The complaint alleged Caviness streamed the entirety, or nearly all, of the Content Nuke video shortly after its June 2025 release. TEI called the broadcast a “group viewing session” rather than genuine commentary, said Caviness offered only “minimal interjections,” and described her as “visibly intoxicated” during the stream. The company argued the use was not transformative and functioned as a “commercial substitute” for the original, diverting viewership and undermining the video’s market. The suit also named anonymous moderators of the r/H3Snark subreddit as Doe defendants for contributory infringement. The Defense Fundraiser and Rejected Settlement Offer
Caviness initially called the lawsuit “frivolous and based on misogyny,” framing it as targeting women streamers. To pay her lawyers, she opened a GoFundMe that raised roughly $49,000. Streaming fundraisers added about $5,000, bringing the total to approximately $54,000, which she said sat in a separate account earmarked for legal fees.4Primetimer. In September 2025, she offered Klein $17,500 to settle. He rejected it and continued with the case.5Win.gg. How the Case Ended

Caviness disclosed the terms in an eight-minute apology video posted on X. She admitted to copyright infringement and conceded the lawsuit “was not frivolous.” She retracted her earlier misogyny claim, saying she had made it “to garner sympathy and retaliate against the Kleins.” Under the settlement, she agreed to turn over whatever remained from her GoFundMe defense fund to TEI after her own legal fees were paid, and to testify against the anonymous r/H3Snark moderators still named in the case.1Copyright Lately. Klein’s Response
Klein addressed the apology on the 215th episode of the H3 Show. He called it “sincere” and “heartfelt,” told viewers, “I genuinely have forgiven her, I’m moving on, and it’s water under the bridge,” and asked fans to stop directing hostility toward Caviness. What Caviness Said About Hasan Piker
The apology contained a pointed section about Hasan Piker, the streamer whose conduct was the subject of the Content Nuke video. Piker had publicly criticized the lawsuits at the outset, calling them a “pathetic stunt” meant to “manufacture controversy” and accusing Klein of using his resources to “bully other content creators who don’t have a f*k ton of money.”9Times of India. What the Settlement Did and Didn’t Decide
Because Caviness settled and admitted infringement, no court ruled on whether her stream was fair use.
