Megan Hargan Case: Killings, Retrial, and Appeal

The Megan Hargan case is a Fairfax County, Virginia prosecution in which Megan Hargan was convicted of shooting her mother Pamela and her 24-year-old sister Helen at the family’s McLean home on July 14, 2017, and staging the scene to look like Helen had killed Pamela before turning the rifle on herself. Prosecutors proved the killings were driven by a botched attempt to steal roughly $400,000 from her mother’s bank account the day before. Hargan was convicted at a first trial in 2022, had that verdict thrown out because a juror ran her own gun experiment at home, was convicted again in September 2023, and in January 2024 was sentenced to two consecutive life terms plus six years.

Who Megan Hargan Is

Megan Hargan was 34 at the time of the killings and the eldest of three sisters. She was living at her mother’s home on Dean Drive in McLean with her eight-year-old daughter while her husband was deployed. Pamela Hargan, 63, was a former Lockheed Martin vice president who had built an estate worth roughly $8 million.¹ Helen, a recent Southern Methodist University graduate, was also living at the house that summer while her mother helped her buy a home of her own. She was dating Carlos Gutierrez, who lived in Dallas.²

Pamela’s sister, Tamara North, later described the relationship between Megan and her mother this way: “I think Megan was constantly striving to please her mother, and she never could.”³

The Money Behind the Killings

Pamela was helping Helen buy a house but was not extending the same help to Megan, who was scheduled to close on a home of her own in Morgantown, West Virginia, on July 14, 2017.⁴ At the time, bank records showed Megan had $443 in her account. Her mother had $603,905.⁵

On July 13, the day before the closing, Megan called Capital One, impersonated her mother, and attempted to wire more than $400,000 from Pamela’s account to a real estate settlement company. To pass the bank’s identity checks she used a spreadsheet of her mother’s passwords and security questions that investigators later found she was keeping in the house.⁶ The bank flagged the transfer and phoned Pamela directly. Pamela told the employee, “No. I did not do that… Those accounts are not to be touched. Period.” She then froze her accounts and sent Megan to the bank to confirm the freeze.⁵

Separately, a forged bank document listing Pamela’s account information under Megan’s name and address had been given to a real estate agent as proof of funds for the West Virginia purchase.⁵

The Killings on July 14, 2017

According to the prosecution’s reconstruction, on the morning of July 14 Megan shot Pamela twice in the head with a .22 Ruger rifle belonging to her husband that had been stored in the home.⁷ Pamela was found face down in the first-floor mudroom, covered by a blanket and a dog bed, with her cell phone placed on top of the blanket and the pool of blood in a position investigators concluded was possible only if someone put it there after the shooting.²

After the first shooting, prosecutors said, Megan tried the wire transfer again. Bank records showed that at 11:45 a.m., someone answered Pamela’s phone when the bank called back, and prosecutors identified that person as Megan.³ She then went upstairs and shot Helen once in the top of the head with the same rifle. Helen was found slumped against a bathtub with the rifle propped between her legs and the muzzle pointing toward the ceiling, arranged to suggest a self-inflicted wound.⁶

Both victims’ phones appeared wiped of prints. Helen’s screen showed visible swipe marks, and no usable prints came off the rifle.⁶ Megan’s eight-year-old daughter was in the home throughout. Trial testimony suggested Helen may have stayed rather than running because she was afraid to leave the child behind.⁸

How Police Were Called

The case became known to police because of Carlos Gutierrez. He was asleep in Dallas when Helen began calling him around 9:30 a.m. When he picked up around 11:30 a.m., she was sobbing. She told him Megan had just walked into her room and said, “I did something bad. I did something bad. I killed Mom.”³ Helen said she could hear Megan downstairs on the phone with a bank and could hear her mother “gasping” through the cracked bedroom door. She refused to leave because she did not know how to get her niece out of the house safely, and she asked Gutierrez not to call 911 because she was afraid of what a police response would mean for the child.⁹

