Lendmark Financial Class Action Lawsuit: Crumpton and Parker Cases

Lendmark Financial Services has faced two notable class action lawsuits: a 2016 federal case in Alabama accusing the consumer lender of using autodialers to place unwanted collection calls to borrowers’ cell phones in violation of the Telephone Consumer Protection Act, and a California case brought by a former employee alleging wage and hour violations. Neither case has produced a published settlement or final judgment in the available record.

The Alabama TCPA Case: Crumpton v. Lendmark

Gloria Crumpton and Lecretia Crumpton filed Crumpton et al. v. Lendmark Financial Services, LLC on November 28, 2016, in the United States District Court for the Northern District of Alabama (Case No. 7:16-cv-01902-JHE).1ClassAction.org. Crumpton v. Lendmark Financial Services Class Action Complaint

The complaint alleged that Lendmark used automatic telephone dialing systems and predictive dialers to place non-emergency calls to consumers’ cell phones without prior express consent. According to the plaintiffs, the company ran contact centers staffed by collections supervisors and equipped with inbound-outbound autodialers aimed at borrowers with delinquent accounts.1ClassAction.org. One plaintiff said she received roughly 100 calls and about 70 voicemails on her cell phone over four months between July and October 2016. The calls continued, she alleged, even after she sent Lendmark a written stop-contact request on September 9, 2016.2ClassAction.org. The Two Proposed Classes

The suit sought certification of two nationwide classes covering the four years before filing:

  • A revocation class of people who received autodialed calls on their cell phones after asking Lendmark to stop.
  • A lack-of-consent class of people who received autodialed calls on their cell phones despite never having given the company their number.

The plaintiffs asked for an injunction against the calling practices, statutory damages under the TCPA at $500 per violation and $1,500 for willful violations, and attorneys’ fees.1ClassAction.org. The California Employee Case: Parker v. Lendmark

Former Lendmark employee Heather Parker filed a class action in California alleging eight wage and hour violations: missed meal and rest breaks, unpaid overtime and minimum wages, inaccurate wage statements, failure to provide personnel records, waiting-time penalties, and unfair competition.3Midpage. Lendmark tried to move the case to federal court under the Class Action Fairness Act, arguing the amount in controversy topped $5 million. In October 2024 a federal judge rejected that argument, finding Lendmark’s damage estimates were “speculative, based on unsupported violation rates,” and remanded the case to California state court.3Midpage. Court records show the case remained open in Los Angeles County Superior Court through late 2025. It has since been reclassified under the Private Attorneys General Act, with a hearing on a potential dismissal due to settlement scheduled for February 2026.4UniCourt. Parker v. Individual Suits and Complaints, Not Class Actions

Several other legal disputes involving Lendmark appear in public reporting but are individual lawsuits or consumer complaints rather than class actions. They are worth distinguishing so borrowers with similar issues understand what has and has not been brought as a class case.

One borrower sued Lendmark under the Fair Credit Reporting Act, alleging the company kept reporting a $3,000 past-due balance to Experian after the debt had been discharged in bankruptcy and “willfully ignored” requests to investigate.5Carolina Law. What to Know About Lendmark Financial Services

A Florida lawsuit alleged Lendmark repeatedly refused a borrower’s written requests to cap the annual interest rate on their loan at 6%, a protection the Servicemembers Civil Relief Act extends to active-duty military members.5Carolina Law. What to Know About Lendmark Financial Services

Consumer complaints also describe high-cost loans and disputed charges. One borrower reported that a $5,000 loan carried a roughly $14,000 total repayment obligation. Another described a 23.99% APR on a $7,800 auto loan, with the balance climbing above $11,500 despite on-time payments. Borrowers have said nearly all of each monthly payment went to interest rather than principal. Some have alleged that branches added unauthorized insurance fees to loan paperwork or falsely claimed their auto insurance had lapsed.6WalletHub. Lendmark Financial Services Reviews
