Former Detroit mayor Kwame Kilpatrick has not received a pardon from President Donald Trump. What he received, on January 19, 2021, was a commutation — an order that ended his 28-year federal prison sentence but left his 24 felony convictions, his supervised release, and his restitution debt fully in place. Kilpatrick has since said publicly that Trump promised him a full pardon during a meeting at Mar-a-Lago, and that the promise is what drove him to campaign for Trump in 2024. As of mid-2026, that pardon has not come.
Commutation Is Not a Pardon
The two forms of clemency do very different things. A commutation shortens or ends a prison sentence. A pardon forgives the underlying crime. Kilpatrick got the first, not the second, so the 24 counts he was convicted of in March 2013 — racketeering conspiracy, extortion, bribery, mail fraud, and tax violations — remain on his record.1U.S. Department of Justice. Three consequences of the commutation-versus-pardon distinction matter for Kilpatrick.
First, restitution. A president can affirmatively discharge a restitution obligation through clemency, but only if the clemency order says so explicitly. A commutation that is silent on restitution leaves it intact.2Congressional Research Service. Second, the office ban. In 2010, Michigan voters approved a constitutional amendment — informally called the “Kwame Amendment” — barring anyone convicted of certain felonies from holding state or local elected or appointed office involving policymaking or public assets for 20 years after conviction.5MLive. Third, the record itself. Kilpatrick is still a convicted felon. U.S. Attorney Matthew Schneider made the point publicly at the time of the commutation, calling Kilpatrick a “notorious and unrepentant criminal” who remained convicted on all 24 counts and remained barred from office under state law.7WXYZ Detroit. The Alleged Pardon Promise
Kilpatrick has said Trump promised him a full pardon within the first month of a second term during a meeting at Mar-a-Lago. He told Bridge Michigan in 2025 that the promise is why he campaigned for Trump in the 2024 cycle. “I told him that I’d go to work, and I did,” he said.6Deadline Detroit. By his own account, that work included speaking at events in Detroit, Philadelphia, and Georgia; recording a September 2024 pro-Trump radio ad for the Michigan Republican Party that also aired in Pennsylvania and Atlanta; helping arrange campaign events in Detroit; joining a Philadelphia bus tour; and speaking at an Oakland County Republican Party fundraiser.8Bridge Michigan. After Trump’s first month back in office passed without action, Kilpatrick left a voicemail for Michigan state Representative Karen Whitsett — the Detroit Democrat who had lobbied Trump for the 2021 commutation — saying a pardon “would cure everything” and asking her to press his case. Kilpatrick confirmed the substance of the voicemail to Bridge Michigan but denied his campaign work was a quid pro quo. Whitsett said she had spoken with Trump since but indicated a Kilpatrick pardon was not among her current priorities. The Restitution That Keeps Adding Up
Because the commutation preserved the restitution order, that debt is the live legal issue in Kilpatrick’s life while the pardon question sits unresolved. He was originally ordered to pay more than $1.7 million. As of early 2026, the outstanding balance was $823,649.09.9Click On Detroit. On February 2, 2026, U.S. District Judge Nancy Edmunds — the same judge who sentenced him in 2013 — denied Kilpatrick’s motions to modify or terminate the restitution and to stop garnishment of his income. An amended judgment confirmed the $823,649 balance and approved a sealed stipulated payment plan that subjects his pension and other income to garnishment.9Click On Detroit. Collection has moved beyond wages and pension. In 2022, federal prosecutors tried to seize nearly $200,000 from an online fundraising account tied to Kilpatrick and his wife, but the account had been closed and the funds withdrawn first.10WXYZ Detroit. Prosecutors argued Pathfinder was a “nominee” entity and that the money belonged to Kilpatrick; he lacked standing to challenge the seizure because neither Pathfinder nor its resident agent, his wife LaTicia Kilpatrick, objected. Prosecutors have also placed a lien on the Novi home, which owed $44,519 in unpaid property taxes and faced potential foreclosure. Kilpatrick has called the collection effort “unjustified, selective and deeply concerning” and said he cannot cover basic living expenses; prosecutors countered that he has been receiving significant income, soliciting donations, and acquiring luxury vehicles.11Detroit News. A pardon that expressly extinguished the restitution obligation would end all of this. A pardon that did not address restitution would not.
What Kilpatrick Was Convicted Of
The record a pardon would erase is a federal public-corruption record built over years of investigation. The FBI opened its inquiry as early as 2004 and uncovered a pay-to-play scheme in which Detroit city contracts were steered to allies in exchange for cash and other benefits. Investigators identified more than $840,000 in unexplained expenditures and deposits that Kilpatrick never reported on his tax returns.12FBI. Public Corruption: Inside the Kwame Kilpatrick Case
A federal grand jury indicted him in 2010 on mail fraud, wire fraud, and tax evasion charges. After a five-month trial before Judge Edmunds in the Eastern District of Michigan, a jury convicted him in March 2013 on 24 counts. In October 2013, Edmunds imposed a 28-year sentence — one of the longest corruption sentences ever given to a public official.12FBI. The 2021 commutation, granted on the final full day of Trump’s first presidency, cut short a sentence that had roughly two decades left to run. The White House statement called the move “strongly supported by prominent members of the Detroit community” and noted that Kilpatrick had taught public speaking classes and led Bible study groups in prison.14Michigan Advance. A pardon has not followed. Until one does, Kilpatrick’s convictions stand, his restitution is being collected, and Michigan’s constitutional bar on his return to state or local office runs until 2033.