When Gutierrez called back later, a different voice answered Helen’s phone. He recognized it as Megan’s. She told him Helen and their mother were arguing over a speeding ticket and would not put Helen on the line.⁹ Gutierrez called 911, telling dispatchers, “I think this is life or death. I think someone might be dead.”⁸ Fairfax County officers reached the house shortly before 3 p.m. and found both women dead. Megan and her daughter were already gone; she was driving to West Virginia to move into the new house.²

How the Staging Fell Apart

Fairfax County police initially treated the deaths as a murder-suicide.¹⁰⁶¹¹

On July 17, three days after the killings, Capital One called Byerson to report the attempted $400,000 wire transfers. Two days after that he brought Megan in for an interview that lasted more than four hours. She first told him her mother had personally authorized the transfers. When he played the recorded bank calls she conceded the voice was hers, saying she lied because she “knew how it would look.” According to Byerson she failed a polygraph three times, while continuing to deny the killings. The spreadsheet of Pamela’s account passwords had been logged during the initial scene search but went missing after the property was returned to the family; officers later recovered it during a search of Megan’s home.⁶

Megan Hargan was arrested in November 2018 on two counts of first-degree murder and two counts of using a firearm in the commission of a felony.¹⁰

The First Conviction and Why It Was Thrown Out

Hargan’s first trial began March 7, 2022 in Fairfax County Circuit Court. On March 24 the jury returned guilty verdicts on all four counts and recommended the maximum sentence.¹²

After the verdict it emerged that Juror #82 had gone home during the trial and used her own shotgun to test whether Helen could have physically shot herself at the angle described in testimony. She concluded it was not possible and shared her findings with other jurors during deliberations. She never disclosed the experiment to the court.¹²

On November 9, 2022, Judge Brett A. Kassabian set aside the verdict and ordered a new trial. Under Virginia law, he wrote, a defendant does not have to show actual prejudice from juror misconduct, only the “possibility of prejudice.” The juror’s outside reenactment and her sharing of the results meant the verdict had not been based solely on evidence presented in court, and the “reliability of the verdict” and the need for “purity” in the process outweighed the finality of the conviction.¹²

The Retrial, Verdict, and Sentence

Commonwealth’s Attorney Steve Descano’s office retried the case, with Senior Assistant Commonwealth’s Attorneys Kelsey Gill and Eric Clingan leading the prosecution.¹³ The second jury heard the recorded Capital One call in which Pamela ordered her accounts frozen, saw the forged proof-of-funds letter, and watched the video of Megan’s four-hour interview with Byerson, in which she blamed Helen’s mental health while admitting to the impersonation calls.⁵ Prosecutors also presented the gunshot residue on her hands and the downward bullet trajectory in Helen’s wound.¹¹

The defense again argued that Helen had killed Pamela and then shot herself, contending Helen was distraught because Pamela had threatened to cancel Helen’s house purchase over her disapproval of Gutierrez, and that Helen had used her toes on the trigger while wearing a sock to avoid leaving prints.¹⁰ The defense pointed to testimony from another sister, Ashley, that Helen had previously attempted suicide and that Pamela suspected her of drug use. Prosecutors responded that both Gutierrez and Ashley had testified Helen appeared normal on July 14, and that no evidence showed she was suicidal at the time of the killings.⁸

After roughly twelve hours of deliberation, on September 22, 2023, the jury found Megan Hargan guilty on all four counts.⁵ On January 26, 2024, she was sentenced to two consecutive life terms for the murders plus six years on the firearms charges.¹⁴

The Pending Appeal

Hargan has appealed her conviction to the Court of Appeals of Virginia. According to the court’s docket, oral arguments in Megan Hargan v. Commonwealth of Virginia, Record No. 0344-24-4, were scheduled for June 24, 2025, in Arlington. She is represented on appeal by Bryan Kennedy and Andrew Elders; the Commonwealth is represented by Assistant Attorney General Matthew J. Beyrau.¹⁵
