Michael Cohen Jail Sentence: Hush Money, Gag Clause, Disbarment

Michael Cohen’s jail sentence was three years in federal prison, imposed on December 12, 2018, by U.S. District Judge William H. Pauley III in the Southern District of New York after Cohen pleaded guilty to nine felony counts spanning tax evasion, bank fraud, campaign finance violations, and lying to Congress.¹ He served roughly a year at the federal prison camp in Otisville, New York, before being released to home confinement during the COVID-19 pandemic, and his supervised release ended in November 2024.²

What Cohen Pleaded Guilty To

On August 21, 2018, Cohen pleaded guilty to an eight-count criminal information in the Southern District of New York: five counts of tax evasion, one count of making false statements to a federally insured financial institution, one count of causing an unlawful corporate campaign contribution, and one count of making an excessive campaign contribution.¹

The tax counts covered more than $4 million in personal income Cohen concealed between 2012 and 2016, producing over $1.3 million in unpaid federal taxes. Most of the hidden money came from his taxi medallion business. He held medallions in New York City and Chicago and pocketed more than $2.4 million in unreported interest payments from loans to a Chicago taxi operator, plus over $1.3 million from a New York operator, along with proceeds from a Florida property sale, consulting fees, and even a rare French handbag sale.³

The bank fraud count grew out of a $500,000 home equity line of credit Cohen obtained in December 2015 by hiding more than $20 million in debt and understating his monthly expenses by at least $70,000. The same pattern of deception ran across multiple loan applications between 2013 and 2018, including an attempt to buy an $8.5 million summer home while concealing a $14 million line of credit.³

A ninth count came on November 29, 2018, when Cohen pleaded guilty separately to making false statements to Congress, a charge brought by Special Counsel Robert Mueller’s office. Cohen admitted lying to the Senate Select Committee on Intelligence about the Trump Organization’s efforts to build a branded property in Moscow, telling senators that negotiations ended in January 2016 when they had actually continued through at least June 2016. He said he lied “to be loyal to Individual One,” meaning Donald Trump, and to align with Trump’s political messaging.⁴

The Hush Money Payments Behind the Campaign Finance Counts

The campaign finance charges were tied to two payments made in the final weeks of the 2016 presidential race. Cohen wired $130,000 to adult film actress Stormy Daniels in exchange for her silence about an alleged sexual encounter with Trump. He also coordinated with David Pecker, then the publisher of the National Enquirer, to suppress the story of former Playboy model Karen McDougal, who alleged a separate affair.⁵

Cohen testified that he acted “at the direction of and for the benefit” of Trump, who told him to “just take care of it.” After the election, Cohen, Trump, and Trump Organization CFO Allen Weisselberg set up a repayment plan: twelve monthly installments of $35,000, disguised as a legal retainer. The same conduct later became the basis for the Manhattan District Attorney’s 2023 case against Trump himself, in which Trump was charged with 34 counts of falsifying business records tied to the reimbursements.⁵⁶

How the Sentence Broke Down

Judge Pauley imposed 36 months in federal prison followed by three years of supervised release. On top of the prison time, the SDNY case carried a $50,000 fine, $1,393,858 in restitution to the IRS, and $500,000 in forfeiture. The false-statements charge from the Special Counsel’s Office added another $50,000 fine and a two-month sentence that ran concurrently with the SDNY term.¹

Where and When He Served the Sentence

Cohen’s original surrender date was March 6, 2019, but Judge Pauley granted a two-month delay so he could recover from shoulder surgery and prepare for congressional testimony. He reported to the Federal Correctional Institution in Otisville, New York, on May 6, 2019, and served in the facility’s minimum-security camp.⁷⁸

He spent about a year at Otisville. In spring 2020, the Bureau of Prisons expanded its home confinement guidance in response to COVID-19, prioritizing inmates who had served at least 25 percent of their sentence with 18 months or less remaining. Cohen qualified. On May 21, 2020, he was furloughed from Otisville and returned to his Manhattan apartment. His projected full release from prison had been November 2021.⁹

The Gag Clause and the Return to Prison

The home confinement transition broke down almost immediately. On July 9, 2020, Cohen met with probation officers expecting to be fitted with an ankle monitor. Instead, he was handed an agreement with an unusual clause banning “any engagement of any kind with the media, including print, tv, film, books, or any other form of media/news.” The agreement also prohibited social media posts by him and required his friends and family to avoid posting about him. The stated purpose was to prevent “glamorizing or bringing publicity” to his inmate status.¹⁰

When Cohen’s attorney tried to negotiate the media restrictions, U.S. Marshals took Cohen into custody and moved him to a federal facility in Brooklyn. The Bureau of Prisons said he had “refused the conditions” and been “argumentative.” His lawyers said he never refused to sign; he sought changes.¹¹¹²

On July 20, 2020, Cohen filed a habeas corpus petition against Attorney General William Barr and Bureau of Prisons officials, alleging he had been re-imprisoned in retaliation for writing a book critical of Trump. Three days later, U.S. District Judge Alvin K. Hellerstein sided with him, finding that the gag clause violated the First Amendment. “In 21 years of being a judge and sentencing people and looking at the terms and conditions of supervised release, I have never seen such a clause,” Hellerstein said. “How can I take any other inference but that it was retaliatory?”¹³

The judge ordered Cohen released to home confinement by 2:00 p.m. on July 24, 2020, under standard federal location monitoring conditions and without the media restrictions.¹⁴¹⁵

When the Sentence Actually Ended

Cohen finished the custodial portion of his sentence on home confinement at his Manhattan apartment, with the prison term projected to conclude in November 2021. The three-year supervised release period ran from there. According to a March 2024 opinion by Judge Jesse M. Furman, Cohen’s supervised release was set to expire in November 2024.²¹⁶

Disbarment

The conviction ended Cohen’s legal career. On February 26, 2019, the New York State Supreme Court’s Appellate Division disbarred him. The Attorney Grievance Committee argued that his federal conviction for making false statements to Congress would amount to the felony of offering a false instrument for filing under New York law, triggering automatic disbarment. The court ordered his name struck from the roll of attorneys, retroactive to his November 2018 guilty plea.¹⁷¹⁸
