Marshall Fire Lawsuit: $640M Xcel Settlement Funding and Payouts

The Marshall Fire lawsuit against Xcel Energy ended in a $640 million settlement announced on September 24, 2025, the day before jury selection was to begin in Boulder County. Xcel, along with co-defendants Qwest Corporation and Teleport Communications America, agreed to resolve more than 300 consolidated lawsuits brought by roughly 4,000 plaintiffs, while admitting no fault, no wrongdoing, and no negligence.¹² The December 30, 2021 fire destroyed or damaged more than 1,000 homes in Louisville and Superior, killed two people, and caused an estimated $2 billion or more in damages, making it the costliest wildfire in Colorado history.³

How the $640 Million Is Funded and Who Gets Paid

Xcel said roughly $350 million of the settlement will come from the company’s remaining insurance coverage. The other $290 million will be covered by a one-time charge to Xcel’s 2025 earnings. The company stated that no portion of the payout will come from its customers.¹⁴

The $640 million pool covers three categories of claimants: individual fire survivors, nearly 200 insurance companies pursuing subrogation claims for what they paid out on policies, and public entities.¹ Qwest and Teleport are included in the settlement, but their individual financial contributions have not been publicly disclosed.⁵

The total is a fraction of the fire’s damages. Adjusted for inflation, losses reached roughly $2.3 billion in 2025 dollars.⁶

How Individual Payments Are Calculated

There is no standardized claims matrix and no single allocation formula. Each plaintiff’s settlement amount was negotiated individually during mediation, based on that person’s specific losses. Factors include whether the home was totally destroyed, whether the plaintiff owned or rented, whether the claim involved smoke or soot damage, evacuation-related nuisance claims, and whether a death occurred.⁷

Law firms manage their own internal allocation for their clients. At least one firm hired a specialized mediator to calculate each client’s share based on economic losses.⁸ Plaintiffs are required to sign nondisclosure agreements, so individual amounts remain confidential.⁷

Why Xcel Admitted No Fault

The settlement contains an express denial of liability. Xcel CEO Bob Frenzel said the company remained convinced its equipment did not cause the fire but had always been open to a resolution that accounted for its defenses.⁹

Matthew Preusch, a court-appointed attorney for plaintiffs, said the outcome “provides real relief for fire survivors and holds Xcel accountable.”¹ KK DuVivier, a law professor at the University of Denver, said the deal avoided the risk of a Boulder jury formally finding Xcel responsible, while sparing plaintiffs a lengthy trial.⁹

What Plaintiffs Alleged Against Xcel

Boulder County investigators concluded that the fire had two ignition points. Investigators identified the most probable cause of the second ignition as an Xcel power line that came loose from its insulator in high winds, contacted another line, arced, and discharged hot particles onto dry grass.¹⁰ An electrical engineer working with investigators concluded the fire ignited when aluminum particles from arcing lashing wire landed on vegetation 80 to 110 feet from the utility pole.¹¹

Lawsuits alleged Xcel’s reclosers were set to tolerate faults of up to 800 amps and required 10 successive faults before triggering a lockout, and that Xcel did not implement a public safety power shutoff despite high wind warnings and severe drought conditions. Plaintiffs also alleged Xcel failed to bury power lines along the Highway 93 corridor, where winds regularly exceed 80 miles per hour.¹¹

Many plaintiffs also raised an inverse condemnation claim under the Colorado Constitution, arguing that because Xcel holds an exclusive right to provide electrical service in Boulder County, destruction of their property by utility-caused fire amounted to a taking without just compensation.¹² Colorado does not apply strict liability to electric utilities for fire damage, so the constitutional claim ran on a separate track from negligence.¹³

The claims against Qwest and Teleport Communications rested on expert reports theorizing that partially unattached telecommunications equipment contacted Xcel’s power lines.¹³

Xcel’s Defense

Xcel argued its equipment was properly maintained and that a substantial portion of the damage came from the fire’s first ignition, a controlled trash burn at a Twelve Tribes residential property on December 24, 2021, that was covered with dirt and later reignited when high winds uncovered smoldering debris six days later. Boulder County officials had visited the site on December 24 and deemed the residents’ plan responsible.¹¹⁴ Xcel also pointed to the century-old Lewis coal seam fire as a possible ignition source. Investigators found no evidence supporting the coal seam theory but could not entirely rule it out.¹⁰

Boulder County District Attorney Michael Dougherty determined that no criminal charges would be filed against Xcel or the Twelve Tribes residents, finding insufficient evidence of a crime.¹⁰

Where the Settlement Stands

By early November 2025, Xcel had executed or reached agreements with more than 2,000 of the roughly 4,000 plaintiffs, and deals with insurers and public entities were described as nearly finalized. About 600 claims involve minors and require court approval under Colorado’s probate rules to confirm the settlements are reasonable.¹⁵

Fewer than 10 individual plaintiffs rejected the settlement and indicated they would proceed to trial.⁵ Because of those holdouts, a narrower trial involving a limited number of claims remains possible.¹⁵

Xcel aimed to finalize remaining agreements and begin distributing funds by the end of 2025. Judge Christopher C. Zenisek scheduled a status conference for January 2026 and said he wanted the process wrapped up cleanly: “Let’s get past the finished line, tie it up, and make sure we do so in a way that people don’t have second thoughts.”⁵
