Luigi Nicholas Mangione: Charges, Death Penalty Ruling, and Trial

Luigi Mangione is a 26-year-old charged in the December 4, 2024 shooting of UnitedHealthcare CEO Brian Thompson outside a Midtown Manhattan hotel, and the Luigi Mangione murder case is now proceeding on two tracks: a New York state prosecution for second-degree murder and related counts, and a federal prosecution for interstate stalking resulting in death. Pretrial rulings have narrowed both cases. A state judge threw out the terrorism-enhanced murder charges, and a federal judge dismissed the capital murder count, eliminating the death penalty. Mangione has pleaded not guilty to all remaining charges and is being held without bail at the Metropolitan Detention Center in Brooklyn.1Business Insider. Luigi Mangione Solitary Confinement at MDC

What Happened Outside the Hilton

Brian Thompson was walking alone to the New York Hilton Midtown for his company’s annual investor conference when, at about 6:44 a.m., a masked gunman stepped from behind a parked car and shot him in the back with a silenced semi-automatic pistol. The weapon jammed repeatedly; the gunman cleared it and kept firing. Thompson was pronounced dead at 7:12 a.m. The shooter escaped on an electric bicycle into Central Park. Detectives recovered three 9mm shell casings inscribed with the words “deny,” “delay,” and “depose.”2ABC News. Arrest in Altoona

Five days later, on December 9, 2024, Mangione was arrested at a McDonald’s in Altoona, Pennsylvania, after a 911 caller reported a man matching the suspect’s description. Officers found him with a backpack containing a 3D-printed pistol with a silencer, a loaded magazine, a red spiral notebook, handwritten writings prosecutors have characterized as a manifesto, and a fake ID. He had given officers a false name.4CNN. The Charges He Faces Now

Manhattan District Attorney Alvin Bragg’s December 17, 2024 indictment originally brought 11 counts, led by first-degree murder as an act of terrorism, which carried life without parole.8Manhattan DA. DA Bragg Announces Murder Indictment of Luigi Mangione After pretrial rulings, Mangione now stands trial in state court on nine remaining counts, including intentional second-degree murder (punishable by 25 years to life), several counts of criminal possession of a weapon, and criminal possession of a forged instrument.9New York Courts. The federal case, filed in the Southern District of New York as 1:25-cr-00176 and assigned to Judge Margaret Garnett, originally charged four counts: using a firearm to commit murder, two counts of interstate stalking resulting in death, and discharging a firearm with a silencer during a crime of violence.10Department of Justice. Terrorism Counts Thrown Out

On September 16, 2025, Justice Gregory Carro of the New York Supreme Court dismissed the two terrorism-related murder counts, ruling the grand jury evidence was legally insufficient to establish terroristic intent. Prosecutors had not shown that Mangione intended to “intimidate or coerce a civilian population” or “influence the policy of a unit of government.” Justice Carro wrote that the New York legislature intended the terrorism statute to reach acts comparable to the September 11 attacks and the Oklahoma City bombing, and that a “targeted and discrete” killing of one person did not qualify. He added that “this court does not believe that the legislature intended the employees of a company, however large, to constitute a ‘civilian population.'”9New York Courts. People v. Death Penalty Removed From the Federal Case

On April 24, 2025, the government filed notice that it would seek the death penalty, following a directive from the U.S. Attorney General.14Courthouse News. Luigi Mangione Dismissal Motion That changed on January 30, 2026, when Judge Garnett dismissed the federal murder count and a related firearm count, eliminating capital exposure. The ruling turned on whether the killing occurred during another “crime of violence.” Prosecutors argued the stalking counts met the definition; Judge Garnett held that stalking does not qualify as a crime of violence under binding Supreme Court precedent. She acknowledged the outcome “may strike the average person — and indeed many lawyers and judges — as tortured and strange,” but said it was a faithful reading of the law.15PBS NewsHour. What Jurors Will and Won’t See

After a nine-day suppression hearing in late 2025, Justice Carro issued a split ruling on May 18, 2026. He found the initial search of Mangione’s backpack at the McDonald’s was “an improper, warrantless search,” and suppressed a gun magazine, cellphone, passport, wallet, and computer chip taken from it. The firearm, silencer, and the journal survived as admissible because they were lawfully discovered during a later inventory search at the police station.17Courthouse News. The defense had earlier filed a notice of intent to raise an “extreme emotional disturbance” defense, which under New York law can reduce murder to manslaughter. Mangione’s lawyers withdrew that notice on June 18, 2026, in a one-sentence letter, citing concern that the psychiatric evidence would be prejudicial in the federal case, where that defense is not available.19New York Times. Reports emerged in mid-2026 that defense attorneys and federal prosecutors had discussed a possible plea deal, but no agreement resulted. Lead defense attorney Karen Friedman Agnifilo called the leaks “part of a troubling, deliberate pattern by prosecutors and law enforcement to prejudice Luigi, manipulate public opinion, and violate his constitutional right to a fair trial.”21NBC New York. What Prosecutors Say About Motive

The writings recovered from Mangione’s backpack expressed anger at the U.S. health insurance industry, which he described as extracting “human life force for money” and whose workers he called “parasitic bean-counters.” An August 2024 notebook entry read: “The target is insurance. It checks every box.” By October 2024, he had identified the UnitedHealthcare investor conference as a “true windfall” that “embodies everything wrong with our health system.” Prosecutors say Mangione had no personal insurance relationship with UnitedHealthcare and chose the company because it was the industry’s largest by market capitalization.22CNN. Trial Dates and Where He Is Now

Both trials have been pushed back more than once. As of June 2026, the New York state murder trial is scheduled to begin September 8, 2026, before Justice Carro. The federal trial is set for later: jury selection on January 5, 2027, and opening statements on January 25, 2027. Judge Garnett has said the delay allows for events in the state case to play out and preserve a fair trial.26ABC News. A Case That Became a Public Flashpoint
