Mel Tucker Lawsuit: Claims, MSU Response, and Current Status

The Mel Tucker lawsuit is a federal wrongful termination case the former Michigan State head football coach filed against the university on July 31, 2024, seeking more than $80 million and alleging that MSU used a sexual harassment investigation as a pretext to escape his guaranteed contract. The 75-page complaint, filed in the U.S. District Court for the Western District of Michigan, adds claims of defamation and racial discrimination. As of mid-2026, the case is still pending.1MLive. What Tucker Is Claiming

Tucker’s suit names Interim President Teresa Woodruff, Athletic Director Alan Haller, general counsel Brian Quinn, and all eight members of the Board of Trustees. He calls the Title IX investigation a “sham” and argues the university seized on media coverage to void the roughly $80 million left on his ten-year, $95 million contract.2Athletic Business. Wrongful Termination

The contract Tucker signed on November 24, 2021 was fully guaranteed but contained a clause letting MSU fire him without paying the balance for “conduct which constitutes moral turpitude” or conduct that would “tend to bring public disrespect, contempt, or ridicule upon the University.”3Marquette University Law School. Mel Tucker Contract and Termination Analysis Tucker’s position is that no such conduct occurred because the April 28, 2022 phone call at the center of the case was consensual phone sex between adults, not harassment.

Defamation

Tucker alleges Woodruff and Haller made “false and defamatory” statements at the September 10, 2023 press conference announcing his unpaid suspension. Haller told reporters “new developments” justified the move, but Tucker contends university officials had known about the underlying situation for months. He claims the Board of Trustees authorized the misleading framing and that the coverage that followed destroyed his reputation and career.3Marquette University Law School. Racial Discrimination

Tucker argues MSU applied its conduct standards unequally, targeting him while sparing white coaches accused of what he calls “far more serious” behavior. He points to former head coach Mark Dantonio, during whose tenure at least 16 football players were accused of sexual assault or violence against women, and who was allowed to keep a $4.3 million bonus after his 2020 resignation and was rehired as associate head coach in September 2023. He also cites basketball coach Tom Izzo, noting that a student-assistant coach charged with punching a female student was allowed to keep working, and that Izzo reportedly contacted a witness in a sexual assault case involving a player before investigators did.4Sports Litigation Alert. Why MSU Fired Him

The dispute traces back to a phone call on April 28, 2022 between Tucker and Brenda Tracy, a sexual assault survivor and advocate Tucker had hired to speak to his football team about consent. Tracy alleged that during the call Tucker made sexual comments and masturbated without her consent. Tucker acknowledged the sexual activity but said it was mutually consensual.5USA Today. Tracy filed a Title IX complaint in December 2022. Outside attorney Rebecca Leitman Veidlinger investigated from January through July 2023, producing a 106-page report. The matter was largely private until USA Today published its account on September 10, 2023. That same day Haller suspended Tucker without pay. On September 18, MSU sent a notice of intent to fire for cause and gave Tucker seven days to respond. The university found his response insufficient and terminated him on September 27, 2023, citing “admitted and undisputed behaviors which have brought public disrespect, contempt and ridicule upon the university” and “moral turpitude.”6Bridge Michigan. How Michigan State Is Responding

MSU filed a motion to dismiss on October 23, 2024, calling the suit “meritless” and describing it as an “$80 million conspiracy” theory. The university argues Tucker’s own “admitted misconduct” is the obvious explanation for his firing and that his race alone does not establish an inference of discrimination.9Sportico. On the contract itself, MSU argues the deal gave the university “reasonable judgment” to decide whether Tucker’s conduct warranted termination. It contends the defamation claim is barred under Michigan’s Hart doctrine, which prevents tort claims arising from the same conduct as a breach-of-contract dispute, and it asserts federal and state qualified immunity for the individual defendants.3Marquette University Law School. The 2026 Ruling Tucker Is Leaning On

In February 2026, Tucker’s attorney Rita Glavin filed a brief opposing dismissal that leans heavily on a January 2026 ruling by Ingham County Judge Wanda Stokes in a separate state case brought by Tracy. Stokes stated the evidence “points to the fact that these were consenting adults.” Glavin argues that finding undercuts MSU’s stated basis for firing Tucker.10Lansing State Journal. The Related Lawsuits

Tucker’s case is one of several tied to the same events. Tracy has filed multiple suits of her own, and the outcomes so far have mostly gone against her.

Her first suit against Tucker, filed in 2023, was dismissed in May 2024 for failing to meet discovery standards; an appeal is pending before the Michigan Court of Appeals.11WILX. Judge Stokes dismissed all nine counts on January 28, 2026, ruling they were either time-barred or lacked a factual basis for a jury; Tracy’s attorney Karen Truszkowski said she would likely appeal.12Lansing State Journal. Tracy also sued the MSU Board of Trustees and two individual trustees, Rema Vassar and Dennis Denno, in June 2025, alleging they leaked her identity as the confidential complainant to the press. U.S. District Judge Paul L. Maloney dismissed that case on April 14, 2026. He wrote that her allegations, if true, showed she “was subjected to sexual misconduct and that her information in the course of that investigation was mishandled,” but found her legal arguments failed to overcome the university’s immunity defense.13Yahoo News. Judge Dismisses Brenda Tracy Case

On March 23, 2026, Tracy filed a separate suit in Oakland County Circuit Court against Mat Ishbia, CEO of United Wholesale Mortgage and a major MSU donor, and against UWM itself. She alleges Tucker’s attorney arranged for UWM general counsel David Zacks to be copied on investigation correspondence beginning in January 2023 without her knowledge, to keep Ishbia informed about developments affecting his financial interests in the football program.14Lansing State Journal. Where Things Stand

Tucker’s federal wrongful termination case is still pending. His attorneys are pointing to Judge Stokes’s January 2026 language about consenting adults as support for the argument that MSU had no cause to fire him.16Detroit News. Mel Tucker Brenda Tracy Lawsuit Dismissal MSU MSU’s position has not shifted: it owes him nothing, and firing him was a straightforward use of the contract’s moral turpitude clause.
