawsuit in February 2025.²³ In July 2024, businesses operated by the family were ordered to pay $210,000 in fines and perform environmental cleanup at a Queens scrap yard over toxic chemical runoff.

Gotti’s grandson Carmine G. Agnello pleaded guilty to COVID-19 relief fraud after prosecutors alleged he obtained $1.1 million in disaster relief funds for a business that was already closed and invested the money in cryptocurrency. He was sentenced on April 20, 2026, to fifteen months in federal prison and ordered to pay more than $1.28 million in restitution.²⁴ Weeks later, Agnello was arrested in Nassau County on domestic assault charges after allegedly attacking his girlfriend at the family’s Long Island home.²⁵

John Alite, the former star witness, reinvented himself as a city councilman in Englishtown, New Jersey. As of June 2026, he was arrested on loansharking charges.²³
