Kroger FTA Data Breach Claim Form: Status, Eligibility, and Options

The Kroger data breach claim form is no longer being accepted. The filing deadline was March 5, 2022, and the $5 million class action settlement has closed to new submissions. If you filed before the deadline and want an update, contact the settlement administrator at 866-790-4318 or check KrogerFTADataBreachSettlement.com.

Where Things Stand Now

The claim period is over. There is no late-filing option, and no legitimate way to submit a form after the March 2022 cutoff. The settlement administrator is the only reliable source for payment updates on claims that were filed on time. Be cautious of anyone who contacts you claiming funds are still available: scammers routinely impersonate settlement administrators after high-profile breaches, and a real administrator will never ask you to pay a fee to release your money.

What the Claim Form Offered Filers

Class members could pick one of three types of relief on the form. Only one choice per person.

  • A pro-rata cash payment from the settlement fund after costs and higher-tier claims were paid. No documentation was needed; the per-person amount depended on how many people filed.
  • Two years of three-bureau credit monitoring with a dedicated fraud resolution agent and up to $1 million in identity theft insurance. The retail value of the package was estimated at roughly $360.
  • Reimbursement of up to $5,000 for documented losses. Qualifying expenses had to be unreimbursed, tied to identity theft or fraud occurring on or after December 16, 2020, and reasonably traceable to the breach. Examples the settlement listed included credit card cancellation fees, overdraft charges, declined-payment fees, and the cost of purchasing credit reports. Bank statements, credit reports showing unauthorized activity, or receipts had to be attached.

Every submission required a signed declaration under penalty of perjury. Documented-loss claims carried the highest evidentiary bar, and the administrator could reject paperwork that didn’t clearly link the financial harm to the Accellion incident.

Online filers submitted through a secure portal at the settlement website, which generated a confirmation code needed for any later status inquiry. Paper claims had to be postmarked by March 5, 2022, and mailed to the administrator in Portland, Oregon.

Who Was Covered

The class included anyone in the United States whose personal information was compromised through the Accellion File Transfer Appliance breach between December 2020 and January 2021. That covered both customers and employees of Kroger and its subsidiary banners, including Ralphs, Fred Meyer, Smith’s, King Soopers, Fry’s, Dillons, QFC, Food 4 Less, and others under the Kroger family of companies.1Kroger. Kroger Family of Companies Three categories of data were exposed: employee HR records, pharmacy records, and money services records. Pharmacy files were the most sensitive, sometimes containing names, addresses, prescription details, health plan information, and Social Security numbers.

Most class members received a mailed or emailed notice with a unique settlement ID. People who believed they were affected but never got a notice could verify their status through the settlement website’s database.

What to Do If You Missed the Deadline

You cannot recover money from this settlement if you did not file in time. You can still protect yourself from downstream fraud tied to the exposed data:

  • Place a free security freeze on your credit files with Equifax, Experian, and TransUnion. A freeze blocks new accounts from being opened in your name without your authorization.
  • Pull your credit reports from all three bureaus for free through AnnualCreditReport.com and review them for accounts or inquiries you don’t recognize.
  • If you find fraudulent activity, file a report at IdentityTheft.gov. The site builds a personalized recovery plan and generates pre-filled dispute letters.

If you did file on time and have questions about where your claim stands, call the administrator at 866-790-4318. Payment distribution typically runs several months after a final approval hearing as the administrator verifies submissions, so delays between filing and payment are normal.
