Kim Soo-hyun’s AI Lawsuit: Fabricated Audio, Kim Se-ui Charges

The Kim Soo-hyun AI lawsuit centers on YouTuber Kim Se-ui, who was arrested in May 2026 on charges of defaming the South Korean actor with AI-cloned audio and doctored messaging screenshots that falsely portrayed him as having dated the late actress Kim Sae-ron while she was a minor. Police concluded the evidence was fabricated for YouTube revenue, and litigation is now moving in two directions: Kim Soo-hyun is pursuing damages against Kim Se-ui and Kim Sae-ron’s family, while several brands that dropped him during the scandal are suing to recover endorsement losses.

What the Fabricated Evidence Was

Kim Se-ui runs HoverLab, also known as the Garo Sero Institute, a Korean commentary channel with nearly one million subscribers.¹²³

At a press conference, Kim Se-ui presented two pieces of evidence: an audio recording said to feature Kim Sae-ron discussing the relationship, and screenshots of KakaoTalk conversations purportedly between her and the actor.⁴ Police later concluded both were manufactured. The audio was generated with AI voice technology. The KakaoTalk screenshots had been altered from conversations involving unrelated third parties, with the interlocutor’s name simply changed to “Kim Soo-hyun.”⁵ Investigators identified the motive as financial: ad revenue from the videos.

Kim Soo-hyun acknowledged at a March 31, 2025 press conference that he had dated Kim Sae-ron, but only after she reached adulthood, from roughly the summer of 2019 to the following spring. Metadata from photos on his iPad, submitted to investigators, placed a disputed photograph of the couple as taken between February 18 and 23, 2020, when she was already an adult.⁶

The Forensic Dispute Over the Audio

The audio’s authenticity became the technical flashpoint. Police referred the file to South Korea’s National Forensic Service in August 2025. In November 2025, the NFS returned an “undetermined” conclusion on whether the recording had been AI-manipulated, citing technical limitations because the submitted file was not the original and contained significant noise.⁷

Police then commissioned a private analysis, though the firm has not been named publicly.⁷ Kim Se-ui built part of his defense around the NFS finding, arguing that the national agency’s inability to confirm AI use undermined the charges and that police were improperly leaning on a private assessment instead.⁴ Kim Soo-hyun’s attorney, Ko Sang-rok of Law Firm Pil, responded that an inconclusive result does not make the recording genuine, and noted that Kim Se-ui’s side never submitted the original files for verification.⁸ Ko also said the informant behind the recordings had produced “multiple versions of patched-together audio recordings” containing errors and inconsistencies.⁹

The Criminal Charges Against Kim Se-ui

Seoul’s Gangnam Police Station submitted an arrest warrant request on May 21, 2026. Judge Boo Dong-sik of the Seoul Central District Court approved it on May 26, 2026, citing risks of evidence destruction and flight.⁴⁵ Kim Se-ui was taken into custody and referred to prosecutors on June 4, 2026.¹⁰

The charges span several statutes:

Defamation through false information, under both the Criminal Act and the Act on Promotion of Information and Communications Network Utilization and Information Protection.
Stalking, under the Act on Special Cases Concerning the Punishment of Stalking Crimes.
Distribution of illegally recorded material and coercion involving such material, under the Act on Special Cases Concerning the Punishment of Sexual Crimes.
Attempted coercion and intimidation.

These were confirmed by Kim Soo-hyun’s agency after the arrest.¹¹

Kim Se-ui denies the charges. He called the arrest warrant “forced and unreasonable” and characterized the KakaoTalk messages as “reconstructed” rather than fabricated, saying he had notified viewers in advance.¹² He said he would file complaints against the investigators.¹

Kim Soo-hyun’s Civil Damages Claim

On March 31, 2025, Kim Soo-hyun filed a civil suit seeking 12 billion won, roughly $8.7 million, against Kim Se-ui and Kim Sae-ron’s bereaved family.¹³ By May 2026, his legal team signaled the figure could rise to approximately 30 billion won, about $21.9 million, citing confirmed economic losses well beyond the original estimate.¹⁴ Attorney Ko has also indicated the team is weighing “adjusting the scope of defendants” beyond the original parties.⁹

Police described the harm bluntly in a filing, saying the YouTuber’s claims “collapsed Kim Soo-hyun’s social base and his economic activities across the board, and destroyed the basis for his professional survival.”¹⁵ Endorsements were terminated, fan events canceled, and the actor has made no public appearances since March 2025.¹⁶

Brand Suits Against Kim Soo-hyun

Several companies that had endorsement deals with the actor filed their own damages claims after the controversy broke, seeking a combined total of roughly 10 billion won.¹⁷ Two are furthest along.

An unidentified cosmetics brand, referred to in filings as “Company A,” is seeking 2.8 billion won (about $1.8 million) from Kim Soo-hyun and his agency, Gold Medalist, arguing that the scandal made it impossible to maintain a contract that had been set to run through August 2025. The Seoul Central District Court’s 22nd Civil Division has scheduled a third hearing for July 3, 2026.¹⁸

PromBio, a health functional food company also referred to as FromBio, is seeking 3.96 billion won from Kim Soo-hyun and Gold Medalist. A third hearing was held on June 10, 2026, at the Suwon District Court, where the judge asked the plaintiff to submit organized evidence on the alleged “violations of maintaining dignity.”¹⁹

Both cases stalled while police worked on the criminal file. The cosmetics case sat dormant between its second hearing in March 2026 and its July resumption. The PromBio case went roughly eight months between hearings.¹⁷ Courts have acknowledged that the criminal outcome could shape the civil rulings, because the core question in the brand suits is whether Kim Soo-hyun breached a duty to maintain his public image, and the allegations underlying that breach are now being treated as fabricated.²⁰

How Korean Law Treats AI Fabrication and Defamation

South Korea is one of the few democracies where truth is not an absolute defense against defamation. Both the Criminal Act and the Act on Promotion of Information and Communications Network Utilization and Information Protection impose criminal penalties for publicly stating facts about another person, even true ones, unless the disclosure serves the public interest.²¹ For online defamation using false information, the penalty reaches up to seven years in prison or a fine of up to 50 million won.²

On the AI side, South Korea passed its Basic Act on the Development of Artificial Intelligence in December 2024, which took effect in January 2026. It sets up a risk-based framework, mandates labeling for generative AI outputs, and creates oversight bodies, though critics say it lacks strong enforcement tools for the sort of deepfake misuse at issue here.²² A September 2024 amendment to the Act on Special Cases Concerning the Punishment of Sexual Crimes criminalized sexually explicit deepfakes, carrying penalties of up to seven years for creation or distribution.²³

Where Things Stand

On May 27, 2026, Gold Medalist released a statement declaring that “the truth has been proven,” confirming that the KakaoTalk conversations were “fabricated and altered from conversations involving unrelated third parties” and that the voice recordings were “confirmed to be manipulated materials generated using AI technology.”²⁴

Kim Se-ui remains in custody following his June 4, 2026 referral to prosecutors. No trial date has been publicly announced.¹⁰ Kim Soo-hyun’s damages lawsuit against him and Kim Sae-ron’s family is active, with the possible expansion to 30 billion won under review. The cosmetics and PromBio suits against the actor are proceeding through summer hearings. Despite being cleared of the underlying allegations, Kim Soo-hyun has not returned to public life or confirmed new projects.²⁵
