Michael Jackson Estate: Cascio Suit, Robson Trial, and Sony Fight

The Michael Jackson estate lawsuits span sexual abuse claims, a federal sex trafficking suit, a probate dispute brought by the singer’s own daughter, trademark fights, and copyright battles, with major cases still unresolved more than 16 years after Jackson’s death. Co-executors John Branca and John McClain are defending the estate on several fronts at once while a trial on long-pending abuse claims moves toward a 2028 start date.

The Cascio Siblings’ 2026 Federal Suit

In February 2026, four of the five Cascio siblings — Edward Joseph Cascio, Dominic Savini Cascio, Marie-Nicole Porte, and Aldo Cascio — filed a federal lawsuit in Los Angeles against the estate, Branca and McClain, and private investigator Herman Weisberg. The complaint alleges sex trafficking and fraud and claims the estate breached the confidentiality terms of an earlier settlement.1Variety. Michael Jackson Lawsuit Sexual Abuse Cascio

That earlier settlement, signed as a January 10, 2020, “Acquisition and Consulting Agreement” following the 2019 release of HBO’s Leaving Neverland, paid each of the five siblings $2.8 million over five years at $690,000 per year. Frank Cascio, who signed the 2020 deal, is not part of the new lawsuit.2Deadline. Michael Jackson New Sexual Abuse Claims

The estate has called the suit a “desperate money grab” and a “shakedown attempt,” pointing to pre-filing demands from the plaintiffs’ attorneys of $213 million and later $40 million. All defendants, including Weisberg, have moved to compel binding arbitration on the ground that the claims fall within the 2020 agreement.3CourtListener. Cascio v. Robson and Safechuck: Trial Set for 2028

Wade Robson and James Safechuck filed separate lawsuits in 2013 and 2014 against MJJ Productions and MJJ Ventures, the corporate entities Jackson controlled. Both men accuse Jackson of childhood sexual abuse at Neverland Ranch and allege the companies facilitated and concealed that abuse through negligence, breach of duty, and intentional infliction of emotional distress.4Kiss FM Detroit. Both suits were initially dismissed, then revived on appeal. The appellate ruling that revived them established that companies may owe independent duties to protect potential victims even when controlled by the accused individual. In 2024, the two cases were consolidated. Los Angeles County Superior Court Judge Michael E. Whitaker has set trial for February 14, 2028, with a status hearing in September 2026.4Kiss FM Detroit. How a 1994 Settlement Delayed the Biopic

A separate piece of litigation history reshaped the estate’s biggest commercial project. In 1994, Michael Jackson settled a civil suit brought by Jordan Chandler’s family for roughly $20 million to $25 million. The agreement included a clause barring any dramatized depiction of the events surrounding the accusations.2Deadline. Paris Jackson’s Probate Fight

Michael’s daughter Paris Jackson has been in an ongoing dispute with the executors over estate financial management. Her filings accuse Branca and McClain of paying themselves excessive compensation, authorizing improper bonus payments to estate lawyers, and lacking transparency in annual accountings. Court documents show the executors received over $10 million in compensation in 2021, which Paris contends was more than double what any single beneficiary received that year.9People. In a ruling signed April 29, 2026, and unsealed May 12, retired probate judge Mitchell Beckloff, now serving as a private referee, sided with Paris on the lawyer bonuses. He ordered the return of $625,000 in bonus payments issued in the second half of 2018, finding them “arbitrary” and without a “specific and detailed factual basis.” The payments had gone to three firms: $250,000 to Greenberg Traurig, $125,000 to Jeryll Cohen of Saul Ewing, and $250,000 to the late Howard Weitzman’s firm.10Rolling Stone. Beckloff also imposed new controls. The executors may not pay future attorney bonuses without written consent from all beneficiaries or a court order, and the estate must withhold 30 percent of attorneys’ fees on an ongoing basis until formally approved. Katherine Jackson’s Challenge to the Sony Catalog Sale

In late 2023, the estate sold a 50 percent stake in Michael Jackson’s publishing and recorded masters catalog to Sony Music Group. The deal valued the assets at roughly $1.2 billion to $1.5 billion, with Sony paying at least $600 million, and included the Mijac publishing catalog containing songs by artists from Sly and the Family Stone to Curtis Mayfield.12Billboard. Katherine Jackson, Michael’s mother, objected, arguing the sale violated her son’s wishes and that the estate’s “single most valuable asset” should have been distributed to the family trust rather than sold. Probate Judge Mitchell Beckloff dismissed her objections in April 2023. On August 21, 2024, California’s Second District Court of Appeal affirmed in a 19-page opinion. The three-judge panel held that Jackson’s will gave the executors “broad powers to manage estate property while the estate remains in probate” and that the transaction was an asset sale rather than a gift or distribution, so it “neither diminishes the estate’s value nor impairs the executors’ future ability to transfer the estate’s assets to the trust.” The court also found Katherine had forfeited her main argument by not raising it in the initial probate proceedings.13Rolling Stone Australia. Resolved Disputes

Disney Copyright Case

In May 2018, the estate sued The Walt Disney Company and ABC over the unauthorized television special The Last Days of Michael Jackson, alleging the program used substantial portions of over 30 copyrighted works, including the music videos for “Beat It,” “Billie Jean,” and “Thriller,” along with concert footage, without a license.15Variety. Tohme Tohme

Tohme R. Tohme, who claimed to have been Jackson’s sole manager in the year before his death, sued the estate in 2012 for nearly $20 million. He alleged he was owed a 15 percent commission on deals he arranged, including a finder’s fee for a 2008 loan that prevented Neverland Ranch’s foreclosure and a share of This Is It concert film revenue.18Spectrum Local News. Michael Jacksons Estate and Former Manager Settle Lawsuit The estate countered that his management agreement was unenforceable because Jackson signed it without independent legal advice and Tohme was not a licensed talent agent.19Los Angeles Times. Five days into a May 2019 trial, the parties reached an oral settlement in open court. The deal collapsed when the estate insisted on adding a non-disparagement clause and a promise by Tohme not to sue again, terms not in the oral agreement. A judge declined to enforce the oral settlement, ruling that under California law the parties themselves needed to be present when terms were stated before the court, and only lawyers had been.20Billboard. MJ Live Trademark Case

In January 2024, the producers of MJ Live, a Las Vegas tribute show running nightly since 2012, filed a declaratory judgment action in Nevada federal court seeking a ruling affirming the show’s right to continue performing and using the “MJ” name. The operator, MJL 12 LLC, accused the estate of “intentional and wrongful interference” through cease-and-desist letters sent to venues in multiple states, which led to tour cancellations.22Billboard. Michael Jackson Estate Legal Dispute MJ Live Tribute Act The estate called the suit “beyond frivolous” and maintained it owns the “MJ” trademark. Why the Stakes Keep Rising

The estate was valued at an estimated $2 billion and has generated more than $3.5 billion in revenue since Jackson’s death in June 2009. Sony alone has paid the estate more than $2 billion across various transactions since the early 1990s, including the $750 million acquisition of Jackson’s share of Sony/ATV in 2016 and the $600 million catalog deal that closed in 2023.12Billboard.
