What Happened in the Breach
On May 31, 2023, Progress Software disclosed a zero-day vulnerability in its MOVEit Transfer file transfer tool. A Russian cybercrime group known as Clop used the flaw to pull data from hundreds of organizations. One of Johnson Financial Group’s vendors used MOVEit, and customer files were exposed in the attack.
JFG later determined the exposed information could include names, email addresses, physical addresses, phone numbers, account numbers, Social Security numbers, dates of birth, driver’s license numbers, and credit and debit card numbers. In September 2023, JFG began sending notification letters to roughly 93,093 people.
Those 93,093 individuals became the class in Schaefer v. Johnson Financial Group, filed in the Circuit Court of Racine County, Wisconsin (Case No. 2023CV001483). The plaintiffs alleged JFG failed to adequately protect their personal information. JFG denied wrongdoing, and no court found the company liable. The parties settled.
What the Settlement Paid
Class members — the people who received a notification letter from JFG in September 2023 — could pick from several benefits:
- Up to $250 for documented ordinary losses, meaning unreimbursed out-of-pocket expenses such as fraud losses, credit monitoring costs, and bank fees.
- Up to $5,000 for documented extraordinary losses, meaning larger unreimbursed monetary losses tied to identity theft or falsified tax returns incurred between May 31, 2023 and July 10, 2025.
- Reimbursement for lost time at $25 per hour, up to three hours, counted against the $250 ordinary loss cap.
- An alternative flat cash payment of up to $45 for anyone who didn’t claim the loss categories, subject to pro rata reduction based on how many people filed.
- Two years of credit monitoring through one bureau, available on top of any cash payment.
The settlement also set aside up to $290,000 for class counsel’s fees and costs and up to $2,500 as a service award for the named plaintiff, Dillon Schaefer, both subject to court approval.
Key Dates and Current Status
The deadline to opt out of or object to the settlement was May 26, 2025. The final fairness hearing took place by Zoom on June 23, 2025. The court granted final approval on June 25, 2025. The claim deadline was July 10, 2025.
