LeeAnn Fletcher Case: Autopsy, Indictment, and Tolson’s Plea

The LeeAnn Fletcher case ended in August 2023 when John “Jay” Curtis Tolson pleaded guilty to voluntary manslaughter in the death of his girlfriend, an Outer Banks mother of two who died in July 2020 after Tolson told a 911 dispatcher she had fallen in the bathtub. He was sentenced to 56 to 80 months in state prison. The case only reached that point because Fletcher’s family, convinced police had dismissed a homicide as an accident, hired their own investigator and ran a public campaign that pushed prosecutors to act.¹

The 911 Call and What Paramedics Found

The last person known to speak with Amanda LeeAnn Fletcher Hartleben, 38, was contacted between 4:30 and 5:00 p.m. on Monday, July 20, 2020. She had just started packing up Tolson’s belongings to move him out of her Kitty Hawk home.²

Two days later, on July 22, Tolson called 911. “My friend is laying in the tub and she won’t wake up,” he told the dispatcher. “I think she fell last night.”³

Paramedics found Fletcher in a dry bathtub. There was no sign she had been bathing or showering. Her head was swollen, her jaw clenched, her skin and the whites of her eyes yellow with jaundice.⁴ She was airlifted to Sentara Norfolk General Hospital in Norfolk, Virginia, and died there on July 25, 2020.⁵

What the Autopsy Showed

Dr. Nicole Masian performed the autopsy on July 28, 2020, at the Office of the Chief Medical Examiner in Norfolk. She listed the cause of death as “complications of blunt force trauma to the head with hepatic cirrhosis with clinical hepatic failure contributing.” The manner of death was ruled “undetermined.”⁶

The findings did not describe a simple slip. Masian documented a large subdural hematoma caused by significant force, along with injuries to both forearms and the backs of both hands consistent with defending against an attack. Fletcher had multiple bruises on her inner right thigh, a large bruise on her buttocks, and wounds on her knees and lower legs. Masian later testified that these injuries were “not consistent with medical interventions.” Toxicology found no drugs or alcohol in Fletcher’s system.¹

Why the Family Had to Push for an Investigation

When paramedics arrived, the call had been logged as a fall. Fletcher’s cousin, Trisha Cahoon, said police officers did not even enter the house.³ The family said they were told Fletcher had been intoxicated, fallen, and hit her head, and that “there was no crime committed.”⁵

In September 2020, the family hired a private investigator. Together with Cahoon, the investigator entered Fletcher’s home and found blood stains, some visible to the naked eye and others revealed by a chemical agent, on doors, walls, and a mattress in several rooms. Cahoon said the bedroom looked “like a massacre with blood everywhere.” A blood-stained shirt collected at the scene was turned over to police on July 31, 2020.⁵ The investigator concluded that the pattern of blood “doesn’t support a fall in the bathtub.”²

Cahoon and other relatives took the case public under the hashtag #JusticeForLeeAnn. A Facebook page drew thousands of followers, a banner with the hashtag was flown over a beach, and a “Coffee and Crime Time” podcast episode pulled in hundreds of thousands of views. People, Court TV, and 48 Hours picked up the story. At a Kitty Hawk city council meeting, speakers criticized the police chief and district attorney by name.⁷

Indictment and Arrest

On October 26, 2020, a Dare County grand jury indicted Tolson on one count of second-degree murder. He was arrested that day by the Bangor Police Department in Maine and held at the Dare County Detention Center on a $1 million secured bond.³⁶ He pleaded not guilty.

The indictment came even though the Virginia medical examiner’s ruling on manner of death remained “undetermined.” No reporting indicates that ruling was ever formally changed. The grand jury relied on the blunt force trauma finding, the private investigator’s blood evidence, and the pattern of Fletcher’s injuries.²

What Came Out at Trial

Trial opened on August 28, 2023, in Dare County Superior Court before Judge Jeff Foster. The defense had asked to waive the jury, arguing the family’s campaign had made an impartial jury “difficult to impossible” to seat. Foster denied the motion but issued a gag order barring Fletcher’s family from giving media interviews during the trial. “We’re not going to have anything disrupt this trial,” he said. “It’s going to be a fair trial provided for this defendant.”⁷

Prosecutors built a timeline placing Fletcher’s injury on July 20, two days before Tolson’s 911 call. The most striking evidence was digital: on July 21, Tolson used his phone to Google “how bad are concussions” and “what if someone won’t wake up from a concussion.”⁸ The state also pointed to what it called inconsistent statements from Tolson, including an admission that he and Fletcher had been in a “tussle,” and to the fact that he never visited her in the ICU.⁹

The state’s case had weak seams. Witnesses testified that no visible head wounds were found on Fletcher’s body and that no blood was in the bathtub where she was discovered. Public Defender Christan Routten argued that police had never properly secured the home as a crime scene and that there was no definitive proof a crime had occurred.¹⁰

The Plea Deal and Sentence

On August 31, 2023, four days into trial and after 11 of the state’s 19 planned witnesses had testified, Tolson accepted a plea. He pleaded guilty to voluntary manslaughter, a Class D felony, and the second-degree murder charge was dropped.¹

Routten said the defense had been preparing to call a forensic pathologist and a forensic neuropathologist to testify that Fletcher’s brain injury “did not match the actual presentation” prosecutors described. The case would have come down to which experts the jury believed, and Tolson, Routten said, was not willing to put “his fate in the hands of 12 strangers.”¹⁰

District Attorney Jeff Cruden said the state would not have accepted the deal “if the family wasn’t 100 percent behind it,” and acknowledged that trial testimony sometimes “don’t go the way you think they’re going to go.”¹⁰

Judge Foster sentenced Tolson to 56 to 80 months in state custody, with credit for time served since his October 28, 2020 arrest, roughly three years. That left him with two to four additional years to serve. Foster also ordered no contact with Fletcher’s family, required Tolson to pay court costs to reimburse the state for his court-appointed attorneys, and recommended substance-dependency counseling in prison.¹

Trisha Cahoon spoke at sentencing. “If Jay had given or actually sought medical help for LeeAnn, we would not be here today,” she said. “He did everything he could to clean up and hide what had happened.” A nurse herself, Cahoon said she could not comprehend watching someone struggle to breathe and doing nothing. Given the chance to speak, Tolson said only, “I pray for peace.”¹⁰

Where Tolson Is Now

Tolson was held at Pender Correctional Institution, where records show he was cited for several infractions, including involvement in a fight.¹¹ The North Carolina Department of Adult Correction listed his projected release date as May 31, 2025, at age 33.¹²

Who LeeAnn Fletcher Was

Amanda LeeAnn Fletcher Hartleben was born July 28, 1981, and grew up in Dare County. She lived in a cottage in Kitty Hawk and was raising two children, ages five and fourteen at the time of her death. A third child had predeceased her. Friends described her as an avid hunter and surf fisher who loved baking, gardening, and Christmas decorating, and called her “Martha Stewart” for it.¹³¹⁴
