What Triggered the Threat
On August 5, 2025, Hunter Biden sat for an interview with journalist Andrew Callaghan on the YouTube series Channel 5. During the conversation, Biden said: “Epstein introduced Melania to Trump. The connections are, like, so wide and deep.”1The Guardian. Melania Trump has said she met Donald Trump at a 1998 Fashion Week party in New York through a modeling agent, an account she gave in her memoir Melania. No public evidence has established that Epstein made the introduction.3BBC News. Melania Trump Threatens Hunter Biden With Billion-Dollar Lawsuit
The $1 Billion Demand Letter
On August 6, 2025, the first lady’s attorney Alejandro Brito, of the Coral Gables firm Brito PLLC, sent a letter to Biden’s lawyer Abbe Lowell. The letter called Biden’s comments “false, disparaging, defamatory, and inflammatory” and demanded a full retraction and apology by August 7, 2025. It warned that failure to comply would result in a lawsuit seeking more than $1 billion in damages for “overwhelming financial and reputational harm.”4ABC7 News. The deadline came and went. No complaint was filed then, and none has been filed since.
Biden’s Refusal
On August 14, 2025, Callaghan released a follow-up video in which he showed Biden the demand letter and asked whether he wanted to apologize. Biden’s answer: “F**k that. Biden also said he would welcome a formal case because it would give him the chance to depose both the president and first lady. “If they want to sit down for a deposition and clarify the nature of the relationship between Jeffrey Epstein — if the president and the first lady want to do that — I’m more than happy to provide them the platform to be able to do it,” he told Callaghan.8ABC News. Would the Lawsuit Actually Win
If Melania Trump did file the suit, she would face a steep legal standard. As the spouse of a sitting president, she would almost certainly be treated as a public figure under New York Times Co. v. Sullivan (1964). Public figures have to prove “actual malice” by clear and convincing evidence, meaning the speaker knew the statement was false or acted with reckless disregard for whether it was false.9Congress.gov. The $1 billion figure is not unheard of but is unusual. Dominion Voting Systems sued Fox News for $1.6 billion and settled for over $787 million; Smartmatic has a pending $2.7 billion suit against Fox; juries ordered Alex Jones to pay roughly $1.5 billion to Sandy Hook families.10Freedom Forum. Others Who Got the Same Letter
Brito sent similar letters to several people who repeated or amplified the Epstein-introduction claim during summer 2025. Most retracted quickly.
The Daily Beast pulled a July 30, 2025 story headlined “Melania Trump ‘Very Involved’ in Epstein Scandal: Author” the day after publication, appending an editor’s note that “the article did not meet our standards.”12The Daily Beast. Epstein: This Story Has Been Removed
Political commentator James Carville removed a YouTube clip from his podcast titled “The Epstein Connection – Trump & Melania” on August 7, 2025, edited the comments out of the episode, and apologized on air. “We took a look at what they complained about, and we took down the video and edited out those comments from the episode. HarperCollins UK removed a passage from Andrew Lownie’s book Entitled: The Rise and Fall of the House of York after 60,000 copies had already shipped containing the claim that Epstein introduced the Trumps to each other. The publisher pulled the passages from future printings, the e-book, and audiobook, and apologized: “HarperCollins UK apologizes to the First Lady.”14People. Michael Wolff, the original source Biden cited, was the only target to fight back. In October 2025, Wolff filed a preemptive lawsuit in New York state court under the state’s anti-SLAPP law, seeking a judicial declaration that his comments were not defamatory and accusing the Trumps of using litigation threats to create a “climate of fear.”16Courthouse News Service. Where Things Stand
The Hunter Biden matter has not moved past the demand letter. Biden has not retracted his statement. The Channel 5 interview is still on YouTube. Melania Trump has issued a separate public denial, saying in April 2026 that she was never friends with Epstein, had no knowledge of his crimes, and was not introduced to her husband by him.19NPR.
