The op-ed ran in The Washington Post on December 18, 2018. It did not name Depp. Depp’s lawyers argued under a theory called “defamation by implication” that readers understood the piece to be about him and that it destroyed his career.3Poynter. - “Then two years ago, I became a public figure representing domestic abuse, and I felt the full force of our culture’s wrath for women who speak out.”
- “I had the rare vantage point of seeing, in real time, how institutions protect men accused of abuse.”
Trial testimony from ACLU chief operating officer Terence Dougherty revealed that ACLU staff had drafted the initial version of the piece and timed publication to coincide with the release of Aquaman, in which Heard starred. Why the Case Was Filed in Virginia
Depp and Heard had lived together in California during their marriage, and Heard’s team argued California was the proper venue. The court disagreed. Depp’s lawyers argued that The Washington Post’s digital publication ran on servers located in Virginia, which gave the state jurisdiction under its long-arm statute.7Syracuse Law Review. Virginia was also friendlier ground for a defamation plaintiff. The state’s anti-SLAPP law lacked meaningful procedures for early dismissal, and Virginia’s summary judgment rules limited how depositions and affidavits could be used, making it harder for a defendant to win before trial.7Syracuse Law Review. The Verdict
The trial began on April 11, 2022, and lasted six weeks. On June 1, 2022, the jury found that each of the three statements was false and made with “actual malice,” meaning Heard either knew the statements were false or acted with reckless disregard for the truth. The jury awarded Depp $10 million in compensatory damages and $5 million in punitive damages. Virginia caps punitive damages at $350,000, and juries are not told about the cap. One juror who spoke publicly afterward said the panel found Heard’s testimony unconvincing, concluded both parties had been abusive to each other but that Heard was “the aggressor,” and said the failure to complete her pledged $7 million charitable donation from the divorce came across as “disingenuous.” The juror said outside material played no role: “We didn’t take into account anything outside [the courtroom]. Heard’s Countersuit
In 2020, Heard filed a $100 million counterclaim alleging that Depp’s attorney Adam Waldman had run a “false and defamatory smear campaign” against her by publicly calling her abuse allegations a “hoax.”12Courthouse News. The UK Ruling and Why It Didn’t Block the Case
Before the Virginia trial, Depp had sued News Group Newspapers in London over a 2018 article in The Sun that called him a “wife beater.” After a 16-day trial in July 2020, Mr. Justice Nicol ruled against Depp on November 2, 2020, finding the characterization “substantially true” and concluding that 12 of 14 alleged incidents of domestic violence had been proved to the civil standard.15BBC. Heard’s attorneys asked the Virginia court to give the UK judgment preclusive effect and end the case. In an August 17, 2021, opinion, Chief Judge Azcarate refused. She found no privity between Heard and The Sun, so collateral estoppel did not apply, and she noted that UK libel law is “starkly different” from Virginia law, including that UK defamation cases are typically decided by a judge alone while Virginia treats the right to a jury trial as “sacred.”17Fairfax County Circuit Court. Post-Verdict Motions and Settlement
Heard moved for a mistrial after discovering that a juror who served may not have been the person originally summoned; the individual reportedly shared the summoned juror’s name and address but had a different birth year. Judge Azcarate denied the motion on July 13, 2022, finding no evidence of prejudice and noting that the juror “was vetted, sat for the entire jury, deliberated, and reached a verdict.”18ABC News. Both sides appealed. Heard’s brief argued Virginia was the wrong forum, that the UK judgment should have been given preclusive effect, that the statements were protected opinion rather than actionable fact, and that the damages were excessive. Depp’s cross-appeal argued he could not be held liable for Waldman’s statements because Waldman was an independent contractor rather than an agent.19Courthouse News. Neither appeal was ever decided on the merits. On December 19, 2022, Heard announced a settlement under which she would pay Depp $1 million. She said she had “lost faith in the American legal system” and could not face a potential retrial, and stated that the settlement was “not an act of concession” and contained “no restrictions or gags” on her future speech.2BBC. Depp pledged to donate the $1 million evenly to five charities, $200,000 each to the Make-A-Film Foundation, the Painted Turtle, Red Feather, the Tetiaroa Society, and the Amazonia Fund Alliance. In 2023, Dior signed Depp to a three-year deal reported at upward of $20 million to continue as the face of its Sauvage fragrance, described as the largest men’s fragrance contract in history.23Variety. The verdict divided legal commentators. Some saw it as a jury credibility call rather than a First Amendment shift; Syracuse University’s Roy Gutterman said the case was about “credibility more than Free Speech.” Others warned it created a template.
