Michael Jackson Lawsuit: Robson, Safechuck, and Cascio Cases

The Michael Jackson lawsuit landscape in 2026 centers on two active civil actions against entities tied to the late singer. Choreographer Wade Robson and James Safechuck have a consolidated case against two Jackson-owned companies, MJJ Productions and MJJ Ventures, set for trial on February 14, 2028, in Los Angeles County Superior Court. Separately, four siblings of the Cascio family — long described as Jackson’s “second family” — sued the Jackson estate in federal court in February 2026, alleging sex trafficking and years of abuse. The estate denies every allegation and has called the Cascio suit an “extortionate” “shakedown.” No claim has been decided on the merits.

Who Wade Robson and James Safechuck Are Suing, and For What

Robson, a choreographer who met Jackson as a child in the late 1980s, filed suit in May 2013. He alleges Jackson sexually assaulted him from age 7 to 14, between roughly 1987 and 1996.1Cosmopolitan. Leaving Neverland Wade Robson Suing Michael Jackson Timeline Safechuck filed his own suit in May 2014 at age 36, alleging abuse that began in June 1988, when he was 10, and continued through 1992. His complaint described forced sex acts and alleged Jackson installed chimes and video cameras to detect approaching people, used code words, and told him to lie.2Justia. Safechuck v. MJJ Productions, Inc.

Neither man is suing Jackson’s personal estate, which was removed as a defendant in 2015. The defendants are MJJ Productions and MJJ Ventures, corporate entities Jackson solely owned. The complaints describe those companies as running a “child sexual abuse operation, specifically designed to locate, attract, lure and seduce child sexual abuse victims” behind the front of Jackson’s entertainment business.3BBC News. Michael Jackson Abuse Lawsuits Can Proceed, Court Rules The consolidated claims proceed on theories of negligence, breach of duty, and intentional infliction of emotional distress. Jackson’s estate has pointed out that Robson previously testified under oath on two occasions, including before a jury, that Jackson never acted inappropriately toward him.

How the Case Was Brought Back to Life

Both suits were initially thrown out. Safechuck’s claims fell on demurrer in October 2020, and Robson’s case was resolved by summary judgment in May 2021. In both rulings, the trial court reasoned that Jackson’s companies had no power to control his behavior because he was their sole owner.5Courthouse News Service. While appeals were pending, California law changed. Assembly Bill 218, signed by Governor Gavin Newsom in October 2019, extended the statute of limitations for childhood sexual assault claims to age 40 or five years after discovery, whichever is later. It also opened a three-year revival window from January 1, 2020 through December 31, 2022, allowing victims of any age to revive previously expired claims that had not been “litigated to finality.”6CSBA Publications. Assembly Bill 218 That change made the Robson and Safechuck claims timely again.

On August 18, 2023, the California Court of Appeal reversed both dismissals. The panel held that “a corporation that facilitates the sexual abuse of children by one of its employees is not excused from an affirmative duty to protect those children merely because it is solely owned by the perpetrator of the abuse.”7FindLaw. Safechuck v. MJJ Productions, Inc. The court applied the two-step framework from the California Supreme Court’s 2021 decision in Brown v. USA Taekwondo, asking first whether a special relationship created an affirmative duty to protect, and second whether policy considerations justified limiting that duty.8Justia. Brown v. USA Taekwondo The panel found the special relationship plainly existed: the plaintiffs were vulnerable children employed by the corporations, frequently left alone with Jackson, and the companies staffed the household with employees who facilitated those interactions.

In a concurring opinion, Justice John Shepard Wiley Jr. wrote that treating Jackson’s wholly owned corporations as separate from Jackson himself was to “be mesmerized by abstractions,” calling this not an alter ego case but a “same ego case.”9El País. When the Case Goes to Trial

