Perry Tole was collecting used cooking oil in an alley between the Westin and the Indianapolis Marriott Downtown around 12:35 a.m. when, according to a police affidavit, Sanchez opened his truck door without permission and told him he could not park there. Tole said Sanchez smelled of alcohol and had slurred speech.2NBC News. The Claims Against Each Defendant
The complaint alleges assault and battery against Sanchez directly. Against Fox Corporation, it alleges negligent hiring, retention, and supervision, claiming Fox “knew or should have known” about Sanchez’s “unfitness as an employee” and his “propensity for drinking and/or harmful conduct.”5Deadline. On November 21, 2025, Tole’s attorneys filed an amended complaint adding Huse Culinary Inc. under Indiana’s Dram Shop Act, alleging the company served alcohol to Sanchez while he was visibly impaired at an event at St. Elmo Steak House earlier that evening.6IndyStar. Tole is seeking compensatory damages, punitive damages, and attorney’s fees. The lawsuit was filed in Marion Superior Court. In late December 2025, Fox Corporation removed the case to the U.S. District Court for the Southern District of Indiana, citing diversity jurisdiction: Tole is an Indiana resident, Fox is incorporated in Delaware with its principal office in New York, and damages exceed $75,000.9IndyStar. Substance-Use Allegations in the Civil Filing
In a May 2026 civil filing, Tole’s attorneys alleged Sanchez may have been under the influence of “cocaine, marijuana, fentanyl, and alcohol” at the time of the altercation. The attorneys acknowledged they had not yet provided evidence supporting the claims and were seeking discovery, including questions to Fox Sports about whether staff knew Sanchez had consumed illegal drugs at the event. The Parallel Criminal Case
The civil suit runs alongside a criminal prosecution in Marion County. Sanchez was initially charged with three misdemeanors: battery resulting in injury, public intoxication, and unlawful entry of a motor vehicle. Fox Sports Fired Sanchez
Sanchez had been off the air since the October 4 incident. On November 7, 2025, a Fox Sports spokesperson confirmed that “Mark Sanchez is no longer with the network.” Drew Brees replaced him as a game analyst.17CNN.
