The allegations against Matt Gaetz center on a House Ethics Committee finding of “substantial evidence” that the former Florida congressman had sex with a 17-year-old girl in 2017, regularly paid women for sex between 2017 and 2020, used cocaine and ecstasy, accepted improper gifts, misused his office, and obstructed the committee’s investigation.1House Ethics Committee. What the House Ethics Committee Found
The committee released its 37-page report on December 23, 2024, after contacting more than two dozen witnesses and reviewing nearly 14,000 documents. It concluded there was substantial evidence that Gaetz:1House Ethics Committee. In the Matter of Allegations Relating to Representative Matt Gaetz
- Engaged in sexual activity in 2017 with a 17-year-old girl, conduct the committee said violated Florida’s statutory rape laws.
- Regularly paid women for sex from at least 2017 to 2020.
- Used or possessed cocaine and ecstasy on multiple occasions between 2017 and 2019.
- Accepted gifts exceeding permissible limits tied to a 2018 trip to the Bahamas, including transportation and lodging.
- Directed his chief of staff in 2018 to help a woman he was sexually involved with obtain a passport by falsely telling the State Department she was a constituent.
- “Knowingly and willfully sought to impede and obstruct” the committee’s own investigation.
One finding went the other way. The committee said it “did not find sufficient evidence to conclude that Representative Gaetz violated the federal sex trafficking statute.” It acknowledged he had transported women across state lines for commercial sex, but found no evidence that any of those women were under 18 at the time of travel or that their participation was induced by force, fraud, or coercion.1House Ethics Committee. The 17-Year-Old at the Center of the Case
The minor was a Florida high school junior in 2017. She and her family had experienced homelessness, and she was working at McDonald’s while trying to save for dental braces. She testified to the Ethics Committee that Gaetz had sex with her twice at the party and paid her $400, which she understood as payment for sex.4The 19th. The Money
The committee obtained Venmo records showing 27 payments from Gaetz to two women between July 2017 and late January 2019, totaling $10,224.02. Individual payments ran from $100 to over $700, with memo lines reading “Gift,” “Car deductible,” “Refreshments,” “travel,” and “extra 4 u.” Both women testified that some of the money was for sex. The committee also documented a $750 check from October 2018, signed by Gaetz, made out to cash, with the memo “tuition reimbursement.” A witness testified Gaetz had given it to her.8ABC News. Across roughly a dozen women, the committee identified payments totaling more than $90,000 that it concluded were likely tied to sexual activity, drug use, or both.4The 19th. The Drug Allegations
The committee identified at least 20 instances between early 2017 and mid-2020 in which Gaetz met with women for paid sex, drugs, or both.9The Hill. Ethics Committee Gaetz Report A woman identified in the report as “Victim A” said she saw Gaetz using cocaine at the July 15, 2017, party. Another said she witnessed him using cocaine or ecstasy on at least five occasions. Nearly every witness the committee interviewed reported seeing him use marijuana.
According to the report, Gaetz asked women he paid for sex to bring drugs with them, using code words like “marijuana cartridges,” “vitamins,” and “rolls,” and reimbursed them for the purchases. Joel Greenberg told investigators he typically provided the drugs at events with Gaetz and was paid back in cash. The committee also found that Gaetz had set up a pseudonymous email account from his House office to buy marijuana.10The Guardian. Why the Justice Department Didn’t Charge Him
The DOJ opened its investigation into Gaetz in late 2020, focused on potential sex trafficking of a minor and obstruction of justice.11CNN. DOJ Declines to Charge Rep. Matt Gaetz It gained momentum when Joel Greenberg pleaded guilty in May 2021 to six federal charges, including sex trafficking of a minor, and began cooperating. Greenberg told investigators he had witnessed Gaetz having sex with the 17-year-old girl and that she was paid. He was sentenced to 11 years in federal prison on December 1, 2022.12CNN. Joel Greenberg Sentenced to 11 Years in Prison
Prosecutors nevertheless recommended against charging Gaetz as early as September 2022, citing concerns that central witnesses would not be seen as credible by a jury.11CNN. DOJ Declines to Charge Rep. Matt Gaetz The department also faced difficulty proving Gaetz knew the girl was underage at the time of the alleged encounters.13ABC News. DOJ Will Not Charge Gaetz in Sex Trafficking Probe On February 15, 2023, the DOJ told Gaetz’s legal team it would not bring charges on sex trafficking or obstruction. He has not been charged with any crime at the federal or state level.
Gaetz’s Response
Gaetz has denied every allegation of criminal conduct. On the minor, he posted: “I NEVER had sexual contact with someone under 18. Any claim that I have would be destroyed in court — which is why no such claim was ever made in court.”14NPR. Matt Gaetz Ethics Report Released He has also said the victim previously threatened him with a $2.3 million lawsuit if he did not pay her.3KFOX TV. Court Documents Expose Gaetz Accuser’s Past
On the broader lifestyle allegations, he acknowledged some conduct while disputing it was criminal: “My 30’s were an era of working very hard — and playing hard too. It’s embarrassing, though not criminal, that I probably partied, womanized, drank and smoked more than I should have earlier in life.”14NPR. Matt Gaetz Ethics Report Released He has described payments to women as “generosity to ex-girlfriends” and questioned how consensual gifts could amount to prostitution.4The 19th. Matt Gaetz Denies All Wrongdoing
On drugs, he said in September 2024: “I have not used drugs which are illegal, absent some law allowing use in a jurisdiction of the United States.”9The Hill. Ethics Committee Gaetz Report
Gaetz was also uncooperative with the Ethics Committee itself, according to the report. He produced three pages of documents in response to initial requests, submitted brief written denials, declined a voluntary interview, and did not appear after being subpoenaed on July 11, 2024, telling the committee he believed the House would not enforce the subpoena.1House Ethics Committee. The Attorney General Nomination
The allegations surged back into public view on November 13, 2024, when President-elect Donald Trump announced he would nominate Gaetz as U.S. Attorney General.16NPR. Gaetz Out as Attorney General Nominee Gaetz resigned from the House soon after, a move that stripped the Ethics Committee of jurisdiction over him as a sitting member and briefly raised the prospect that its report would never be released.
Senate Republicans balked. Senator Richard Blumenthal estimated that five to ten Republican senators had voiced concerns, with at least three to five prepared to vote against Gaetz, likely enough to sink the nomination given a 53-seat majority.16NPR. Gaetz Out as Attorney General Nominee On November 21, 2024, Trump told Gaetz he did not have the votes, and Gaetz withdrew, saying the nomination was “unfairly becoming a distraction.” Trump then nominated Pam Bondi.17CNN.
