The legal age of consent in Pakistan is 16, set by Section 375 of the Pakistan Penal Code. Any sexual act with a person under 16 is rape under the statute, whether or not the younger person appeared to agree, and the penalty when the victim is a minor is death or life imprisonment. The rule applies to males, females, and transgender persons alike after a 2021 overhaul of the law.
Age of Consent Under Section 375
Section 375 is the controlling statute. As amended by the Criminal Law (Amendment) Act 2021, it uses gender-neutral language: “person A” commits rape against “person B” when one of several conditions is met. The sixth condition covers intercourse with a person under 16, with or without that person’s consent. The prosecution does not have to prove force, threat, or deception. Proving the younger person’s age at the time of the act is enough.1pakistani.org. Pakistan Penal Code (Act XLV of 1860)
Explanation 3 of the section defines “person” as male, female, or transgender. Before 2021, the statute framed rape as an act by a man against a woman, which left male and transgender victims outside its protection. The current version removes that limitation.1pakistani.org. Pakistan Penal Code (Act XLV of 1860)
The definition of the act was also broadened. Section 375 now covers penetration of any bodily orifice by a body part or object, as well as oral contact with genitalia. Good-faith medical procedures are expressly excluded.1pakistani.org. Pakistan Penal Code (Act XLV of 1860)
Penalties When the Victim Is a Minor
Section 376 of the Penal Code sets the sentencing framework. A standard rape conviction carries imprisonment of not less than 10 years and up to 25 years, or imprisonment for the remainder of the offender’s natural life, plus a fine. The death penalty is available at the court’s discretion.1pakistani.org. Pakistan Penal Code (Act XLV of 1860)
When the victim is a minor or a person with a disability, the sentencing floor disappears. The punishment is death or life imprisonment, plus a fine. Courts do not have the option of a shorter term. The same elevated range applies to gang rape under Section 375A and to rape committed by a public servant exploiting their position.1pakistani.org. Pakistan Penal Code (Act XLV of 1860)
The practical effect is that offenses against children sit at the top of the sentencing scale from the outset. A judge convicting a defendant of raping a minor cannot impose a 10-year term even in a case the judge might otherwise view as less aggravated.
Marriage Age Is Separate From Consent Age
The age at which a person can marry is governed by a different statute and uses different numbers. The Child Marriage Restraint Act of 1929 sets federal minimum marriage ages at 16 for females and 18 for males. Performing, arranging, or facilitating a marriage below those ages is a criminal offense, with potential imprisonment and fines for parents, guardians, and the person who solemnizes the ceremony.2Refworld. Pakistan Act No. XIX of 1929, Child Marriage Restraint Act
A counterintuitive feature of this law is that a marriage conducted below the legal age is still treated as a valid union. Courts have held that the Act punishes those who arrange or participate in underage marriages without rendering the marriage itself void. A girl married at 15 is legally married, even though the adults who arranged it committed a crime.
Courts have also recognized that a Muslim girl who has reached puberty and freely consents may be able to contract a marriage under Islamic personal law, even if she is under 16. That creates tension with the flat 16-year age of consent in the Penal Code: the same act could be lawful within a recognized marriage and criminal under Section 375. Outcomes depend on which framework a judge applies.
Provincial Variations
Sindh raised its minimum marriage age to 18 for both men and women through the Sindh Child Marriage Restraint Act of 2013. The implementing rules require anyone performing a marriage to verify both parties are at least 18 and to provide a signed affidavit confirming their ages. Police officers who refuse to register a complaint about a child marriage can themselves face prosecution.3Sindh Judicial Academy. Sindh Child Marriages Restraint Rules, 2016
Punjab passed the Child Marriage Restraint (Amendment) Act in 2015, which increased the penalty for facilitating child marriages. A marriage treated as legal in one province can trigger criminal liability in another, so local rules matter.
The Hudood Ordinance Complication
The Offence of Zina (Enforcement of Hudood) Ordinance of 1979 runs parallel to the Penal Code and uses a different concept of adulthood. The ordinance defines “adult” as a male who has reached 18, a female who has reached 16, or anyone who has attained puberty, whichever comes first.4pakistani.org. The Offence of Zina (Enforcement of Hudood) Ordinance, 1979
That puberty clause is where the two frameworks collide. A 14-year-old who has reached puberty could be treated as an adult under the ordinance, meaning they could face criminal liability for extramarital sexual activity, while remaining a child victim under Section 375. The two statutes point in opposite directions for the same person.
The Protection of Women (Criminal Laws Amendment) Act of 2006 narrowed the overlap by moving rape prosecutions back under the Penal Code. Before 2006, rape allegations could be recharacterized as zina, which sometimes resulted in victims being punished for their own assault. The 2006 Act separated the two offenses, though the Hudood Ordinance remains on the books for consensual extramarital relations.
How Cases Are Investigated and Tried After 2021
The Anti-Rape (Investigation and Trial) Act of 2021 restructured the response to sexual offenses. Anti-Rape Crisis Cells now coordinate the immediate response when a sexual offense is reported, handling medical examinations, forensic evidence collection, and coordination with police to ensure a First Information Report is registered. All of these steps must happen “without any delay,” and the law does not require a particular order, so evidence collection can begin before the FIR is formally filed.5Sindh Judicial Academy. Anti-Rape (Investigation and Trial) Act, 2021
Designated special courts hear these cases. Judges must have Sessions Judge experience or 10 years as a High Court advocate. Once a court takes cognizance of a case, it should decide the matter “preferably within four months.” No more than two adjournments are permitted during trial, and one of them requires the requesting party to pay costs. Appeals go to a High Court division bench, which is expected to decide within six months.5Sindh Judicial Academy. Anti-Rape (Investigation and Trial) Act, 2021
The deadlines are aspirational rather than hard, but they mark a departure from a system where sexual assault trials routinely stretched on for years. The Act also directs NADRA to maintain a national registry of convicted sex offenders, though implementation has been slow.
Victim Protections
An FIR can be lodged orally or in writing, by the victim or by a third party, and even by a minor. No preliminary investigation is required before the police register the complaint. Punjab and Khyber Pakhtunkhwa offer online FIR portals.6Immigration and Refugee Board of Canada. Pakistan: First Information Reports (FIRs), Including Procedures
The 2021 Act added further protections. Disclosing a victim’s identity is prohibited and trials are closed to the public. Victims are entitled to free legal representation through the Legal Aid and Justice Authority. The two-finger virginity test is explicitly banned; the Supreme Court of Pakistan had already declared the practice unconstitutional in 2021, finding it violated Article 4(2)(a). Medical examinations must now focus on whether an assault occurred, not on a survivor’s sexual history. Courts can order convicted offenders to pay compensation to victims on top of the criminal sentence.
The gap between these protections and their day-to-day enforcement is wide. Police refusal to register FIRs for sexual offenses is documented, which is one reason the 2021 Act created crisis cells as an alternative entry point. A victim turned away at a station can go directly to a cell, which then coordinates with law enforcement.
Which Rule Governs When They Conflict
The practical answer for anyone trying to understand their rights or obligations is straightforward. The age of consent under criminal law is 16, and that number applies regardless of gender, marital status, or province. Marriage below the legal age is a separate offense with its own penalties, but an underage marriage is not automatically void. Courts resolve conflicts between the Penal Code, Hudood Ordinance, and personal law case by case, and the outcome often turns on which framework a judge applies. When uncertain, the safest assumption is that the 16-year threshold in Section 375 governs.
