The U.S. claim form for the Keurig class action is no longer available. The claim period in Smith v. Keurig Green Mountain, Inc. has closed, the court entered final judgment on March 17, 2023, and settlement checks were mailed to approved claimants later that year. If you filed on time, the information below explains what your claim was worth and what to do if your check is sitting uncashed. If you are a Canadian purchaser, a separate claim form is still open through July 8, 2026.
What the U.S. Claim Form Asked For
The form lived at K-CupRecyclingSettlement.com and could also be mailed in on paper. Claimants gave their contact information and reported how many K-Cup pods labeled “recyclable” they had purchased between June 8, 2016 and August 8, 2022. The form then split filers into two documentation tiers.
Filers with proof of purchase attached receipts, credit card statements, or online order histories showing their K-Cup buys. The administrator used those records to verify pod counts. Filers without documentation could still submit a claim by attesting to their purchases on the form itself, and those claims received a flat lower payment.
Eligibility was limited to U.S. purchases for personal, family, or household use. People who bought pods for resale were excluded, along with Keurig affiliates and the attorneys and judges involved in the case.
What Approved Claims Paid
Payments came in two tiers:
- Without proof of purchase: $5.00 per household, based on the attestation alone.
- With proof of purchase: $0.35 for every 10 pods documented, with a $6.00 minimum and a $36.00 maximum per household.
Hitting the $36.00 cap took documentation of roughly 1,029 pods over the six-year class period, or about 170 pods a year. Payments were subject to pro-rata reduction if approved claims exceeded the money available after fees and administrative costs. If Your Check Is Uncashed or Expired
Settlement checks typically expire 90 to 180 days after the date printed on the face. Look at your check for that date first. If it has passed, the settlement administrator may be able to reissue it while funds remain, though reissuance is not guaranteed. Contact information on the check itself, or on the settlement website, is the place to start a reissue request.
Whether the Payment Is Taxable
The IRS treats settlement payments as taxable income unless they compensate for physical injuries or physical sickness.2Internal Revenue Service. Tax Implications of Settlements and Judgments Because this settlement compensated consumers for product labeling rather than physical harm, the payments are technically taxable. Amounts of $5 to $36 sit far below the $2,000 threshold that requires an administrator to issue a Form 1099-MISC, so you are unlikely to receive a tax form. The income is still reportable, but the dollar amounts make it a minor line item at most.
The Canadian Claim Form Is Still Open
A separate Canadian class action covers K-Cup purchasers in Canada and is accepting claims until July 8, 2026.
