Michael Hetle Murder Case: Trial, Sentence, and Appeal

The Michael Hetle murder case ended with a life sentence for the former police officer and NASA executive who shot and killed his 24-year-old neighbor, Javon Prather, outside their Springfield, Virginia, townhomes on March 3, 2020. A Fairfax County jury convicted Hetle of first-degree murder in October 2021, Judge Randy I. Bellows imposed life plus three years in January 2022, and the Court of Appeals of Virginia affirmed the convictions in February 2023.

What Happened on March 3, 2020

Police were called to the Fairfax County townhome community several times that day over disturbances between the two households. Around 5:00 p.m., after Prather returned home and played loud music, Hetle shouted at him from a window. Prather walked over, knocked on Hetle’s front door, and stepped back.¹

Hetle opened the door holding a semi-automatic pistol and shot Prather twice in the chest. As Prather turned and tried to flee down the stairs, Hetle kept firing, hitting him in the back. After Prather collapsed on the driveway, Hetle shot him once more in the chest. Seven shots in roughly six seconds.¹ Prather died at the scene.²

The entire encounter was recorded by Hetle’s own security camera and a Ring doorbell camera. The footage showed Hetle then pointing the gun at Prather’s wife, Janelle, who had run out to help her husband, and saying, “You want it too?”³¹

The Feud Behind the Shooting

The conflict stretched back to around 2016 or 2017 and involved complaints about barking dogs, loud music, and, in Hetle’s account, an incident in which Prather used a garden hose without permission to wash a car.⁴ Between September 2018 and March 2020, Hetle filed numerous complaints with police and the homeowners’ association about noise, vandalism, public intoxication, and trespass. He obtained a two-year protective order against Janelle Prather in May 2019 after alleging she had thrown glass bottles at his home and car.¹

On the morning of the shooting, Hetle sent an email to the HOA warning that the dispute could “result in tragedy” if the association did not intervene. Prosecutors used that email at trial as evidence of premeditation.⁵

Evidence of Racial Animus

Hetle is white; Prather was of mixed race. Hetle’s own son testified that he had heard his father use a racial slur about Prather at least ten times. Janelle Prather told the jury she believed racial hatred partly motivated the shooting. Hetle denied it.¹⁴

The trial court also admitted a 2001 written reprimand from Hetle’s time as a Bellevue, Washington, police officer for making demeaning comments about an Ethiopian woman’s nationality during a traffic stop. Hetle acknowledged the reprimand but denied making the specific comments. The court ruled the evidence was relevant to malice and that its probative value outweighed any prejudice.¹⁶

How the Trial Played Out

The case went before a Fairfax County Circuit Court jury in October 2021. Defense attorney George L. Freeman IV argued self-defense, saying Hetle believed Prather was armed and was protecting his home and family from a person he perceived as violent, and pointed to neighbors who described Prather as aggressive.⁷

Prosecutors called it a premeditated execution. “He didn’t want Javon hurt. He didn’t want Javon to leave. He wanted Javon dead,” prosecutor Lyle Burnham told the jury.⁵ Their case rested on the video, the HOA email, the son’s testimony about the slur, and a recorded jailhouse call in which Hetle’s wife told him police had seized their security camera and its password, prompting his one-word reaction: “Shit.”¹

On October 14, 2021, the jury convicted Hetle of first-degree murder and use of a firearm in the commission of a felony.⁸ Fairfax County Commonwealth’s Attorney Steve T. Descano called the crime “malicious and racially motivated.”⁹

The Sentence

On January 28, 2022, Judge Randy I. Bellows sentenced Hetle to life in prison for the murder plus three years for the firearm charge.¹⁰¹ He had been held without bond since his arrest.

In their sentencing memorandum, assistant prosecutors Joseph Martin and Lyle Burnham described Hetle’s conduct as showing “callousness” and “a disregard for a specific community,” and said that even in his pre-sentencing interview there was “not a hint of remorse or an acknowledgment of Javon’s humanity.”¹¹

The Appeal

Hetle appealed to the Court of Appeals of Virginia. On February 14, 2023, the appellate court issued its opinion in Michael James Hetle v. Commonwealth of Virginia, Record No. 0304-22-4, affirming the convictions and the life sentence.¹

Who Javon Prather Was

Javon Prather was 24 and served in the Maryland Army National Guard with the 1st Battalion, 175th Infantry Regiment. He was married to Janelle Prather, and shortly before his death he had voted in his first election on Super Tuesday.¹²

Who Michael Hetle Was

Hetle worked as a patrol officer with the South Lake Tahoe Police Department in California from 1992 to 1994 before joining the Bellevue Police Department in Washington in October 1994. Between 1994 and 1999, he completed an eight-month deployment with the U.S. Naval Reserve in Germany, Bosnia-Herzegovina, and Kosovo.⁶

He later moved into federal service. At the time of the shooting, he held the title of executive officer at NASA Headquarters in Washington, D.C., working in the agency’s Enterprise Protection Program, which conducts cross-agency risk mitigation assessments of NASA programs and activities.¹³
