Johnson and Johnson Settlement Check 2021: Bankruptcies Dismissed

No Johnson & Johnson settlement checks went out in 2021. That year, the company moved its entire talc liability into a new subsidiary and put that subsidiary into bankruptcy, which froze the tens of thousands of pending lawsuits and prevented any individual payouts. Courts have since rejected that strategy three times, and as of mid-2026 there is still no global settlement, no trust fund, and no checks for the roughly 67,000 claimants waiting on ovarian cancer and mesothelioma cases.¹

What Happened in 2021

In October 2021, J&J created a new subsidiary called LTL Management and transferred all of its talc-related legal liabilities into it. Two days later, LTL filed for Chapter 11 bankruptcy. The move, sometimes called the “Texas Two-Step,” was designed to pause every talc lawsuit in the country and force claimants into a single court-supervised settlement process instead of individual trials.²

The mechanics: J&J split its consumer subsidiary in two. One piece kept the profitable business. LTL Management got the lawsuits, along with a funding agreement from J&J worth up to $61.5 billion to cover potential payouts.³ No settlement fund was actually established, and no checks were cut. The bankruptcy filing itself was the point: it triggered an automatic stay that halted litigation across the board.

That same $61.5 billion funding backstop is what eventually sank the plan. In January 2023, the Third Circuit Court of Appeals dismissed the bankruptcy, ruling that a subsidiary with guaranteed access to that much parent-company money was not in genuine financial distress, and financial distress is a prerequisite for Chapter 11 protection.³

Three Bankruptcy Filings, Three Dismissals

J&J did not accept the first ruling. It tried the same route two more times, and each attempt kept claimants waiting without payment.

First filing, October 2021: LTL Management’s Chapter 11 petition. Dismissed by the Third Circuit in January 2023 for lack of financial distress.⁴
Second filing, April 2023: LTL refiled in New Jersey with a restructured funding arrangement. Dismissed in July 2023 on similar grounds.⁴
Third filing, September 2024: The liability entity was reincorporated in Texas as Red River Talc LLC, paired with a roughly $9 billion trust proposal spread over 25 years. U.S. Bankruptcy Judge Christopher Lopez rejected the plan and dismissed the case on March 31, 2025.⁵

Judge Lopez’s ruling on the third try was pointed. He found that law firms had cast plan votes on behalf of tens of thousands of clients without direct authorization, that the voting window was “unreasonably short,” and that a last-minute vote switch broke the tabulation rules. He also held that the plan’s attempt to release J&J and retailers like Kenvue from future lawsuits, without the consent of the affected claimants, was not permitted under bankruptcy law.⁶ After that, J&J abandoned the bankruptcy strategy and returned to defending cases individually.⁷

The Settlement Amounts That Were Proposed and Withdrawn

Alongside the second bankruptcy filing in April 2023, J&J announced a proposed $8.9 billion global settlement to be paid into a trust over 25 years. With roughly 60,000 plaintiffs at the time, that worked out to an estimated average of about $330,000 per claimant.⁸⁹ The number was revised down to about $8.2 billion when the plan was refiled through Red River Talc in 2024.¹⁰

Neither version was approved. J&J withdrew the offer after the third bankruptcy dismissal, and the company is not currently pursuing a mass settlement.¹¹ If you were expecting a check tied to any of those proposed figures, it never became real money, because no plan ever received court approval.

Where the Litigation Stands Now

With bankruptcy off the table, the cases are back in regular courts. The federal multidistrict litigation, MDL 2738, is active in the U.S. District Court for the District of New Jersey under Judge Michael A. Shipp, with 67,623 lawsuits pending as of May 2026.¹¹² The first federal bellwether trial, Judkins v. Johnson & Johnson, was selected in July 2025 and remains in pretrial.¹³

Court-ordered mediation is underway. Fouad Kurdi was appointed mediator, Christopher Seeger of Seeger Weiss was appointed Plaintiffs’ Lead Negotiation Counsel in July 2025, and a formal settlement discussion was scheduled for April 13, 2026.¹⁴ Separately, the Philadelphia Court of Common Pleas has opened a mass tort program for ovarian cancer claims, with trials underway in early 2026.¹⁵

Individual verdicts have kept pressure on the company. In December 2025, a Baltimore jury awarded $1.56 billion to Cherie Craft, a woman diagnosed with peritoneal mesothelioma; the award included $59.8 million in compensatory damages and $1.5 billion in punitive damages, and J&J has said it will appeal.¹⁶¹⁷ Other recent awards include $65.5 million in a Minnesota mesothelioma case in December 2025, $42 million in a Boston case in July 2025, and $260 million in an Oregon case in June 2024.⁷ A $966 million Los Angeles verdict in October 2025 was later reduced when a California judge struck the $950 million punitive component in March 2026, leaving a $16 million compensatory award that the family plans to appeal.¹¹

An older case is also still relevant. A 2018 Missouri jury awarded $4.69 billion to 22 women who alleged J&J’s talc caused their ovarian cancer. That award was reduced to $2.1 billion on appeal, the U.S. Supreme Court declined to hear J&J’s challenge in June 2021, and according to reporting J&J paid the $2.12 billion judgment.¹⁸¹⁹

What Individual Claimants Can Expect

Because no global fund exists, the two available paths to compensation are a jury verdict at trial or a private, confidential settlement negotiated between a claimant’s attorney and J&J. The company has reportedly settled 95% of mesothelioma cases privately, with terms kept confidential. Ovarian cancer claims, which make up most of the 67,000-plus pending lawsuits, remain largely unresolved.⁷¹

Industry estimates put a potential future average payout at roughly $500,000 if a global deal is reached, with wide variation by diagnosis.¹⁸ Estimated ranges reported by legal-industry sources:

Ovarian cancer: $100,000 to $500,000
Mesothelioma: $500,000 to $1.4 million or more
Wrongful death: $750,000 to $3 million or more⁹

These are estimates, not offers. Once an individual settlement is finalized, the typical wait for a check runs one to two months, though court backlogs and paperwork can extend that.²⁰ To file, you generally need evidence of regular talc product use, a diagnosis of a linked cancer (ovarian cancer or mesothelioma), and a filing within your state’s statute of limitations, which typically runs one to three years from diagnosis.¹

What the $700 Million State Settlement Does Not Cover

You may have seen news of a $700 million J&J talc settlement announced in June 2024. That is a separate matter. It resolved claims brought by 42 states and the District of Columbia over allegedly deceptive marketing, and the money goes to state governments, not to individual consumers or personal injury claimants.²¹ The consent judgment also permanently bars J&J from manufacturing, selling, or distributing talc-based cosmetic powder products in the United States, but it does nothing for people alleging their cancer was caused by the product.²²