The two suits were consolidated in 2024. Los Angeles County Superior Court Judge Michael E. Whitaker set trial for February 14, 2028, after delays pushed the case past earlier late-2027 targets.10Rolling Stone. Michael Jackson Abuse Accusers Get Trial Date The delays trace to scheduling conflicts around depositions and the limited availability of the court-appointed discovery referee overseeing pretrial matters. Lawyers on both sides agreed to waive deadlines that would have forced an earlier trial, and a status hearing was set for September 2026 to keep the case on track.11People. At a June 2026 hearing, Judge Whitaker asked whether the discovery referee could also serve as a mediator. Jonathan Steinsapir, an attorney for the Jackson estate, said he would need to consult with his client. Defense counsel acknowledged that the subject matter remains “very disputed” but said the parties are “working as well as we could.”10Rolling Stone. Michael Jackson Abuse Accusers Get Trial Date

The Cascio Family Lawsuit

In February 2026, four of the five Cascio siblings — Edward, Dominic, Marie-Nicole Porte, and Aldo — filed a new lawsuit against the Jackson estate in the Central District of California. The Cascios had been considered Jackson’s “second family” for more than two decades. Jackson frequented their New Jersey home, hosted them at Neverland Ranch, and took them on tour.12The New York Times. Michael Jackson Second Family Cascio

Their complaint alleges Jackson groomed, drugged, raped, and sexually assaulted the children, with some as young as seven, over a period of more than a decade. The alleged abuse occurred at Neverland Ranch, at international tour stops, and at the homes of celebrities including Elizabeth Taylor and Elton John.13Los Angeles Times. Michael Jackson Abused Boy at Homes of Elton John, Elizabeth Taylor, Lawsuit Says The siblings allege Jackson plied them with wine he called “Jesus Juice” and hard liquor he called “Disney Juice,” used pornography to desensitize them, and threatened to destroy their lives and families if they spoke.

The claims are a striking reversal of the siblings’ earlier public position. In December 2010, several Cascios appeared on The Oprah Winfrey Show to defend Jackson; asked whether there had been “any improprieties,” siblings Eddie, Frank, and Marie Nicole answered in unison, “Never.” Eddie called Jackson “a target.”12The New York Times. Michael Jackson Second Family Cascio Frank Cascio wrote in his 2011 memoir My Friend Michael that he could state “with the absolute conviction of a man who saw Michael interact with thousands of kids” that he “saw nothing that raised any red flags.”14Billboard. Frank Cascio and the Arbitration Order

Frank Cascio is not among the four federal plaintiffs, and his dispute with the estate is on a separate track. The estate revealed it had paid him $3.3 million in a confidential January 2020 settlement containing a binding arbitration clause and no admission of wrongdoing. The estate says it paid “reluctantly” to protect Jackson’s legacy and shield his children from further allegations.15People. Michael Jackson Former Defender Accused of Extortion The estate alleges Frank Cascio later demanded $213 million, later reduced to $44 million, to avoid a public lawsuit, which it characterizes as extortion.14Billboard. On March 4, 2026, Judge Whitaker granted the estate’s petition to compel arbitration, finding the 2020 agreement contained “a valid and binding arbitration provision.”16USA Today. The Estate’s Position and What Is at Stake

The Jackson estate, managed by executors John Branca and John McClain since Jackson’s death in 2009, calls every abuse allegation “untrue and financially motivated” and describes the accusers as “opportunistic.” Because deceased individuals cannot sue for defamation, the estate has leaned on breach-of-contract claims and arbitration enforcement to protect Jackson’s posthumous reputation.15People. The financial exposure is significant. In late 2023, Sony Music acquired 50% of Jackson’s publishing and recorded-masters catalog at a valuation above $1.2 billion, paying at least $600 million for the stake, and cumulative Sony payments to the estate exceed $2 billion.18Billboard. Michael Jackson Estate Sells Music Rights Sony Valuation On-demand streams of Jackson’s music reached 6.5 billion in 2023, up 38% from two years earlier, and the estate earns an estimated $75 million annually. In court filings, the estate has argued its ability to pay legal fees is essential to defending the Robson/Safechuck case and warned that a default would be “disastrous.”4People. None of the civil claims have been decided on the merits. The Robson/Safechuck case is in discovery and heading toward its February 2028 trial. The Cascio siblings’ federal lawsuit remains active. Frank Cascio’s individual dispute is in arbitration. What all of the accusers share, and what the estate contests in every forum available to it, is a set of allegations Jackson cannot answer himself.
