Melody Farris Murder Case: Trial, Verdict, and Sentencing

Melody Farris was convicted in November 2024 of murdering her husband, Atlanta attorney Gary Farris, whose shot and burned remains were found in a burn pile on the couple’s Cherokee County, Georgia farm in July 2018. A jury found her guilty on all five counts against her, and she was sentenced on December 5, 2024, to life in prison with the possibility of parole after 30 years. The Melody Farris murder case ended with her still maintaining her innocence and publicly accusing her own son of the killing.¹

Who Gary Farris Was and What the Marriage Looked Like

Gary Wayne Farris was a commercial real estate attorney with more than 30 years in practice and the managing partner of the Atlanta office of Burr & Forman.² He and Melody had been married 38 years and lived on a 10-acre farm near Alpharetta, though they kept separate living quarters inside the house.³

The relationship was troubled. Gary had filed for divorce in February 2010 after learning Melody had taken out a home equity loan on the farm without telling him; the petition was dismissed that August and the couple reconciled.⁴ By 2018 they were fighting over money. Prosecutors said Gary wanted to support their four adult children while Melody was spending on an affair with Roy “Rusty” Barton, a farm equipment salesman she had been seeing since 2014.⁵ In a text to a neighbor, Melody wrote of her husband: “I hope he dies alone and a gruesome death.”³

In the months before he died, Gary told at least two of his children he believed Melody was trying to poison him. That fear followed an April 2018 incident in which he was rushed to the hospital after eating cookies she had baked.³

How Gary’s Body Was Found

On July 5, 2018, Melody reported Gary missing after two grandchildren could not find him on the property. During a search of the farm, the couple’s son Scott Farris discovered skeletal remains in a burn pile roughly 80 to 100 yards from the house and called 911.⁵ Investigators initially considered an accident or medical episode. Melody encouraged that theory, telling detectives Gary had started the fire himself and may have collapsed.⁶

That changed when forensic teams sifting through the ashes found a bullet lodged in Gary’s rib. GBI forensic pathologist Dr. Steven Atkinson ruled the death a homicide caused by a gunshot wound to the torso.³

What the Investigation Uncovered

Investigators believe Gary was killed on the evening of July 3, 2018. A matching .38 caliber bullet turned up on the basement floor, and drops of Gary’s blood were found on the kitchen floor, on the stairs down to the basement, and in the basement itself. The pattern suggested the attack started upstairs and continued below.⁵

Data from Google Location Services on Gary’s phone showed the device moving between the house and the burn pile between 7:58 a.m. and 9:05 a.m. on July 4, a window when only Melody was home. Scott’s phone records placed him miles away, heading to a 7:00 a.m. golf tee time.⁵³

Detectives found birth control and a credit card in Rusty Barton’s name inside Melody’s purse, and text messages showed Gary had confronted her about spending on the relationship. Barton, who was Melody’s cousin’s stepson, told investigators that during a July 4 phone call Melody said: “Gary is in the burn pile.” After a 12-month investigation by the Cherokee County Sheriff’s Office, Melody was arrested in June 2019 in Tullahoma, Tennessee, where she had been staying with Barton. He was never charged.⁵

The Trial

The trial opened on October 7, 2024, in Cherokee County Superior Court before Judge David L. Cannon Jr. Over 18 days, prosecutors called 44 witnesses and introduced more than 1,200 pieces of evidence.⁶⁷ The state’s theory was that Melody killed Gary to gain access to his multimillion-dollar assets and pursue a life with Barton, shooting him first in the kitchen and again after he fled to the basement.⁵

Beyond the bullets and blood, prosecutors pointed to blood on a Kubota tractor they said was used to move the body, luminol streaks near the basement stairs suggesting cleanup, and Melody’s DNA on the tractor’s gear shifter.³ Barton testified and repeated his “Gary is in the burn pile” account, though he admitted he had shifted his story about when the call happened.⁸ Three of the couple’s adult children testified against their mother, describing her flat reaction to Gary’s death and her refusal to hold a funeral.⁹

Late in the case, Martha Jane Barton, Melody’s second cousin and Rusty Barton’s stepmother, told the jury on October 25 that a .38 Special revolver she owned had disappeared sometime after her husband’s 2014 death. She had not reported the gun missing until October 18, 2024, after hearing Rusty’s testimony and realizing the case involved the same caliber. The murder weapon was never recovered.¹⁰

The defense went after the state’s narrative in three ways. On physics, they argued Melody, who weighed about 130 pounds, could not have moved 300-pound Gary to the burn pile; attorney John Luke Weaver dragged burlap bags filled with 320 pounds of rock salt across the courtroom to make the point.⁵ On evidence, they attributed the blood drops in the house to a dog bite on Gary’s ankle and called the phone location circles too large to prove anything precise. On suspect selection, they pointed at Scott Farris, citing his size (6 feet 8 inches, 280 pounds), his access to .38 caliber ammunition, and a financial motive to inherit the property, and they faulted investigators for not searching his room or the barn where he lived.⁹ Lead detective Daniel Haynes testified he had never considered Scott a suspect. Scott’s hands tested negative for fire accelerants, and his phone put him away from the farm during the July 4 morning window.³

Verdict and Sentencing

Closing arguments were delivered October 30, 2024. After more than 15 hours of deliberation across four days, the jury returned its verdict on November 4, finding Melody Farris guilty on all five counts: malice murder, felony murder, aggravated assault, concealing the death of another, and making a false statement.¹¹

On December 5, 2024, Judge Cannon sentenced her to life in prison with the possibility of parole after 30 years for the murder conviction. She received an additional five years each for concealing the death and making a false statement, both running concurrently with the life sentence. The court also ordered no contact with family members unless a family member chooses to maintain it.¹ At the minimum, she would be eligible for parole in 2054 at age 94.⁵

Given a chance to speak at sentencing, Melody accused her son Scott of the killing, saying he “wanted that property to be his” and had “set me up from the beginning.” Scott was in the courtroom. He later told CBS correspondent Peter Van Sant: “It was 100% Melody Farris who murdered my father.”¹²

Where the Case Stands Now

Three of the Farris children supported the guilty verdict. The youngest daughter has continued to say she believes her mother is innocent. The case was the subject of a CBS 48 Hours episode, “The Farris Wheel,” which aired in May 2025, and a six-episode companion podcast, Blood Is Thicker: The Farris Wheel, which premiered in March 2026.¹³

As of mid-2026, no public record indicates Farris has filed an appeal or any post-conviction motions. She continues to maintain her innocence.⁵
